  1. HES BEEN APPROVED!! We applied March 25, he had his biometrics appointment yesterday and literally walking out of the building got the notice they are processing it. I got a notice at 4:43 am that action had been taken on his case, to see this: Card Is Being Produced We have approved your Form I-90, Application to Replace Permanent Resident Card They had said it would be 6 months to make a decision from yesterday, it was less than 24 hours!
  2. Ok, I will see what we can do. I'm a bit wary of immigration attorneys, the last one we consulted stole £3k from us 😕 (for a different matter, but it still makes me very wary).

  4. No, no I-407 signed. I didn't think the officer handled it correctly either. Thank you, we will do that then. Ah I didn't realize, I guess if he had to go back we'd have to find out where to go then. Hopefully it doesn't come to that!
  5. They never asked him what basis he was trying to enter. They told him if he'd gone with ESTA he wouldn't have had any issues. I think in the end they allowed it based on being the parent of an American child, but his intention was to come here to live and work as an LPR once he got his green card renewed. 2 of my children and I had already moved back to the US and we won't be leaving again.
  6. Ok so I will try to relay the information as accurately as I can. My husband went through Ireland, and the CBP officer saw his green card (he accidentally had it in his passport). The woman said 'oh you have a green card you can go.' but she was going to scan it so he told her it was actually expired, and it all went downhill from there. He was told to go to a review room, the woman didn't ask him why he was traveling, just straight up said 'So I hear you want to surrender your green card.' My husband had never once said that at any point, and replied to the woman that no, he had no intention of giving up his green card. She then said he had 2 options, surrender his green card, or apply for SB1. Then she said he could ask for a waiver, but that her boss would have to accept it, he'd boss's boss would have to accept it, then it would have to go to a federal judge and that it would take a really long time. She then said there was some 4th option he can't remember. My husband was very concerned about getting our autistic teenager home to the US so he said he'd go for the waiver. The CBP officer said it should automatically be approved because he has no criminal record and never asked for a waiver before. She then said her boss probably wasn't around but she'd try. Then she came back saying her boss was there, but that he'd denied the request. No reason was given. My husband tried showing the government website printout saying 10 year green card holders shouldn't be denied even if it's expired, she said that's for 6 months not 8 years (his card has been expired 4 not 8). She then told him he had to give her his green card regardless of what else might happen. She told him she would give him until May 31st, that it doesn't change his immigration status in any way, and that if he stayed beyond May 31st, they may permanently ban him from the country. He never signed anything and he wasn't given anything other than a printout about how to apply for an SB1. His passport has a stamp that says Paroled until May 31, 2024 Purpose DT' Theres a number written by hand below that. And not that this is anything but it upset me, the CBP officer was rude to my teenager once she found out he's autistic. Nice. So with all that information, does anyone know if he can still file an I-90 from here? She said it doesn't change his immigration status. If that's not possible, could he apply for I-90 from England and get the stamp to come over from the USCIS field office at the London embassy? I'd really like to avoid starting over. I need my husband here. I also need to add the CBP officer never said immigration judge she just called it a federal judge, so my husband had no idea that's what she meant.

  8. Is IJ an immigration judge? He didn't mention that, I'm wondering if he meant the SB1. Ok thank you, I'll look into that.
  9. Thank you for that information. I was wondering how we could still prove his LPR. So we can still file for the renewal from here? I'll get better details when he gets here, but from what I was told he was given 'parole', which I guess means he wasn't officially allowed entry but was allowed in because he had our minor child with him.

  11. ECO is an Entry Clearance Officer, sorry if that's not the right term I'm used to dealing with the British side of things. He's currently on a plane bound for Chicago, delayed though. This is killing me. He didn't sign anything but they did take his green card. We were in the UK for 6 years, and Germany for 1. We don't own property in the US, I had an adult child living in the US but I don't think that's strong enough ties, and I really can't see him being approved for an SB1 based on how long we were gone. I wouldn't have any way to prove we wanted to come back. If we have to start from scratch could he do that from here and still get approval to stay and work here while the green card is processed? Sorry I can't remember the name for the spouse visa anymore. I guess what I'm wondering is how long we're going to have to be apart, I really need my husband to help me raise our kids.
  12. I guess we're going to have to start over. They took his green card. He has severe social anxiety and had no idea he could request an immigration judge to make the decision. I don't know whether to try for SB1, or just give up and start over from scratch as my spouse.
  13. I'm wondering if anyone can help me, this information is extremely new but my husband is trying to get to me (American citizen) and he has an expired 10 year green card. The ECOs are only allowing him to enter for one month. They say he needs some sort of special document from the country we were living in. I was told we could get him here and renew his green card from here, but the ECO is telling him that's not true. Can anyone help me figure out if he can still apply to renew and ask for the stamp in his passport (I-551?) from the US? He's a British citizen. Apologies if this is the wrong location for this post, I've barely slept and I am really anxious. *ETA they want him to apply for an SB1 visa. I don't know how to prove he qualifies for that. The reason we couldn't return was we couldn't afford it and then we thought we couldn't.

  15. Oh I know, that's how he first got overseas to begin with, but the cost of flying him through cargo isn't possible this time around, we weren't expecting to have to leave almost immediately so the funds just aren't there, and there will be no one to take him if I can't get him on the plane.
  16. I'm just paranoid, so many airlines say they allow pets in the cabin and then either have a lot of restrictions on location or simply don't fly anywhere near where we're going. Some won't take pets at all, some only cargo, and often the information is buried in fine print like Delta. If I turn up to the airport with cat in tow and they turn us away I would be devastated.
  17. I've been looking for hours trying to find the answer. There's no way to contact Lufthansa that I can see in order to ensure I've got my information correct. Everything I'm reading says as long as my cat + carrier don't go over a certain weight, I can bring him with us, even on an international flight. It's been several years since we flew with our cat, and back then it wasn't possible for international flights to have a pet in the cabin. We're flying Frankfurt Germany to Chicago on a direct flight. He has a microchip and a 3 year rabies vaccine.
  18. I didnt realize that was an option, thank you. I'm not sure how plausible that would be, but I'll look into it. We won't have a car so will have to rent one and trying to keep costs down.
  19. Thank you. You've given me a lot of hope. What would you call 'soon'? We have to get the kids' passports and we have an elderly dog we won't be able to take with us, we were hoping for one last Christmas before we had to put him down.
  20. So it would be up to the ECO at the port of entry? Do you know if he went before a judge for removal proceedings how liklely they'd take our circumstances into account, and if it would negatively impact a potential future application for a new green card? It's been an incredibly difficult journey for our family, we wanted to go back for a long time but we literally couldn't afford it.
  21. Yes, we kept it just in case. I've read through the SB-1 eligibility, but I don't think we qualify because while we left for my husband to have a new job in the UK, it wasn't his employer that made him move. I don't think we could prove it wasn't our responsibility.
  22. It was a 10 year green card, we left the US in 2016. We did everything ourselves, so no one told us about options to keep his green card if we decided we wanted to move back to the US. 😕
  23. The children are all citizens, we will need to renew their US passports. My husband's green card unfortunately expired in 2019.
  24. My husband is a UK citizen, I'm an American citizen, we moved to Germany a year ago and need to move back to the US. We were not aware we were supposed to formally abandon my husband's green card when we moved out of the US to the UK in 2016. I don't think he would owe any exit taxes (does that affect the application?). We don't have any connections to the US anymore other than my grown child (husband's stepchild) and some family in the state we intend to move back to, no bank accounts etc. Yes, short sighted at the time but we had no way of knowing things would turn out so badly moving out of the US, and to be perfectly honest we were ignorant of the fact that we would need to keep applying to extend our stay outside the US. Our situation: we have 3 children together, all under 18, 2 diagnosed autistic, 1 ADHD, married 16 years. Everyone's mental health here is suffering greatly, but particularly myself and my 17 year old. Due to the children all being disabled, as well as myself, my husband is the only one able to work, and I need him with me to help care for the children. I really cannot stress enough how much I need my husband with me, but I cannot stay here in Germany much longer or I will have a mental breakdown. My 17 year old is also suffering immensely. Would this be enough to be considered an exceptional circumstance so we can go with DCF? And can we get approved for my husband to live and work in the US while we wait for his green card this way? Is there any way to know how much time it will take?
