it has been 17 months since my case is in AP, does anyone here whos case is still in AP for more than 18 months? I sent several inquiries myself and through congressman and always received a same reply that case is still in Administrative Processing! Is it the right time to file WOM after 17 months? or should wait to complete round figure to 18 months or AP will clear right after 18 months? Also during I-130, DS260 and the for the whole process we hired one lawyer which I think he was new in this profession like only have few years of experience at the time we filed i-130. I have a question that, if we go for filing WOM, we should continue with current lawyer, which I am not sure if he is an expert of filing WOM lawsuit or not? For filing WOM is it really necessary to go with a lawyer who have a good experience with WOM instead of someone who dont have much experience? Is there really WOM lawsuit experts, or it doesnt matter we can go with any immigration lawyer? If I change the lawyer for WOM lawsuit, will it create any issue later after AP clear? People who have WOM experience and have knowledge, can you please share names of good lawyers for WOM. Please guide. Thanks

Hi Adam, Did you get a reply and instructions from consulate about Becoming Canadian citizen and getting Canadian passport? My question is that you sent your home country old passport for visa or Canadian passport? On which passport they will stamp US immigration visa, previous home country passport or new Canadian passport who recently became Canadian citizen. Please reply. thanks

Hi Adam, I have a similar case as well like yours, got a Canadian passport recently, when did you send them an email with picture of Canadian passport? did you get any reply from their side about any instruction? Let me know whenever you received any confirmation that now on which passport they will stamp visa either on home country passport or Canadian passport?

Hi many Congratulations, We tried to reach congressman, and we got response that they will contact USCIS on our behalf, I was like our case is at Montreal consulate why contacting USCIS, and tried to explain them, and now waiting for their reply, I want to know, when we request congressman, they contact directly to Montreal consulate or they contact USCIS first, though we tried to explain them clearly about the whole case which is currently in AP. anyways, if they contact through email to Montreal consulate do they send an email to the same email address (montreal-iv-dv@state.gov) where we send for inquiry or they have any other way of inquiring, I am asking because if representative of congressman is unaware of the process then we can share this email address with them. Its been like more than 12 days we submitted request if they can inquire on our behalf, and still they have not done it. Please guide. Thank you

Congrats, I wanted to ask you a question, you could also Adjust status by visiting instead of L1 ? if someone has no option of L1 or TN visa, can someone adjust status while visiting when case is on AP? is there any consequences for adjustment while doing on visit? Also can we get TN easily if we apply, and when AP clear while working on TN , can we just go back to Canada and continue Councillor Process like submitting passport and re medical. Or can we also adjust status while working on TN as well just like you did on L1. please guide in details. thank you

I got 6 updates from the end of April to Mid May, after that no status updated at all, I dont know what is happening, i am so down because of this process, I sent an inquiry in June and got response that my case is currently under administrative processing. As soon as the administrative processing is complete, the Visa Unit will advise of the next steps if anything else is needed to complete processing the case. Since then complete silence, I am going to send them another email now as 3 months already passed when I sent them last inquiry, and will also ask our attorney and congressman to get inquiry,

Congratulations Phil, finally your waiting time is over, mine is still stuck with CV only requested. My interview was also held first week of November, 2023. Now from last week my case start getting updates as follows: Updated on April 30, May 2, May 3. Not sure its a good sign or not? how often your case was updating in last 3 months? can you please share the dates if you have saved the dates for updates.

I have one question: If case is in AP after interview, at the time of Interview applicant was Permanent Resident of Canada, and during this long AP processing time, if applicant apply for Canadian citizenship if qualified and then get Canadian citizenship before passport request or re-medical for IR1, will this cause an any issue in current ongoing IR1 process if one become Canadian? I mean in this scenario, do we will have to inform USCIS, NVC OR Montreal consulate that we just got Canadian citizenship. I just checked I-130 form and DS-260 forms, it was not asked any where which citizenship you hold. Can we do this like if we get Canadian citizenship then just hold Canadian Citizenship certificate but dont apply for Canadian passport and then migrate to US once IR1 visa approved. Sorry if its out of way question, but i thought you guys have great knowledge so someone of them will reply here. thank you
