HOLY #######! 15 years!!!! I did not even think about your visa type. Have you thought about reaching out to your State Senator? They cant do much, but if they usually do get a response from the Consulate when they inquire about a case. I truely hope you find resolution soon, you are so patient and the end is almost here! I wish you all the luck

I totally agree! The color, and them keeping the passport is a good sign! And I fully expect to get the visa issued, they have no reason not to - my fiance is definitley eligible. I just think we have to be realistic and recognize the backlog of cases they have because of covid and hope like hell that they look at our cases soon! Immigration is not a fast process, and requires patience. If you want to be proactive, email the consulate and ask for updates. You might not get a response but it shows them you are waiting for their approval, and wont give up in the face of delays. I email them about every 10-15 days, Stay polite and positive, and ask for an update. We got this - pressure makes diamonds, and if we can wait out the pressure of long distance ON TOP of the stressfull immigration process then no doubt will have a happy, strong, and resisliant relasionship on the other side.

WOM is Writ of Mandamus, a legal document filed by a lawyer that basically makes a government agency perform its duty under law. In immigration, it is filed when a case if outside normal proccessing times. HOWEVER, if you got to the Montreal thread (link below), you will see that a lot of people are filling them but they are being dismissed, and may not be worth it. Some people go to court and the judge rules in favor of the consulate even after the case has waited over a year in some cases. This early on in the process, any laywer who offers a WOM as a solution is out for money in my opinion.

Hello everyone, I know a few people on this thread were given a 221g and are waiting to hear back, but is there anyone here who has recently been issued their visa after 221g? If yes, what was your timeline from interview to admin processing to issued? Also if you emailed the consulate during your waiting period, how often did you reach out to them and what did you say? Thanks ❤️

This seems to be a topic of different opinions. Some past consulate officers have said that an interview if your chance to make your case. According to them, some people show up to the interview and say the BARE minimum, which leaves them with questions. Maybe they mean dont clam up and only say one or two words, I took it to mean: Be a human, be friendly, and answer the questions as best you can. I think what some people would consider "oversharing" is just giving them more of your relationships story. Never a bad thing, IF the story checks out LOL

Okay wow! Thank you for sharing! We discussed it a lot last night, and even though the wait times are longer now, he has the same thought process as you - a long vacation might be nice. He has a very intense job, and for the past few years has been working non-stop 14+ hour shifts, often switching between days and nights. We both think a break would be good for him, and he is prepared for the inevitable moment when he realizes he is BORED lol. His company will hire him back as soon as he has the EAD, even if it takes a year. For that, he is incredible fortunate. But - he's worked really hard for that priviledge. We have a really good support system, and feel that continuing K1 is most likely the best way to go for us. So far the response from the company has been TN visa only... which I now know wont work - he has a meeting with them later this week to discuss L1 visas.

You have to keep checking. They wont let you pay the fee until there are appointments availible. -
For K1, vaccinations are recommended but not required. Tell the Civil Surgeon you are preggos and he will make a note of the contraindication to vaccines. What consulate are you interviewing at? Have your paperwork organized and ready to go. When they ask questions give as much information as possible. Use the interview as a chance to make a case for yourself instead of an opportunity to answer the bare minimum. You got this!!! Good luck

Thank you for this info! I just called him and when I read your comment to him, he said "Oh! TN is what they offered!" So he will call them today and ask about the L1 and see if we get lucky. Good to know TN is a no-go. Luckily, my Fiance is on-top of his stuff, and would comb over that visa info like his life depended on it. So if L1 does happen, he would catch any mistake. I really appriciate all the responses. Knowlegde is power!

This is one of my hang ups... they havent mentioned a specific visa OR put him in contact with a lawyer. They have just stated they are willing but havent taken any action. I will have him call his HR Rep and ask for a meeting with their immigration lawyer. Until then, I cant justify abandoning the K1. I recognize it is more expensive but I am fortunate enough to afford it and with his savings+my income we can survive comfertably while he waits for AOS on the K1 visa. IF they come back offering the L1 petition, we will absolutley consider it. Especially if google is right and the timeline is only 2-4 months. Thank you both for your reponses... hopefully he can get in touch with the immigration lawyer asap.

Hey everyone, this might be in the wrong forum but I wanted some info on the following: My Fiance will be coming to the US soon (221g at interview but passport sent to Montreal Consulate. hoping for an approval soon), and has been in open communication with his work about the process. Long story short- his initial plan was to "quit", move to the states on the K1 visa, and then hire on at the same company after applying for, and receiveing an EAD. (Company is in Canada and the US.) HOWEVER, his company has now offered to keep him employed and sponser a work visa so he can work here as soon as he arrives. I am worried this will effect the K1 process but maybe I am over thinking it. Should he "quit" his job, move down on K1 visa and wait for an EAD like everyone else, OR is it okay for him to be sponsered by his company simultaneously with the K1. Thank you in advance for your replies! I am not willing to risk messing up this process after waiting 2+ years.

Answer honestly always! Answering "yes" will not hurt your chances at this completely different visa. They are looking for your honesty, nothing more. They already know the answer here. Make sure your fiance has all the facts as to why is was denied when they get to the K1 Visa interview, no doubt they will ask about it. Good luck, and welcome to the K1 crew -

No update I emailed them again on 10/31 and have yet to hear back. I am going to keep emailing them until we get an answer. Also for clarification- he is not my husband, he is my Fiance and we have not been married yet. (just incase our case worker decides to stalk my profile Im not taking any chances for misunderstanding lol)

Hello! Welcome to VJ! I am almost near the end of my K1 visa process (hopefully lol) and am happy to answer any questions you might have or lend support if you need. Some advice right off the bat: take a deep breath and trust in the timing of this stange universe we live in. Every single great thing in our life takes time, and every second of waiting is one step close to your success. Lean on the love that you have in the moments where you feel there is no end in sight, because those moment will come. You will both have bad days and you will both have days where you are strong and patient. On the days that he misses you, try to be the stong, resiliant postivity. And when you are down hopefully he can be that for you as well. Mind set is everything. Make yourself busy to make the time go by faster, do your reseach and make sure you dont forget anything. If you are unsure about anything (do i need this? do I not?), proceed on the side of caution and add it to your list of documents. Better to have it and not need it than need it and not have it. You will quickly learn patience, but try to find peace in the waiting. Trust the timing, everything happens for a reason. Good luck! We are all in this together ❤️

Yes! And I strongly suggest emailing them every week or so. Reminding them to look at your case is never a bad idea! Be polite, professional, clear and consise. Reach out to them after your case has passed the 6-8 week mark and keep reaching out till you get an answer Good luck, we are in this together!
