We were officially engaged in January 2004. I began to apply for the K1 visa shortly after through the Texas Service Center. I got notice in March 2004 that our information was being compiled and in July of 2004 found out our information was misplaced (a.k.a. lost). It took a lawyer and additional time (one month) but the information was found. I had COPIES of EVERYTHING just in case.
We ran into an additional problem. It was probably a good thing the lawyer was called upon previously. Curious about our background as a couple, he found out my fiance had previously enterend the US on a J1 visa. She was in Guatemala at the time living out her two-year residency requirement. This made her ineligible for reentry into the US until two years after the date she had left. I did the simple math and found out our interview date at the consulate was going to be six months too soon. We ran the risk of having to file all over again because she was ineligible at the time of the interview. Lucky for us the consulate undrestood the mistake and postponed the interview for an additional six months at which time my finace would be eligible for entry into the US.
Long story short we had a successful interview, she was granted the visa, we entered through Miami, got married and now reside in the Caribbean where I am employed. Lots of bumps and turns along the way but we came out ahead. Now we are waiting for the adjustment of status interview which has been canceled three times. Hopefully it will be done soon.
