  5. Hi everyone, Many years ago, my sister-in-law, a U.S. citizen, filed an I-130 petition for my wife. Unfortunately, the petition was denied because there was no response within the specified timeframe. This was due to my sister-in-law having moved to another country and not receiving the Request for Evidence (RFE). She learned about the situation after contacting USCIS in 2016. I am currently in the process of submitting a new petition for my wife. Should I include the letter my sister-in-law received from USCIS in 2016, explaining the reason for the denial of her I-130, in the additional information for the following question? And one more question about this form: my wife is married to me only and we both don't have children. Should I fill in my own information from 21a to 22 for Spouse 1, write 'N/A' for #23a of Spouse 2, and 'None' for 25a of Person 1, and leave everything else blank, including Person 2-5?

  8. I've included the link in my original post, but I might also attach a screenshot from the USCIS site where I found confusing information. According to the instructions for filling out Form I-130, is the passport photo requirement waived because my wife is not in the US?
  9. Hi VJ members, I've been reviewing the checklist before submitting the I-130 standalone. Is the passport-style photos applicable for me only (USC) since my wife (the beneficiary) is residing outside the US? https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf I'm not sure since I also follow these steps:
  10. My mom came for a visit for almost two months from Toronto Pearson June this year and no questions asked. Her I-130 just got approved last month. She came to visit me twice while her I-130 was pending.
  11. They have Vietnam passports so yes, they are. I guess they must go back home to get the police certificates there in person. 😅
  12. Thanks a lot, Mike. Now I have read this link again and I got confused. So my parents are not Vietnamese non-residents who currently reside in Vietnam. I used their Canadian passports to apply for US visa and they no longer reside in Vietnam. Should they be considered foreigners who no longer reside in Vietnam?
  13. Oh, thanks for the details. They are from Vietnam. We do not have fam there so I guess we have to contact the Embassy and/or Consulate in Canada for their police certificates.
  14. Hi everyone, My parents are immigrants and they have been living in Canada for more than 10 years. They have been visiting backhome a couple times during the last 10 years but never stayed there over a duration of one to two months. They are Canadian citizens for more than 7 years now and they are in their 70s. Their I-130 form got approved recently and we are not sure if they have to go back home to ask for their police certificates there as well as the ones from Canada? I've looked at this requirement and got confused a bit. Thank you.
  15. They were older than 55 at the time and they didn’t do the interview at all I believe. There was no test for them but they must physically present for immigration officers to check their identities and signed paperwork.
  16. Thanks. So we are not going to look into changing anything else regarding the interview country. Am I able to go with them? Or any of my siblings would be okay to do this?
