    Hi, Our timelines are similar. I will post our timeframe below for your reference since we just got to the final step for my fiance's K1. My fiance also has a nexus, and his passport has been with the consulate since August 2023, back when we interviewed. He has been able to cross with his nexus without issue, even up to the point of his visa getting issued. I think you will be fine to visit as long as your pick up/cross with your visa within the expected timeframe. Here is our timeline: NOA1: October 4, 2021 RFE: January 2023 NOA2: March 22, 2023 Interview: August 15th, 2023 Sent DS5535 back the same day as the interview WOM filed January 2024 - which did nothing for our case 8/1/24 Consulate requested passport back (even though they still had it... lol) and repeat medical 9/3/24 Repeat medical 10/7/24 Case approved 10/9/24 Issued 10/10/24 Ready for pick up (since we picked the pick up location as close as possible to the consulate to try to get it asap) Here's to hoping AOS is better for all of us!

    I would email the consulate for clarification on your medical. To elaborate on my earlier post.. my fiancé’s passport was kept by the consulate this entire time, and he emailed them (since they requested for him to send his passport back in the email) and to our surprise they responded within an hour to let him know that it was an error on their end, that the consulate still had his passport. So once my fiancé’s medical is done we should be set. In case anyone else is in this situation, they did request 2 new passport photos to be sent to them instead. It’s crazy how they send generic emails a month late yet they returned his email right away today. Things are speeding up all of a sudden. Hoping everyone else can get out of this situation soon!

    I am back with a good update for a change! We also got an email to send in my fiancé's passport (despite the fact that they kept it at the interview lol) and to repeat the medical exam. Our interview was August 15, 2023 and we are just shy of 12 months leading to approval. I don't think our WOM necessarily helped our case... and we did not have multiple case tracker updates leading to our email requesting the documents. Ironically, the last time we inquired was about a month ago and we got sent the generic email response again without a case tracker update. I checked my email to do something else and was shocked to see I got the email (instead of my fiancé) regarding doing the medical and sending his passport. My fiancé (Canadian citizen) did not get the email. So make sure you are checking CEAC and any emails you may have associated with your case. I will update everyone on my timeline as we finish up. I have a question in case anyone else has experienced this- has anyone else had the consulate send the email requesting to send the passport back, yet they kept the passport after the interview? My fiancé never requested to get his passport back because he has nexus, and has been able to visit using that instead. The email requesting our documents was from a "do not reply" email.. should we just email the consulate the same way we usually do for case inquiries?

    Is there a new spreadsheet with our data on it? Unless I am viewing it wrong, it looks like all of the K1 data was removed from the spreadsheet.. not that I have any good news anyway. Our WOM is likely going to be dismissed (October 2021 filer, interview August 2023...) since the Court is claiming anything under 5 years is not an "unreasonable" timeframe to wait. So disgusted and burned out by this whole process...

    How long did it take for them to return your passport, and did you request to get it back or did they just send it back randomly? They still have my fiancé's passport, he never requested to get it back. I am grateful he has his nexus and has been able to travel to the US without issue.

    "Did they ask for your passport when they have you the 221g? I wondering if taking my passport was a good sign, or if it was just a mistake by the CO. Does your status explicitly say AP? Did you get any updates to indicate you were getting more vetting? That is terrible that they told you a few weeks and it has been 10 months. Has anyone tried going to the consulate in person to get more information? I live in Montréal, wondering if that is a way of getting additional information" @Cadtoverm - the consulate kept my fiancé's visa and issued DS5535. We've been waiting since our August 2023 interview. We were told we would be sent an "email questionnaire" and it was the DS5535. Out of denial, we tried to talk to the officers at the consulate in Montreal, but they didn't let us inside. Not to be the bearer of bad news, but to save you a step since we already tried. 😅 I am so sorry to hear that you are stuck in your current circumstance. This is an awful and poorly streamlined process.

    We just filed with Goldstein before the fee change.. hoping we have some success, I figured we had nothing to lose even if the WOMs have had push back recently. Goldstein seems to have a method that works for them . I have a feeling the fee increase is due to the extensions they’ve been facing.. but I will update the timeline as we go. Our interview was August 15, 2023. So it’s been 5 months, and after our 4 month wait inquiry with the consulate they got back to us in 3 weeks with the same generic AP message… seems like we are getting nowhere without intervention.

    Our case was updated weekly post interview in mid August… (7 updates between August 15th and September 11th) but we have had no updates in 3 weeks now. We will likely be filing WOM as soon as possible, seeing that most cases in Montreal are not resolving naturally in a reasonably timely manner... Our lawyer recommended starting our case with them at the 2 month mark and suing at 4 months post interview. I’ll be updating the excel sheet as we go.

    Wanted to update that our 221g had medical and “email questionnaire” listed (aka DS-5535…) and the consulate got our medical results one day after our interview (8/15/23, 8/16/23) then emailed us 11 days later to inform us that they had our medical results. Our case has been updated 3 times since the day of the interview, but is still listed as “ready”. I’ll attach the email below. I am glad that they are working on our case and wish there was a way to say just finish what they started before our case rots on someone’s desk..

    That is really helpful to know! I was fearful that it would trigger again some point later on, even though our case is straightforward. We will figure something out to get through this, hopefully not taking too much longer.. The only new information they have from the DS5535 is the rest of my fiance's travel history. It's a shame to think it will take months sitting on someone's desk to process something so simple and pointless, but that is the common theme for this thread I suppose! After this is said and done, I am going to see what more I can do to advocate for a better legal immigration system. We really don't deserve to deal with this.

    Oh, interesting.. I wish they were transparent about the processing rather than telling us to fill out an email questionnaire and nothing else lol. I am grateful that everyone has been able to share their experiences so we do not get stuck waiting even longer- it has already been nearly two years and we haven't even finished our K1 yet. Adjustment of status to get a green card comes afterward, so another year of waiting by the sound of it. My fiancé lives in QC and I live in upstate NY and practice here. We are able to see each other often now that the pandemic has calmed down and I am finished with my schooling, so I know we could have it much worse. I did not think we could legally get married before filing for a K1, and it wasn't until we waited over a year (original processing time was 5-7 months when we filed) we saw that people could get married and file other visas that process a lot faster than ours. It is all hindsight now though. And it sounds like once we get a DS5535, we will get one again if we file for anything else (I could be wrong though, since there really isn't much transparency from the governments behalf on this..).

    Has anyone filed a WOM before the 60 day mark? I've read through about 30 pages of this and checked a couple of the google docs but it gets depressing to keep reading... Hopefully when next week rolls around I can consult with some of the popular lawyers mentioned here, and see what options we have moving forward. I appreciate the information, but I am a licensed doctor of physical therapy in the United States. I only read into it years ago (pre-pandemic) but transferring my license would be costly and they made it seem like I would have to take courses again to practice there (might have been Quebec specifically though). But at this point I've accepted that I'll probably have to dump thousands of dollars into a lawsuit to get our case over with anyway... such a flawed system.

    Hi, New to this dreaded journey. NOA1 for I-129F on 10/4/21. Already had delays from an RFE for further information to prove a bona fide intent to marry before NOA2. We waited over a month for interview dates to pop up, and were able to book an interview one week prior to our interview date. Because of this, our medical did not arrive in time (they sent it 1 day after the interview....) Because of this, we got a 221g for medical and were told to fill out an email questionnaire to "avoid delays". Our email was labeled DS5535. Our case has been updated the day of the interview, still stating "ready", and the day after the interview when they received our medical results it was updated and still says "ready". They kept my fiance's passport at the end of his interview. So the waiting begins. Now I am trying to figure out what to do next. I am in the process of finding a lawyer to seek legal input, but would appreciate any advice from others who have recently (late 2022/2023) been in the same boat. I hate being sent into uncertainty after waiting so long. We did not know it was possible to get stuck in an endless cycle at the last stage before getting married. Our wedding is supposed to be planned for the end of October 2023. I am devastated to see the degree of delays, knowing it will impact our wedding date after we were so excited to finalize everything when we got our interview date. We let everyone know with the delays it would be a stretch, but we were really hopeful to make this happen so my fiance's grandmother (90 years old) could make it to the wedding. After reading through the recent entries here, it sounds like it is rarely processed within 60 days, but that is the supposed time frame before anyone is willing to take legal action. Has anyone ever dropped their K1, got married, and started over filing for a CR1/I130? I am even contemplating dropping the whole visa and moving to Canada instead.. I am a medical professional so I could use that to my advantage, but that was one of the main reasons we wanted to settle in the US (did not want to take another licensure exam, language barrier would prevent me from using my degree in Quebec and we both live along the Canadian border in QC/NY). With all of that said, I would like to give everyone here a virtual hug. What a process to be able to live with our loved ones.
