Hi There, Can someone advise my case: - I have a B1/B2 US Visa that is valid 2022-2027. - I first entered US: 15 Apr 2022 - My i-94 said Valid Until: 14 Oct 2022 - My i-94 said Expiration Date: 30 Apr 2022 (on the bottom right of the page) I misunderstood that I must exit the US on 30 Apr 2022. Other than being confused by the Expiration Date on my i-94, upon my interview with immigration officer in the entry port, I also showed him my original return ticket which was 30 Apr 2022. Hence, my misunderstanding. - Therefore, I filed for i-539 for extension of stay, wanting to stay until 6 May 2022. - I returned on 6 May 2022, and while I was in the airplane, I receive USCIS email that my biometric appointment was scheduled on 1 June 2022. - I called USCIS on 10 May 2022, explaining that I have left the US and my i-539 was pending, and my biometric appointment is on 1 June 2022. They told me there's no solution but to keep rescheduling until indefinite time. - I emailed my local US Embassy on 10 May 2022, explaining the situation and asked if I can have a biometric appointment in the local US Embassy. They said they cannot do it (I assume it must be done in a USCIS office). - On 11 May 2022, there was an email from USCIS confirming this reschedule request. - On 11 May 2023, there was an email from USCIS informing me of my i-539 denial. Then here's the confusing part. - In the meantime, I got married with my husband who is an American citizen (Nov 2022). We've been since living in my country and plan to continue living here for indefinite time. - We need to visit US for 2 weeks on 21 Aug 2023 (we already bought un-refundable tickets). We exchanged emails with US Embassy asking if my Visa is still valid (they cannot give definitive answer until today). - At first they replied our email saying, quote "If you travel abroad while the I-539 process is pending, USCIS considers the application abandoned. You will need to apply for a new Visa to re-enter the U.S.". - Then after informing that this is a non-immigrant Visa and I do have Visa that is valid until 2027, one officer called me and said that it was unnecessary for me to file the i-539 in the fist place and it should be no problem as long as I can explain this whole situation to the immigration officer in the port of entry. - Later on she called me again and said that she wasn't sure now and need to confirm with the other local officers in the Embassy. - Later that day they replied my email saying, quote "After further discussion, the best option for you is to apply for a new B1/B2 Visa. The previous Visa most likely automatically cancelled if you left the U.S. while I-539 application is in process.". - So I filled in a DS-160 as preparation for new Visa application. - Then I went to the website for the New Visa application, and the earliest available schedule is 14 Sept 2023, beyond our planned trip date. I thought well what the heck, let's just book an appointment, there's always a chance to reschedule - perhaps someone will cancel their earlier appointment. So I made a payment and the system doesn't recognize the receipt number. And I left my laptop, and several hours later I came back and the page needs to be refreshed. After that, the whole online process that I went through was gone. I am planning to make another appointment and payment. - In the meantime my husband asks the US Embassy again, if anyone can just check if my Visa indeed is now invalid or it is still valid. So we don't have to go through the application process. They haven't replied us, probably already sick of us lol. At this point, do you recommend me to just hop on that plane and risk being asked to turn around upon landing? Or shall I just not go? We just found out that I'm 4 weeks pregnant, and I'm excited to meet my in-laws in the US and celebrate this together. But I'm also worried if I have to go through 60 hours of plane ride (return trip) in one go - it sounds brutal. Thank you for any advice!
