  1. I had a quick look on your timeline. So, almost after 2 years, this year in June 2023 they send a RFE. May I ask when you replied? Usually after reply it goes fast(er). Or your IO is on vacation.

  3. I filed my joint petition I-751 in February 2022 and I'm MSC/NBC too. So far nothing.
  4. I totally understand, thank you. This was my thought process: I did the withdrawal, that's why I thought my case status would be now: Application withdrawn / instead Interview cancelled. (in my opinion) it was just the wording, at the end of the day of course it doesn't matter, it's cancelled, i get that.

  6. Hello all, I did a withdrawal request for my N-400 application on June 15. I applied for N-400 originally on May 9th. On July 11. i received an interview notice for 08/24. basically after I send a withdrawal. I guess it got overlapped. Last week I received the cancellation notice which states: This is to advise you that, as requested, we have canceled the interview on Thursday, August 24, 2023 at 08:00AM for the above applicant. We will advise you of any further action taken on this case, including any rescheduled interview information, under separate notice. Now my question is: the status says "interview cancelled". why not "withdrawn"? or is it the same thing? I specifically asked to withdraw my N400 due to health reasons and me not being able to move forward with my application as of right now. thank you in advance

  8. Well Probably not anymore my interview got cancelled today upon my withdrawal request from June.
  9. I filed ROC 751 in 02/2022 and filed N400 in 05/2023 - got a notice on 07/11/ for an interview N400 on 08/24/23. my 751 is still pending though (MSC)
  10. thank you. we fully support and still love each other. we are just going through rocky times and have the financial resources to take a physical "break" from each other but that wasn't mine point or original question. i just wanted to know if my documents are "alright" as proof

If the married parties timely file the I-751 joint petition within the 90 days immediately before the two year anniversary of the date of the expiration of the conditional permanent residence, the parties appear for interview (or agree to appear), the marriage was legal, the parties have not divorced, and there is no evidence or proof that the marriage was entered into for the purpose of procuring permanent resident status, the law and regulations allow for the approval of the I-751 even though the parties have separated
  12. this is not accurate & i already stated in my original post: what I will bring with me: my attorney.
  13. Again - we can not file for divorce in Virginia - have to live separate for one year and I will not get "pushed" into divorce.
  14. my attorney, who is local, and in that local field office all the time, stated that a separation does not mess with my I-751, she also said that I might have good chances on N-400, since we lived together when I filed for N-400. ( i know what the law says, living together up until oath ceremony, so i don't have my hopes up, i did withdraw my N-400 per letter, but I was scheduled for an interview anyways ) I was simply asking how my documentation looks like.
  15. a divorce is not in the picture and either way, i live in virginia and i can not file for divorce - and i won't - only in one year after living separate for one year. I spoke to an immigration lawyer, she said I shouldn't have issues for my I-751. our intention is not to file for divorce, we are taking some time apart so things can cool off, we are both in therapy, hoping for reconciliation.
