Hi folks,
I had my interview for my NIW-EB2 case on October 2023. After the interview, the consular officer asked me to email my 212(e) waiver for my previous J1 visa and then they will grant my immigrant visa. As the process is very time consuming It took more than 7 months to get the waiver from USCIS. Finally, on 18th June 2024 I got my I-612 and emailed the copy of my waiver to the embassy. The embassy did not reply my email and I tried multiple times. I called them however the phone is never reachable. Its already more than 15 days I am getting very worried about it. Could you kindly suggest what shall I do in such situation? Your expert advice would really help.
Thanks in advance!

Hi Everyone,
Looking to see if anyone else is having issues with getting the embassy to respond to email questions. My fiancé is the Irish citizen and we are going through the K-1 visa process and we are getting towards the end of the validity period for his i-797. It expires 5/29/2024 but the medicals are booked up and he couldn't get an appointment until 6/14/2024. The only time they answered us was when they said that the i-797 can be extended once they receive the notice of readiness, but the documents they included in the email say that the notice of readiness can't be sent until he has the medical exam results. This whole thing is making no sense to us and we really need help. Anyone out there who can help us out? Thanks in advance!
HI @ascotty94, did they reply you? I was told to submit my waiver document via email but once I did that I did not get any acknowledgement. It's already been more than ten days I did the follow up via email but still no reply from the embassy here in Dublin. I tried to call but the phone is never reachable.

Hi,
I got my receipt from USCIS after 2 weeks of the favourable recommendation from DOS. Its now nearly 4 weeks I have not received the case approval from them. According to USCIS technically 4 weeks is the processing timeframe. Hope somebody can share their latest timeline?
Thanks!

Who funded your program, and is your country and skill code on the Exchange Visitor Skills List? It’s possible a mistake was made before that the current consular officer caught.
Its funded by the University in US and my DS2019 clearly stated not subjective to 212e.

Is this the only J you have had?
yes its the only J1 I have.

The visa in your passport will say if you are subject to 212e.
What were you doing on a J?
I was doing Postdoctoral Research in J1 visas in the US and it clearly mentioned in the visa sticker that I am not subjected to 212e. I showed that to the the visa officer and the officer said yes I saw it but you still need the waiver. That actually made me quite surprised/confused !

No
No, more likely a confusion.
Assuming you do not need a waiver then however long it takes to clarify matters. Waivers are not a given if needed and vary according to the reason why someone is subject to one.
Yes I tried to make the visa officer understand that I don't need waiver but the officer insisted me to get that done if I wanted to get the visa in my passport. It took me more than one year to get the interview appointment for NIW-EB2 and then all medical test done. Then again I need to do that J1-waiver which is really time consuming and might take 6 months or more due to COVID backlog. So frustrating !

Hi Folks,
I am writing to seek your advice regarding the necessity of obtaining a J1 waiver for individuals who are not subject to Section 212(e), the two-year home residency requirement. My concern stems from a recent interview with a visa officer for my NIW-EB2 green card, who inquired about the J1 waiver despite my previous J1 visa explicitly stating that I am exempt from this requirement.
Given the critical nature of this matter and its potential impact on my ongoing processes, I would greatly appreciate your guidance on the following points:
-
Is it customary for individuals not subject to Section 212(e) to still require a J1 waiver?
-
In light of the visa officer's query regarding the waiver, could this indicate a change in policy or an oversight in my specific case?
-
Understanding that processing times can vary, what is the typical duration for obtaining a J1 waiver under current processing conditions?
Your prompt response to these queries would be immensely helpful in navigating this situation and ensuring compliance with all pertinent regulations.
Thank you for your help.
Cheers,
MohTim

Hi all, I've received the interview letter, and my interview at the Dublin US Consulate is scheduled for the 19th of October 2023. In preparation for the interview, I've been trying to schedule the required medical test at Mater Hospital. Unfortunately, after reaching out via email, I was informed that the earliest available date for the medical test is the 23rd of October. This timing has left me a bit concerned considering the proximity to my interview date. I kindly request your advice and assistance on this matter. Is there any possibility of expediting the medical test process? I find myself in a bit of a dilemma and would greatly appreciate your insights and suggestions on how best to approach and resolve this situation.

I did send one inquiry, but as you mentioned, the reply was copy and pasted, just saying "first in first out" and I need to wait..."they can not predict how long" blabla BS. So frustrating and do not know what to do.
Hi @Aaron2013, any update about your IL? I saw one applicant got his IL in August 2 who was DQ in March 31, 2023 for NIW-EB2? I still haven't got mine though?

Soon will be 4 months after my DQ, and I am still waiting. The more frustrating thing is even though NVC says "first in, first out ", and they have a priority over different visa types, we don't know how the queue works...I have no idea about their algorithm. If family visas have more priority than employment visas, how long exactly should we wait, what if EBs DQ 4 or 6 months before FBs, will FB still have priority? It is so im transparent and frustrating.
May be I am wrong but I think the immediate relatives (IR) are given the priority over other categories. I seriously doubt they have any algorithm to rank the categories of the case 😉 !. Btw have you thought of inquiring NVC about your case? I think most of the time they give the copy/paste answer. Hope they don't make 12 to 13 months of wait time after DQ for issuing ILs.
-
Hello all, when does NVC send out interview letters? Is it usually start of the month? Middle of the month? Or do they send it out throughout the month?
-
Hi @Aaron2013, its frustrating to see that EB2's are not given the priority as CR1. I thought after 3 months max of receiving DQ, you will get the IL but I am not sure how much more we have to wait. My current job contract is going to finish from this end of August, not sure what to do either start searching new job here in Ireland or still wait for the Eb-2 interview. 😞 !

Hi all,
I was DQ in April 21, 2023 with EB2 NIW and am in the queue for an interview now. Any idea how long it takes to get an interview date this year at the U.S. Dublin Embassy? My PD is also current.
Any help would be appreciated. 🙂
Thanks !

Exactly just waiting at the moment. However, my fear is what if they don't respond. That is what makes me confused and stressful.
