  1. I wonder when we will recieve that RFE since we did the same as you.......RFE for the I-864 being addressed now
  2. Think I figured out the RFE The RFE is a generic one, that includes everything regarding what the I-864 should have. I just looked at mine (RFE) and it says this in one portion: The "Total Income" line on IRS Form 1040 is used to determine qualifying income for a sponsor, not the "Gross Receipts" line from IRS Schedule C or C-EZ. My 2022 1099R shows Gross Distribution as over $100K, but the Total Income on the latest Tax transcript shows only a little over $32K. which would still be enough for a household size we have. a Line above that which is labeled "Total Pension and annuities total shows the over $100K. I also looked at the I-864, and I did not put the correct amounts in Part 6 section 24a, 24b, and 24c, the total income was the Gross income I listed and not the Total Income from the Total income line...my mistake. Yet i show that in Part 20 my current annual household income is over $100k. Guess I should have put the right amounts in those bottom boxes and submitted the 3 - 1099R's with everything and I would not have received an RFE....just surmising here. I just finished putting together a letter of explanation along with the cover sheet indicating the contents I will be including in the packet. The issue I believe was that my tax transcripts show my total income as low and I did not include my 1099R's for the past 3 years, each show a gross distribution. With a smaller taxable income. Since I retired on a disability retirement a large portion of that monthly income is un-taxed. I had included a pension verification letter which shows what my lifetime defined benefit income is monthly, annually its over 100k. It looks like they ignored that or did not see it, but its in the scanned documents on the site. I will also be including my last 3 years 1099Rs as well as the tax transcripts again along with 6 months of paystubs, 12 months of Bank statements, and a new Pension verification letter with the wording Defined Benefit Lifetime Pension highlighted and the Monthly amount Highlighted as well. I have also included all of the above in my letter of explanation as well indicating I also own my home and my monthly pension pays for it and all of our daily living expenses. I also included a 1 in the box 3 of Part 5, which when you add it and box 1 and box 2 makes the household size 3. I should not have listed being married right? as my wife is listed already in box 1. I need to add my ex-wife into box 6 as I sponsored her in 2014 and we divorced in 2018 after being married for 6 years. She is remarried, and I am not sure if she has become a citizen yet or worked the 40 quarters in 10 years......so that would make a household size of 3, even though its just the two of us. So if I am looking at this correctly the 125% poverty limit for 3 people is $31,075 and my 2022 Total income line reads a little over $32k for 2022 on the Tax transcript, so that alone should be enough....in theory. So the RFE must be because i had listed household size originally as 4 instead of 3, put the wrong amounts in the three years tax returns boxes, and did not include the 1099R's, or bank statements and listed those accounts as assets. I will be correcting those issues, as I indicated and then re-submit the corrected I-864 with all of the evidence once again. The package is going to be huge with 12 months of bank statements for 2 accounts (each is 4 pages), 6 months of pay stubs, the 3 tax transcripts which are each 6 pages, the 3 - 1099R's, the Pension verification letter, a new copy of my birth certificate, the Letter of explanation, the Cover letter, and the 3 page RFE.........hard to believe there are so many pages, all total 130 pages.....going to need a box to mail it to them......sad I will keep you folks updated. Not sure I need to find a Joint sponsor as my income is more than enough. On another note : My wife completed her biometrics appt on yesterday. Status online updated on 11/29 to cases being actively reviewed. Glad they let her walk-in in Riverside, Ca. I765 says estimate of 3 months for a decision I485 says estimate of 4 months for a decision Fingers crossed, EAD decision falls within that timeline or sooner.

  5. Got it. Thanks. I also was married before and sponsored that one many years ago. Not sure if she is a citizen or has worked the 10 years yet, so I still need to put a 1 in box 6, and that would make my total household size 3, even though she is also re-married, which does not absolve my sponsorship......sad really. That marriage ended in 2018 after 6 years.

  8. My 1099R's for the past three years were not submitted, my mistake. I will include my Roth IRA's and Bank statements for my accounts, which should put the amount well above the threshold. Other than that not much else to be done. She is already here in the states, (K-1 Visa) and then this is for the AOS after we were married in October. The I-134 was accepted for her to come to the US, so I am not sure what happened here. I will also include a detailed explanation with the additional forms I will send as well as now amending the original submitted I-864.
  9. Took just over an hour for my wife's biometrics when we dropped in today. Now to figure out the RFE for the I-864 issue....no I do not have anyone who can be a joint sponsor. I make over 100k a year from my lifetime pension and I am going to be 60 this year. No other family except my kids from my previous marriage who have there own families.
  10. No joint sponsor available as I am the last of my family alive except for my kids who have there own lives. I downloaded 3 years worth and sent them with the I-864. I make over 100k from my pension which is a lifetime pension and goes up annually with COLAs. I am medically retired and will be 60 this year.
  11. 2 hours from the door to the USCIS support center, just arrived and they went ahead and let my wife in one day early after she explained I worked tomorrow. Now waiting for her to exit. I hope submitting the 1099R, doing a new I-864 and listing my houses title certificate and my Roth IRA accounts along with bank statements satisfies them. The issue of support is not for retired folks who have just an un-taxed pension apparently..... Made the address change online since they swapped the order of 2 numbers in the address when they uploaded it. Funny how we received the NOA's with the right address.... Can I just upload the RFE info? Or do I need to mail it?
  12. I am on a pension and only get a 1099R form. My Pension letter and pension pay stubs show how much I make yet only a small amount is taxed and shown as total income. I received an RFE for the I-864 of which i am sponsoring my wife. I own a house which I did not list as an asset. How do I get USCIS to understand

For the RFE - Additionally, my total income looks low to them as I am on a Medically retired pension of which only a small amount is taxed, and so it seems that I make less than I do. They did not bother to look at the Pension letter which is uploaded or my last 3 three pay stubs I included. I think I need to upload the 1099R and a letter of explanation, as well as including my current home as an asset. Do you folks think I need to upload the last three months bank account statements?

  15. Just used ask Emma. It gave me an access code. Added the case to my account. Found the Biometrics letter and the RFE. The Biometrics is scheduled for tomorrow at 1pm. Can we arrive early and how long does it usually take as I have to work (Petitioner) at 4pm. The RFE is for the I-864, it says they could not determine if I the sponsor am qualified. I receive a Pension every month which is over $110K a year, I do not have W-2's. I have the 10-99R if that's what they want, but I sent them the last 3 months retirement pay stubs which shows the monthly amount along with the last 3 years tax transcripts, and the annual pension letter from my Pension program which shows what I receive every month. I own a house but am still making mortgage payments on it. No way I can find a joint sponsor. Apparently whoever did the data entry for the address also put in the mailing address wrong and that is why the documents never arrived. How do I change that?
  16. Still waiting for the mail to deliver the RFE the case tracker says was mailed on the 14th of November. Still have not received the access code in the mail either......sigh. I tried the USCIS request program since we have not received the RFE and it says we need to wait until the 30th to do the request.
  17. Still awaiting the RFE and the login access code....I know it was the Thanksgiving holiday but it (RFE) was mailed supposedly on the 14th....

  19. Just looked over my wifes I-485.. I think I know why the RFE. I checked the "No" box for the public charge box instead of yes and filling out the other questions......ugh. Now to just wait for the RFE to confirm that's what they want....I hope so. Not sure why I selected "No". She is not an asylum or refugee seeker per se, yet she is from Myanmar, and us an ethnic Karen who are being persecuted and hunted down by the Junta.
  20. We shall wait and see. I hope thats it. If it's for needing a birth certificate then it's a lost cause as she's never had one, is from Myanmar and we had affidavits done as well as certification and notarization by an attorney in Thailand. They were accepted for her K1 visa there. I submitted all of her medical paperwork, given after her medical prior to the K1 and the extra hospital documentation of the added vaccines she needed to complete the series. The marriage certificate is a certified and stamped original. If it's for the Affidavit of support, well then who knows. I was married before and my ex-wife came to the US in 2012 on a IR1, but after 6 years here we divorced and she remarried a millionaire, yes a real millionaire. Do they ask for divorce paperwork? That was all given in June for her K1. They should have all of that I go in the sealed package we carried and gave to the CBP at our POE. I did not send any photos with the packet, so again who really knows what they want. If they sent the RFE on the 14th, then it should be here today or tomorrow, but my USPS informed delivery does not show it arriving today. Talk about being g stressed and it's Thanksgiving week, and my kids and there families arrive e today for the week.
  21. Just used the case tracker app......depressed now apparently they sent an RFE notice on the 14th. I thought I had included everything in the I-485 packet......guess we will find out this week. If we had the access code I could check on the USCIS site to see the document, but alas no access code yet.
