    My I-94 is not expired. In order not to overstay it, I applied for EB-2 NIW on time and was in legal status until I received a letter of denial dated 06/14/2023. I understand that I have 30 days from 06/14/2023 to file an appeal. But I would like to reapply. Do I have 30 days or more to reapply or how long can I reapply after the denial? I do not think that I will hire an attorney.

    My evaluation says: "...The diploma is, in level and intent, the academic equivalent of a Bachelor's degree and a Master's degree in architecture (first professional degree in architecture) from a regionally accredited institution in the United States. The degree is also the first professional degree in architecture in her country."

Many wrote that I need to have a Ph.D. or master's degree, but what about a Bachelor's degree with 5 years of experience? See also below: You can pass the General EB-2 Eligibility Test by meeting 1 of the following 2 criteria: You have an advanced degree (Master's or Ph.D. Degree), or its equivalent (Bachelor's Degree and 5 years of experience); or You have demonstrated exceptional ability in your field.     Hello Boiler! I have a work permit based on Form I-140 (EB-2 NIW). I work officially. And then I-485 hasn't been turned down yet, it's on pending. Do you think I can apply for EB-2 NIW again to stay legal? And during this time, I find a job and apply for EB-2 or EB-3.

    I am working in photoshop now. I sent my resume to employers, but I'm not getting a job yet. The whole reason is that I came on a B-2 visa and really want to be useful in America by working here.     Thanks to all who responded. My I-140 was denied, but my I-485 is still pending. I am an architect. I have six years of Bachelor's education. Yes, I have a lawyer. He answered the RFE, and then the refusal decision came. Here's why: - "The evidence submitted is insufficient evidence showing you are well positioned to advance your endeavor." - "Although your resume shows your work history, the expert opinion letter attests to your exceptional ability, substantial merit, and national importance of your proposed endeavor, and that you are well-positioned to advance your proposed endeavor, the submission of solicited letters and resumes supporting a petition is not presumptive evidence of eligibility. - "The two letters from your previous employers show that you were employed as an engineer, but they do not demonstrate that you are currently employed in your proposed endeavor, or that you have had a leading, critical, or indispensable role in the endeavor." - "The document titled, "EB-2 Personal Plan" does not satisfy the requirement for presumptive evidence of your notable successes either, and only outlines your work history, education history, and how you plan to advance your proposed endeavor." - "You have not shown that your work has served as an impetus for progress in the field or that it has generated substantial positive discourse in the broader legal community. As the record is insufficient to demonstrate that you are well-positioned to advance your proposed endeavor, you have not established that you satisfy the second prong of the Dhanasar framework. Therefore, you have not established that you are well-positioned to advance the proposed endeavor." I'd like to reapply by myself and I do not know which requirements to update and fix. I will be very grateful if someone can help me.
