  1. Hi all, I have bit of a complicated situation. I married a foreign national in 2023. In 2024, I filed my taxes as married filing separately. I had to paper file as my spouse did not have a ssn. My spouse will be entering US in May of this year. After entering she will receive her ssn and green card. From my research I have two option for filing taxes this year. Option 1: File married filing separately and then amend the taxes after she receives her ssn. I can’t file joint because she needs to request ITIN and has to send original passport as an additional evidence which is not possible. With this option, I read that we won’t be eligible for certain credits like EIC since ssn is needed on or before the due date of the return that is filed. I don’t mind this as we wouldn’t qualify for these credits anyways. My concern is that will we be able to use higher standard deduction when we amend to file MFJ. Option 2: File for extension so that we can use wife’s ssn and file jointly. When I fill out extension form 4868, I read that I can put “ITIN TO BE REQUESTED” for my spouse since she doesn’t have ssn. Is that right? This means I have to mail this form and can not e-file? For my state, NJ, I found following instructions for extension: You enclose a copy of your federal Application for Automatic Extension, if filed by paper, and fill in the oval on the front of your NJ-1040; or You file Form NJ-630. Does this mean I have to do nothing now and then just file by mail and just check mark on NJ-1040 where it says “federal extension filed” when I eventually file my taxes. And should I just pay my tax online before the deadline of April? I’m leaning more towards Option 2 as I heard that there’s a huge backlog of forms 1040X.
  2. She got her passport recently and she had to provide school leave certificate which is an equivalent in India for BC. I don't even get why anyone would have fraudulent Id of BC. Every single of her document is under her actual name. This thread is going on a tangent. We are extremely stressed right now and accusing us of a fraud is not needed to make me even more depressed.
  3. Officials are saying that once the birth certificate is issued there's no correcting or amending it. Her birth date, father's full name and mother's full name is the same on all document and birth certificate. Not sure how to move forward at this point.
  4. It's actually John Smith vs Ben Afflek different. She said that the name on birth cert was put by her grandma during the birth by mistake. To create passport, she didn't need to submit birth cert and submitted other form of e idence under her actual name. She won't be getting a new birth certificate, just affidavit and name change document. We already submitted DS260 so can't put the name on birth certificate in the other name section. How big of a problem is this?
  5. Hello, I'm petitioning for my wife for CR-1 visa. We are at the NVC stage. We noticed that her name is different than her name on all documents. Just FYI, my wife's country is India. We are trying to get Gazetted (Registered name change). Should this be enough? They were told that the birth certificate can not be changed. Any help would be appreciated.

  7. I don't know why they would be starting to review cases sent couple of months ago rather than reviewing case sent more than a year ago.
  8. Hi all, I submitted i-130 application for my wife in June 2023. I submitted all the supporting evidence separately(each separate pictures, separate pdf for 401k beneficiary, separate pdf of my visit to wife's country. ) I read lot of comments where people uploaded one pdf with all evidence while providing some details of the evidence. Did I mess up? Can I upload unsolicited evidence now with one pdf combining all evidence? Thanks

  10. I have read here that people get the receipt within 1 or 2 days when they file online.
  11. Hello I submitted I-130 for my spouse online 7 days ago. However, I don't have NOA1 letter in the form of a pdf that people usually get here. Is this a normal occurrence? Thanks
