I thought the same until I saw those posts. Given that people in the US can see her history of violating immigration rules in one of their allied countries, it could cast a negative light. The DS-260 form does ask about history removal/deportation from any other country implies they do care, don’t they?

Hi everyone, My wife is out of status in Canada (previously an international student from Vietnam but has dropped out for about 2 years). Will this affect the decision once she gets to her interview at HCM city consulate? I asked this question before in the forum and folks said that it shouldn’t have any affect on the matter. But now I’ve heard mixed information from Facebook posts as well as Reddit. Generally they say her overstaying in Canada does have effect, especially since Canada and US shares immigration info. So, what do you think? Also, we’re at NVC stage now. Once she obtains her Canadian police check, will it contain information about her overstaying info? Or even her going to obtain the police check gets her kicked out of Canada (triggering a removal order or the same for example). We’re so worried right now, any advice will be greatly appreciated!

My stupid me incorrectly put 2028 instead of 2018 for one of the address history dates. Should I resubmit a new I130A, or should I wait for a RFE? If the latter, do you guys have any idea how much extra time it would cost us?

I've seen couples placed into AP and eventually got approved after months. So there's definitely hope for you guys. Just that it might take some time, which you can't do anything but wait. Good luck!

Hi everyone, I'm a USC and I'm currently filling out the spousal forms I-130 and I-130a on behalf of my wife. My wife is living in Canada but will eventually move back to Vietnam, her home country, when it's time for the interview. We've indicated the U.S. Consulate in Ho Chi Minh City, Vietnam as our preferred choice in question 62a-c of the I-130 form. She can't have the interview in Canada as she doesn't have legal status there. There are a couple of items in the forms, mostly related to her address history, that I'm unsure about. I ask a lot, so please bear with me 🙂. Any insight is greatly appreciated. Here's a list of her address history in the last 5 years: 9/2018 - 1/2021: Canada address 1 2/2021 - 12/2021: Vietnam 12/2021 - 3/2022: Canada address 1 4/2022 - 9/2022: Canada address 2 10/2022 - 3/2023: Canada address 3 4/2023 - now: Canada address 4 All the Canadian addresses are in the Greater Toronto Area. Questions: 1. I understand the importance of accuracy in filling out the forms, but I'm wondering if I can simply combine her last 4 Canadian addresses into the current one (from 12/2021 to present) for simplicity. Another reason for this is because of the question below. If I don't combine them, the answer will be the oldest address from 2 years ago. 2. Should I put: a. Her current Canada address for question 11 and her Vietnam address for question 13, or b. Her Vietnam address for both since we want to emphasize her main residence is in Vietnam, not Canada. 3. I filled 'Never lived together' for this question. I've been flying to Toronto very frequent to visit her. All of them happens on the weekends and I only stay for a couple of days. I believe these visits fall under the category of traveling/visiting and not actual 'living together'. We do have a plan which I'll stay for 2 weeks for the upcoming Christmas. Even that one is still visiting, correct? 4. Regarding her employment history, I've entered her current job starting from 2022. For the period 2018-2021, I put 'Unemployed' in the 'Name of Employer/Company' field and 'Student' in the 'Your Occupation' field. Is this correct? Or should I remove the 'Student' entry entirely, even if it results in an unexplained gap in her employment history? 5. I'm filling out the form electronically on the computer. However, fields 1a-c are not fillable. Can I skip these since I'm filing electronically? And no need to sign and date the sheet also? 6. I'm considering including a letter to emphasize her residence in Vietnam together with the application. What are your thoughts on this?

Real experience here to share. When I saw the 6 to 10 weeks processing time, I thought they were juts exaggerating. They were not. It took us almost 3 months (from beginning of May to end of July this year 2023) to have the marriage registered in their system. What a pain...

For example, if she requests for the PC in June, receive it in August then leave Canada, would it still valid? Or she has to leave on the same date of the request to leave no gap?

Question 62 in I130 form does ask where the beneficiary intend to have the interview at. It also says "NOTE: Choosing a U.S. Embassy or U.S. Consulate outside the country of the beneficiary's last residence does not guarantee that it will accept the beneficiary's case for processing. In these situations, the designated U.S. Embassy or U.S. Consulate has discretion over whether or not to accept the beneficiary's case". We really don't have any choice other than go back to Vietnam as having interview in Montreal is impossible since she's out of status. She has done some police check in the past for school purpose and they didn't ask about immigration status. I hope it stays true and she won't have an issue next time requesting one.

Yes, we will obtain the Canada police check as she has been living there for a couple of years. Another question, lets say she receives the IL in May for an interview in August. If we request the police check in May, there will a gap from May to August, would there be any problem?

Hello, My wife (Vietnamese) and I (USC) got married in Canada. She has been overstayed her Canada visa. Our plan is when it's her time to do the interview, she will fly back to her home country (Vietnam) and have her interview there. I believe the US and Canada share immigration data so they will know about her overstay in Canada. Will it by any chance affect the decision on her CR-1 visa?
