  5. That sounds great overall, but shouldn't the CO have been informed about how that policy works? Because then I obviously shouldn't have been given this ban in the first place. Now if it is in their system (probably, right?), how does that get removed if you cannot appeal the CO's decision? If any of those options you presented were to be filed: wouldn't the 10 year bar, if in the system, just lead to a denial? Just trying to understand how I don't have a bar according to your understanding, but the CO was so direct and quick to tell me I did.
  6. Yes, D/S with no specific date. Never was brought in front of a IJ/IO, was never in removal proceedings as I departed on my own. The SEVIS was terminated by a university official.

My documents that I had brought with me (and never was given the opportunity to present because the interview quite literally was over in 30 seconds) showed I have property in my home country, 1 business that I run, more immediate family, an ongoing master program at university and more evidence.

  12. Is the waiver then submitted with the I-130 packet (what exactly do you send in at this time?), or only if USCIS would request a waiver? Is there also a significant difference between this scenario, or if you would apply for a K1-visa? Would this get approved despite the ban, or this also includes having to include a waiver?

  14. It's worth noting that my parents are older and limited to traveling, and majority of my family lives there. So not being able to visit them for months at a time or a few months out of the year will be very difficult for our family as a whole.

  16. Another question: do they only apply with this form and the filing fee in the packet? What else should be included? Just to repeat: parents are LPR's, sibling is USC and I am 30 and unmarried/no children.

  19. I understand. I thought it was worth a try because I was able to prove my ties to my home country and responsibilities here. There was never any thought of misrepresentation. Yes that seems to be what most are agreeing on. Thank you I understand. It seems as a waiver is the best route and to consult a knowledgeable immigration lawyer.

  21. Got it. Would I need to reapply for the tourist visa and ask for the waiver at the embassy or how does this work? Is an immigration lawyer required for the I 601? I appreciate any helpful information and examples on this.
  22. It seems as the D3 is only available for DREAMers. Regarding I-601: this is to prove extreme hardship correct? are these successful at all?
