  1. Any advice about what I should do next regarding the ESTA? It naturally expires in April 2024, but should I apply for a new one to show that I now became aware of the mistake and fixed it?
  2. Thank you so much for responding. This is what I figured too, once my anxiety had calmed down from the initial “Oh god, I made a mistake on a US application!” horror. It’s reassuring to read that you also think the same as I do. It would have been a totally different story if I had messed up one of the eligibility questions, that’s for sure.
  3. My current understanding (now I am somewhat calmer) is that this is not material misrep bc it would not have made an impact on whether or not I got the ESTA, right? If anything, putting “no” to past/current employers would have been more likely for denial. Should my next step be to apply for a new ESTA and list my current employer? I have a job now. Also, when it comes to the DS-160 in the future, when it asks about any past misrep regarding past applications, should I say yes and explain this mistake? Or is that only for material misrep?
  4. Please help me. I’m so angry at myself. I only remembered the employer bc I had to list employers from the past 5 years for I-129f. I went on the UK tax website which lists employers for my specific employment date for my current job, and I saw my old job from 2019 on there, and I was there less than a month.
  5. Oh god, I cannot believe this. So when I applied for my ESTA, I put that I had no past or current employer, as I was unemployed at the time. I totally forgot about the short period of time in which I worked for a store, as I was only there for less than a month and had to quit due to health reasons. Can I fix this? Am I screwed for K-1? I know you have to file for a new ESTA to change anything aside from passport details and US address. I’m terrified now. I only remembered the past employer bc I saw it on the tax website in the UK when filling out employers from the last 5 years in form I-129f. I only became aware of this now bc I am printing my ESTA application for more evidence of travel to see my fiancé in the last two years.
  6. Ohhh, interesting. Thankfully my fiancé makes enough to sponsor me, and we have a co-sponsor line up in case of any unexpected issue with his job etc. What do you think of my misrep concern? Hopefully my explanation made sense.

  8. This part is still sticking out to me now that I have returned to this thread. I am less anxious about it now, but still apprehensive. I know the US takes dealings with CBP or any immigration official very seriously, even just the possibility of a lie to gain admission to the US. Misrep seems confusing to me, because how, without the ability to read minds, would they prove a material misrepresentation regarding intent for a previous trip? Aside from obvious, severe cases like outwardly lying on a visa application, or claiming to be single when actually you are married etc. I want to prepare for the worst where I can, so if I were to bring evidence that this was not a material misrepresentation to the interview, would it help my case if they accuse me? My evidence includes: everything I brought into secondary that I listed in my initial post, my correspondence with Universal Credit after my return where I inform them I was out of the country for longer than a month and arrange to repay them, evidence of those repayments, email confirmation/bank statements confirming my return flight was changed to February 12th 2023 on December 12th 2022 which is the day after my fiancé proposed to me, and my initial travel insurance that was valid from December 1st to December 15th, as I gave myself a day extra in case of flight delays. I was also honest about my trip being to spend time with my (at the time) boyfriend before the holidays, because that’s all there was to it, not even tourism really lmao. It wasn’t until my boyfriend became my fiancé that we realised “Am I gonna move to the US after this trip? Is this the last time I will visit the States before a lengthy immigration process? Should we make the most of this trip and spend the holidays together and with his family and his friends that have now become my friends too?” etc. Would that be sufficient if it pops up in the interview? As you can probably tell, I am not very familiar with dealing with US officials lmao. Hence why secondary was so scary for me. I know it’s something I will have to get used to for my immigration journey, but I just find misrep to be a grey area, regarding how they prove it and how the applicant disproves it (and if they are even given the chance!) I know CBP treat you as suspect from the start and it is on you to prove otherwise, so I guess I am expecting the COs to be the same and want to prepare for potential suspicion. I would appreciate kindness, but of course, I know how tiresome it can be to deal with anxious people. Trust me, I am currently undergoing the long gruelling journey of managing this better. I’m just looking for info and advice from people with more knowledge than I, as I know the previous responses helped me a lot when I made the initial post. A lot of these worries have only now popped up for me again bc I’m about to send off the petition, so it all feels very real and scary and exciting and just… a lot of emotions, and I don’t want anything to get in the way of this if I can help it. I am also unsure if this thread needs to be moved away from the CR-1 category due to me being a K-1 applicant now. I don’t want to violate any TOS due to yet again changing my mind on something lmao!

  10. Oh, interesting. I also realise it is entirely up to the CBP agent at the time. Thankfully I did not overstay my I-94, and my last departure from the US was February 12th this year (allowed visit time was up to February 28th) Any advice? In your opinion, should I wait longer to visit again? My fiancé can next visit me in April next year, so I was discussing potentially trying to come see him again before then, if I felt confident enough after my visit to secondary, which was very anxiety inducing for me.

I hope it’s okay to reopen this thread as it relates directly to it, but I wondered if I was correct in my assumption that I will likely face issues returning to the US as a tourist due to deviating significantly from my initially stated travel plans. Does anyone have any insight? I have a job now, but I still live with my parents. Also still receiving Universal Credit, which is what I mentioned in my secondary inspection last time. Oh, and we’re going for K1 instead of spouse visa now, for a variety of reasons, but we are certain this is the best path for us.
  12. Thank you for sharing your experience. I definitely need to accept that random things can pop up and that there is only so much you can prepare for. Anything I do have proof for, I will probably send with the petition, but will be mindful to keep the package on the smaller side. Some RFEs sound downright bizarre in this process. It really seems like a luck of the draw situation regarding whoever adjudicates your file.

Despite numerous people being approved with the short statement of intent to marry, there are also exceptions, most of which used the exact same statement of intent to marry that is provided by VJ, which is why this all seems kind of unpredictable to me and where my concern lies. These are the threads I could quickly find just now.
  15. It’s more to avoid an RFE where possible. One of the people who got the “intent to marry” RFE is actually from the UK, one from Russia, one from the Philippines, it seems random. They all sent the “intent to marry” letters with the petition too, so it seems that in some cases that alone is not enough. Proof of pre-marital counselling is something I have that shows a clear intent to get married, along with sending our individual signed intent to marry letters.
  16. Fair enough. What about affidavits from friends/family? I guess it could fall under that category. Do you know if they need to be sent the original signed letter, or are scanned copies with the signature still accepted?

Since I saw a few threads in which people received RFEs for “proof of bona fide intent to marry” even with signed intent to marry letters, I want to cover my bases a bit and include a letter from the therapist who we had pre-marital counselling with, basically an affidavit attesting to the authenticity of the engagement from her perspective after the sessions. I know it is not always necessary, but I’m just covering a base that I know I can cover. Better safe than sorry is my approach to this process. Will this need to be signed and the original sent in? She lives in another city, so it will have to be shipped to me. Or will a scanned copy of the signed letter suffice?

  19. Not sure if this is a dumb question or not but I wondered if the PDF version of boarding passes are okay to send as evidence for K1. I’m asking because I no longer have my physical boarding pass, but because I checked in online, they sent me the boarding pass via email anyway. I have no passport stamps either, and neither does my fiancé. We have never been stamped on any of our four trips in the US or the UK. I have my I-94 record which lists both arrivals and departures, but wanted to include the boarding passes too, despite not having the exact copy I used to board the plane. Is this okay?
  20. Hi everyone! Putting together the K1 packet now, and I just wanted some clarification on what my best course of action would be regarding evidence. So, my fiancé and I have had 4 trips in total over the past two years, and I have the most substantial documentation/evidence for the two most recent trips. Should I only include evidence from these two? Or should I still include evidence from the trips before? I read that quality over quantity is best, but wasn’t sure if having proof for all trips might also be considered quality. Evidence I have for our most recent trip are boarding passes (our passports have never been stamped for any trip), train ticket receipts for two people, hotel reservations, bank statements from both of us, photos with my family, tickets for a cathedral we visited along with email confirmation of that purchase and a photo of us at the cathedral, the same for a restaurant we visited also. I also plan to include evidence from the trip before this, which was me visiting him in the States for 2 months. I have photos with his family and the same level of proof listed above. Should I also provide what evidence I have for the two initial trips? Or will the two most recent trips be sufficient?
  21. That was the original plan, yes! However, for personal reasons and also for the sake of being able to marry in-person, we decided to go for the K1 instead, and we are aware of the drawbacks of that visa. It’s just the best option for us right now.

  23. Hi! Long story short, my fiancé and I plan to file for the K1 within the next couple of weeks and plan to start putting together the package today. I wanted to ask any fellow UK beneficiaries a couple of questions simply for my own peace of mind: • What evidence did you provide in your petition? • Did you frontload the petition? (Include proof of a bonafide relationship, not just meeting in person in the last two years) If you didn’t, were you asked for proof of that at the embassy stage? • How many pages was your petition in total? I have read numerous answers to these questions and they were helpful, but all from varying embassies. I know embassies can differ quite vastly from each other, and that London is low fraud and therefore an easier time, but I just wanted to hear specifically from fellow UK folks who have since had their K1 visas approved! Thank youuuu ❤️
  24. How so? Public charge is a factor to consider, and I have only ever seen information about US benefits, so I wanted to know if any other person in the UK went through the interview and had their Universal Credit brought up. That’s all!
