  1. To add, I’ll suggest peeps here to reach out to their local congress person (if it applies to your visa). I am with an IR1 visa with permanent address in California. I know some members on this discussion board had no luck, but I was able to get through to mine. My husband (American) called and was connected to their rep right away, member from their immigration / legal team. They can also I quite about status and sounds like their have someone with an “in” to help with the situation.
  2. Coming close to 90 days mark for me. After multiple emails the consulate was able to confirmed that they have received all my DS5535 information (they did not email me for request of information). Consulted with Goldstein and was advices that I can submit WOM before 90 days mark, given factors of family separation and delay in accepting job offer as evidence of hardship. I have previously escalated to local congresswoman’s office and they too have agreed to further escalate given the above reasons. With movement at the congresswoman’s office, id decided to hold off with filing WOM. All these events happened last week, and my status was updated today. Hoping that this is good sign! Really hoping to not file WOM, as I was told that it’ll be at least another 3-4 months after filing WOM before decision will be made.
  3. In addition to DS5535, I was instructed to submit an RCMP background check (I submitted a provincial one originally and was approved by NVC). I have the correct background check on hand now, but the consulate instructed me to hold off on sending it in and that I should wait for further instruction from them. Just had a consultation for WOM and I was told that a WOM MAY not appropriate as not all my documents are submitted, even though I was instructed not to send it in. I’ll connect with the lawyer again tomorrow once she has clarify that a WOM is appropriate for my situation. i will be in further limbo if I can’t file WOM and if the consultare wouldn’t accept the requested document. updates: after ++ email inquiries, the consulate was able to confirmed that they have received my DS5535 info from the previous email I sent. Up to this date, I have not received any documents or instructions from them after my interview… all of which they said they would do. I just want to be with my family. Two kids… one starting preschool in august. I’m speechless.
  4. @Gha thank you for the info. It makes me feel a bit better to know that others have to wait. But right now I’m beyond nervous to know that it has been almost 2 months and no words from the consulate. I’m confused though, why issue the visa for 2 days??
  5. This is good to know! Thank you! Sounds like u have an honest lawyer! Would u mind sharing his name just in case I need it? i have a job offer too, but unfortunately it doesn’t qualify for TN. Going the H1B route but I was told that even with H1B, there’s a possibility that applicants can be flagged for AP!

  7. I have not communication from them period. I know that there wasn’t a formal form (I learned from this great forum). So I included all the info that would be asked in my email to them. I’m hoping that they have received the info and is processing it
  8. No emails either. i did proactively send them all my DS-5535 info via email three weeks into waiting. At 55 days, I emailed to request confirmation of receipt. I only got a generic response so my question wasn’t answer. 😩
  9. No!!!! It doesn’t make sense. It has been 60 days since my interview and I have not received anything from the consulate. I asked multiple times and still, generic responses. This makes me wonder whether or not they actually touched my application at all. the new form indicates that 6 months is the processing time, nothing about the 60 days that was previously mentioned on their website. All status updates correlates with the date of generic email responses. I know many ppl inquired about WOM here and it really does frustrates me that it’s needed to get things going. Also makes me wonder will this delay timing for those who doesn’t file for WOM, since the WOM has totally become a “premium processing” equivalent for AP, only there’s no guarantee a decision within 15 days and if u have 5k to spare. Just a thought. I’m frustrated.
  10. I sent a follow up email again to inquire about my DS5535 form, because I never got one via email (my interview was in April). Got the same generic response again. However, I noted that their automatic response was different. Pretty much saying not to bother contacting them until 6 months has elapsed. Doesn’t help much, but at least u can tell that more is being done to address the backlogs that they are dealing with.
  11. Shouldn’t, as long as u have proof of sufficient tie to Canada. For most a return ticket should be suffice. Being in AP doesn’t mean you are banned from the country. So enter the same way you would have like before. Custom just need to make sure that you wouldn’t be staying in the country and don’t leave.
  12. I’m in similar situation. Had an interview with US employer within days of my Montreal interview. I thought immigration would go uneventful, given that I’m applying for IR1 visa with two children and husband who are already American. Got DS 5535’d. Employer notified. I tried the TN visa route but my job wouldn’t qualify (consulted with lawyer). Now exploring potential H1B visa option. We also connected with local congressman and a rep from the office has reached out to USICS to advocate for prompt AP review. The rep told us that it’ll take 30-180 days for USICS to respond. Try the TN or H1B route, but that’ll require work sponsorship (if they are willing and hopefully have a H1B cap exemption) or ur job to fall under either visa categories. You’ll have to be clear that you have no intention to immigrate through these visas while your IR1 is pending, in hopes that USICS grant you the temp work non-immigrant visa. Also try the your partner’s local congressperson. Even if it’s generic response it wouldn’t hurt to try. good luck!
  13. Hope this is true! That would explain the 80 days wait that someone else posted. Just hoping that everyone that already has been placed on AP will get quicker response.
  14. My status is still the same as “refuses”, but the “last update” date changes a few times. How do you know that your case was “opened”? i read previously on the thread that many ppl have their status updates after DS5535 was received, then back to radio silence. Sensing that this could be the case for me.
  15. Mine was on the same day! I’d never received the questionnaire via email. I’d emailed them three times since the interview, with DS5535 info attached in my email. They have responded stating that co silage is aware of my situation, but never really acknowledged the DS5535 info. My status has been updated three times since their response, last being yesterday.
  16. Updates: To date I have sent 3 e-mails to the consulate since my interview mid-April. I was told to expect the DS5535 questionnaire via e-mail but have not received it yet. Along with my e-mail I included info that are required in the DS5535. I received respond today from the consulate, indicating that my application is in AP and I should wait for further instructions before sending any additional documents in. The e-mail DID NOT include the DS5535 questionnaire, nor did they acknowledged the info I previously provided. My CO told me that a completed DS5535 is required in order to being AP. I want to assume that they have received my info and have initiated the AP. My status was also updated twice, once on May 3 and then again May 5. I know I shouldn't be reading so much into this. I'm staying hopeful that this will be completed within 60 days!!!!
  17. I’m relatively new to this group and I’m sure some of the more seasoned members can add to this. The whole AP could be for whole lot of reasons and the consulate office always keep it vague as to why are have been flagged. I asked my CO and he says maybe people with the same name, though he doesn’t know what could have flagged it as I appeared to be a “normal” case. Many members have no idea why they are flagged. I am convinced that it’s because I was not born in Canada (born in Hong Kong). Though I have been a Canadian for most part of my life, I’d been flagged due to… racial profiling. Though many members here are born in Canada and haven’t traveled much other than North America and Mexico.
  18. further security review and screening. Did the consulate provide any further info other than you being placed on AP? Questionnaires to complete? Sorry to hear that you'd been placed on AP even though they have verbally approved you during the interview. Must be so frustrating.
  19. It's me again, the person who has been waiting for the DS5535 e-mail but never received it from the consulate. After three weeks of waiting, I received an updated status regarding my IR1 visa online. Still "refused" but I assume that this indicate something is in progress? Could this possibly means that they have received my DS5535 info from the three e-mails I sent over the past three weeks? Who knows! Staying positive!!
  20. Thank you for this. I have sent two emails to the consulate already. I’m really hoping that they have not forgotten my case. In the second email, I have included information for what were easels in the DS5535 form. I figured that it wouldn’t hurt to include them anyways. Since my interview, I have returned to US to visit my husband and be with my two children. No issues at the border as I have a return ticket as proof. Just wondering… has anyone tried to apply for a TN visa while their IV is pending?
