  2. Oh I agree with you 100%! I don’t see the reason for not sending it. But on the other hand, if I was told NOT TO then why should I go against that … which is why I send my initial email to inquire. it’s in the mail now… fingers crossed
  3. I need to submit proper RCMP check, ds5535 and passport (given back at the end of interview). The CO told me to not send in the RCMP check as it will most likely expire by the time my AP is cleared and I will be asked to resubmit a new one. I also sent a follow-up email after acquiring my RCMP check, in which I received instruction to hold off on sending things in until I get further instructions from the consulate. I just recently learned from this forum that some members have sent their RCMP in asap. So I emailed the consulate to confirm. That’s when I was told that I have to send in my RCMP. Frustrating. I was also told to expect ds5535 via email after my interview. Never received one. After three weeks, I just send in my information based on DS5535 online templates via email. Have to follow up a few times and finally they confirmed receipt. Doesn't sound like this was a common experience for peeps here. Im very proactive throughout this process but have had super bad luck with everything. Perhaps my application has fallen through the cracks between the desks… literally.
  4. E-mail inquiry for status update is more to give you a piece of mind that you are doing something. It keeps my hopes up to see an email response knowing that someone is looking at my email. Still hoping that @sikeDS-5535dbyMTL can elaborate on how to build a case as advised by the lawyers. Will template response from the consulate help with the cause? I was instructed by both the CO and later email responses to NOT send in the required documents until I receive notification from the consulate to do so. The attorney that I consulted stated that this is a strong enough case to submit a WOM, that being my application placed on AP for missing documents but is told NOT to submit my missing documents until being asked to do so. Not to mention that I never actually received the DS5535 form from the consulate AT ALL. That was back in August 2023 and I decided to not file a WOM at the time (given the cost and the increasing case dismissal). In recent email correspondence, I am now instructed to send in the missing document minus my passport. I don't know anymore... For those who are new to this, my advice is to start looking for alternative ways to reunite with your family as you wait for DS5535 (if that's an option). Employment sponsorship, remote work from Canada.. anything. A bit off topic too - those with kids about to be born - There is a LONG WAIT TIME for appointments for birth abroad for your kid to receive the US citizenship. At least that was the case back in 2023. Need to account for this as you wait for your AP to be cleared.
  5. Sucks that you are in this situation Curious to know, which immigration lawyer did you use? Most of attorneys that came up in the chat room (e.g. Goldstein) comes at $5000 minimum. At least that was the quote I received back in July 2023. Like many members here, I have attempted to build a case through ways you described above. At the end of the day, there was minimal impact to timeline. I emailed the consulate requesting reason for denial - ignored. I emailed to explain in detail hardship (e.g. family separation, financial burden, loss of job opportunity) - template response. Also emailed congress/senate representatives... even the White House - got bounced back to DOS and received a SOL response. I know I sound super jaded having been in AP for 10 months.
  6. Hang in there! If it’s a true ds5535 case then the wait time will be a black hole unfortunately. Start exploring alternative visa options asap. Can try local congress/ Senate representatives, but none of them have been helpful for pretty everyone here that tried (don’t listen to them if they say they’ll help move things along because it’s all a political tactic).
  7. Just make sure you have a return date and flight handy when they ask you. A trick - can always purchase ticket same day and many companies (i.e. AC) offer 24h free cancelation. Ultimately, they want to make sure that you wouldn't enter the country and then stay through AOS.
  8. My understanding is that each visa application is separate and that being refused under 221g in one shouldn't impact the decision for the other. You can give it a try and see if your employer is willing to fork out the $$ for it. Does your company have a legal entity that can advise on this as well? Worth giving it a try.
  9. How many of us have filed their application via attorney? I'd always wonder if have legal representation would prevent DS5535. For those who were represented, what strategies did the lawyers use to expedite the process, if any? Yes, I think DS5535 is random, but I am also convinced that being from the "special" countries listed will increase the chance of you being selected for it. The CO's expression literally changed when he asked my country of origin and my age when I immigrated to Canada (<10yo). I'll be curious to know data on 221g/DS5535 in relation to country of changeability.
  10. I received a print out during the interview that explained why your visa case is refused based on 221g. On it I was asked to submit required documents (proper rcmp check, passport and ds5535 form). @SGtoMurica and @Phil_K_IR1, did you receive this as well? Like the form specifically stating ds5535? Just curious to know. This whole system is BS…
  11. Thank you for sharing this. Probably the only place that I’ve read so far that explained fully what exactly happened with the whole 221g/AP/DS5535 bullshit. I more I read, the more angry I am. *vent alert*. I asked the CO what have triggered AP and he literally did a 🤷🏼 as he thought that my case was a straight forward case. ####### question - was fingerprint taken at the interview? I don’t recall mine being taken. By the CO or would it be with the first clerk you talk to who collected the documents?
  12. Got an unsolicited status updated on Thursday. Hopefully that’s a good sign. It has been a rollercoaster of 10 months waiting. I emailed my ds5535 info in after not hearing from them for three weeks post interview. I followed up to confirm receipt and they responded yes and provided date when info was entered into their system. For peeps who asked about emailing congressman for help. I tried before, congress, senate and even White House. No help. Congresswoman was a waste of time, her representative made it sound like they can help to influence process but literally ghosted on us after 4 months. We were referred to reps in DoS by the White House and got a “personalized” letter response… but pretty much saying nothing can be done. For those who received extension request after filing WOM, how much extra do lawyers charge? I inquired Goldstein but they cannot give me a straight answer.
  13. Thanks for answering all the questions!! I am just getting excited to see movements at all! Perhaps there are more ppl like u! I’m in the same situation. Wrong police check (require an RCMP clearance) and placed on AP/DS5535. My interview was in April 2023. Interesting that u were contacted to do a second medical so soon. Mine expired in October 2023. I specially asked if I should repeat it proactively and was told to hold off until I hear back from them. Same with sending in my RCMP clearance. Aside from passport, did they ask for the rcmp clearance? Or did u send earlier? did u file a WOM? ur plan sounded solid. I don’t see why you can’t stay in US and have ur wife handle the mailing. As long as you wouldn’t be needing the passport to enter into the country. Good to know that I can use only your citizenship card and driver license to enter Canada.
  14. Congrats! Do u have to repeat the medical exam? Also, what can you use as alternative to enter the country (ie. nexus)? My understanding is that you’ll have to enter the US with the sealed package they give you. Do you plan to ask family members to mail you the package in US? I’d never been in the situation so apologies I don’t have the answers to your questions. I’ll be curious to see if the above is possible as well cause I might be on the same boat as u when the time comes!
  15. Ya I agree 100%. When I was given 221g, I was told that a ds5535 will be sent to me but that never happened. I waited 3 weeks and took matters into my own hands and send in the anticipated information myself. I was only able to confirm receipt after multiple follow-up emails. I guess for anyone new here waiting for AP clearance, start looking for alternative route. WIT doesn’t sound like an effective solution anymore compared to a year ago. If you are given 221g with ds5535 requirement, you are in for a long long ride. I hope that I’m wrong but expect wait time to be at least 8+ months.
  16. I did not get a response for my Oct and Nov inquiry. I emailed two weeks ago and received a response yesterday, although response is generic. Difference is that I have specific inquiry in the most email, rather than a broad request for status update. My “last update” status was then updated as well online. my interview was April 2023. Sigh.
  17. Has anyone received any response from the consulate regarding AP status? I have emailed them since October and I have yet to get a response or even status update online.
  18. US is very serious about immigration fraud and the officers have the rights to deny entry at anytime if you have a history of fraud. Why chance it? Having a US spouse or children wouldn’t make a difference. Just look at many of us here (myself included) who have suffered family separation due to AP. I’ll just hang tight and hope that the April AP will hear back soon.
