I was informed to submit my medical exam, passport AND a new RCMP report as of last Thursday. I’m glad to hear the news, but is also confused that a new RCMP report was requested when I mailed in mine already. Also kinda regretting the fact that I sent in the report proactively, rather than waiting for them to give me the green light to do so.

So I just want to clarify. Are we suppose to update a re-opened DS260 even if I have not received notification from the consúltate to do so? Reason I asked. My interview was April 2023. When I checked in Oct 2023, my DS260 was reopened. I resubmitted at the time. Fast forward to this week, I checked the form and it is again reopened. The expiry date is Oct 2025. Now I’m just super confused.

I decided to write to the consulate given the strings of lucky peeps who interviewed back in 2023 and had recently got their visa. My interview was in April 2023. Email inquiry was sent early June and a follow-up one sent a week ago. Below is the standard response I received today, with a status updated to todays date. Upon reading closely, I noticed “aim to reduce the time required for CERTAIN types of AP”. I still don’t understand how my case can be different, given our legitimate marriage and two children holding Canadian/American citizenship. **** Thank you for your inquiry. The duration of administrative processing will vary based on the individual circumstances of each case. The Department of State is continuously working to refine our visa application, assessment, and security screening procedures. We continue to aim to reduce the time required for certain types of administrative processing. While we cannot predict when the processing of your visa will be completed, please be assured that the Consulate and the State Department are aware of your concerns and will contact you as soon as the processing is complete. Thank you for your patience and cooperation

Yes you can. The applications should have no bearing on each other. TN is a non-immigrant visa, so you’ll have to show proof of ties with Canada and the intention to return. My employer submitted H1B visa sponsorship and was approved. The lawyers were aware of my AP situation but they were not concerned. The boarder officers didn’t ask about my AP status at all. Hope this is helpful. It has been 14 months and I’m still waiting for my AP to clear. Which to further proof that AP with DS5535 is beyond bogus. U are free to travel in and out of the country as Canadian… but you can’t immigrate because of national security reasons… that they can’t disclose.

I applied for the H1B after 221g was issued (pending DS5535) for IR1. The attorney representing my employer/me is aware of the ongoing IR1 petition and didn’t see an issue. Luckily, from that front, I didn’t encounter any problem. My intension is still to return to Canada to complete consular processing for IR1 once AP is completed and I shared that upfront. Not sure if this was explicitly mentioned or was even asked for the petition. One good thing to know - as Canadian, I am interview exempted, meaning I can directly cross the boarder and get my visa stamped there. I was dreading yet another interview, cause I still have ++ PTSD post montreal interview.

Hello folks! A quick update. I’d been on AP for almost a year now (since April 2023). I am in the medical field. My employer was able to file a H1B petition for me and was successful. I was relieved to see that my IR1 petition did not impact my H1B (I know that on paper the two petitions have no bearing on each other, but didn’t believe it until actually seeing it happen). im gonna keep my IR1 petition open… in hopes that the light to the end of the tunnel is near. It has to be right? Sigh. My status hasn’t been updated for the past month. I had give up emailing for updates, as I either get a template response or no response at all.

I don’t understand the complete standstill with all cases since Jan 2023. Are there ppl OUTSIDE of this chat forum that is actually being cleared?? I can’t even imagine the backlog the system is facing now. I wonder does this have anything to do with changes to the system post public opinion inquest. Hang in there everyone!

I mailed in my proper RCMP document to Montreal. The document arrived Feb 8. I emailed them to request for receipt confirmation on Feb 9. They responded Feb 22 with mainly template response (eg “we realize the extended time causes frustrations… we are doing what we can blah blah” ) BUT NEVER DID THEY CONFIRM RECEIPT OF DOCUMENT. Stupid. Status was updated Feb 22 which I assume corresponded with the email. Got another “unsolicited” status update Feb 27. I assume that’s when someone finally opened the mail and added the document to my file. Many assumptions can be made in this situation. What I gather is that they move at snail speed. SMH
