I just wanted to post our timeline here in case anyone is interested. * Application to USCIS - April 19 2021 * USCIS approved, case transferred to NVC - April 29 2022 * NVC DQed - Oct 7 2022 * Interview date - Feb 3 2023 * Put in AP same day * DS 5535 received 3 days later and form sent in Feb 9 * Writ filed May 2 2023 * Last defendant served May 11 - July 10 answer due * June 6 request to send passport - arrived June 12 * Issued - June 21 * Documents received - June 23 Couple of notes: Hacking law - who said criteria for filing more focused on date USCIS approved rather than when placed in admin processing. As long as 12 months from USCIS approval they seemed to think it was fine to file a writ. Part of the reason we went with them so we could file sooner. Didn’t realize we couldn’t import our cars because they don’t have a tire pressure monitoring system. Something to look forward to. Husband has received his social but still waiting on green card. Having some issues with drivers license because even though he’s a permanent resident now apparently when the lady looked him up it says his i94 expires in November so she issued his DL with expiry in Nov too. Other than that I’m glad it’s all over. Such an unfair process for everyone going through this. Good luck to anyone still dealing with AP!! Hope you guys get some good news soon!
  2. Thank you!! Our last defendant was served May 11th and their answer to the lawsuit due by July 10th. So June 21st status changed to issued and then got the passport on the 23rd which is way faster than we expected!
  3. Just wanted to update my husbands status changed to issued today! Says passport should be returned within 10 business days. Hope you get some good news soon! Can’t be much longer! edit to add I’ll update again soon with our whole timeline in case anyone is interested.
  4. Anyone know or have a guess how often they issue the visas in batches? The consulate received my husbands passport on the 12th and we had an update on the 14th (assuming that’s when someone actually got ahold of it) but crickets since then.
  5. Oh interesting. Maybe we will get lucky then and won’t have to send in a new one. My husbands getting one tomorrow thought just in case. Thank you for the info too! Gives me a little bit of hope.

Anyone have a timeline on how long it takes to get your passport back from consulate? we filed a WOM and finally got the email asking for my husbands passport (he sent it in immediately) but his medical expires in a few days and we’re worried it’s going to really delay things. Do you guys think it’s likely they will request a new one? “Any further processing of this immigrant visa case has been suspended until we receive the requested passport. Once submitted, the file will be reviewed, and the consular officer will provide further information on the status of the case.” - the wording in the email. thanks!
  7. I’m not sure if it matters. That’s what we are trying to figure out. It seems like people get more updates right before they get approved but it also seems like people have fewer updates than us. I think we are just trying to make sense of something that doesn’t really make sense at all. nope our congressman wasn’t helpful. We’ve emailed the consulate a few times but just get generic responses. I don’t think it has anything to do with the updates. yeah it seems to have gotten things moving more. Just hoping they don’t ask for an extension and make a decision within 60 days

Feb 3 - interview Montreal consulate Feb 6 - issued ds5535 Feb 9 - responded to ds5535 May 2 - filed writ We’ve had 9 CEAC updates so far on the following dates: Feb 10 Feb 14 Mar 17 Apr 26 May 9 May 18 May 23 Jun 5 Jun 6 It just seems like so many updates! We don’t know if it’s good/bad/unimportant. Really hoping we’re close to it being done but I have no idea what to expect. Thanks in advance!!
  9. Thanks! Yes he’s keeping a log of time spent in the US and he’s always honest with them. He does get pulled into secondary every time but has his paystubs, return flight etc Thanks! All great suggestions!
  10. We are filing on April 25th which is almost 3 months from his interview but a full year since he got approved by USCIS I believe. From what the lawyer said it seems like since they just asked for a ds-5535 and no other supplementary information they feel more comfortable filing this soon.
  11. Husband had his interview in Montreal Feb 3rd of this year and got hit with the ds5535 a couple days later. After reading all of these submissions here we decided to just file a WOM with hacking law ASAP. Edit to add they are going to file in about a week. Can’t believe so many people go through this. It seems ridiculous. Even the lawyer said he’s seeing so many more cases out of Montreal. Anyways does anyone have any recent timelines they could share after filing a WOM? And has anyone’s spouse travelled to the US while in AP? thanks!!
