  1. The CO gave back my passport. After questioning him as to why he said the DS5535 was to verify some travel history, all of which could be seen on DS260 albeit maybe 1-2 trips. Usually, if they keep your passport you’re more likely to have a faster processing! The consulate was quite strict when I had my interview about who they were letting in. We went back to ask some questions after my interview and the guard did not let us go in and just gave us a small note which had the email address to contact them (same one they send your form from) so I’m not sure they’ll allow you in but since you’re in Montreal it’s worth a shot!
  2. I was told it’ll take 4-6 weeks. It’s going to be 10 months in a few days. I was hopeful we’d get second medical invites out soon but it doesn’t look like that’s coming anytime as Feb ppl haven’t mentioned anything. Is this going to really be a two year process? If you switch the last digit of the case number on CEAC it tells you the status of the cases before/after you. Seems like on my particular interview day alone, 6 people got put in APs. Pretty ridiculous.
  3. I believe multiple agencies such as Homeland Security, the Department of State, and the FBI conduct background checks. Unfortunately, the timelines for processing our information are unclear, leaving us uncertain about how long these checks will take.
  4. They also didn’t reply to my email which I sent early September whereas previously they would send a response in ~2 weeks time. They did, however, respond to my husband’s congressmen who inquired on our case. The response to him was their standard generic reply. Currently at 206 days post interview. We also consulted with PIC lawyers but were told, as others mentioned already, judges are a lot more strict and he referenced the case where WOM was denied in spite of it having been 16-18 months after the interview citing that this was not a long duration.
  5. Yes, well aware and not something I’m interested in. Spoke to multiple lawyers at length about this topic as well. But curious if anyone did this in the group and what the outcome was. Frustrating when I know of a few people who did AOS to begin with and they already have a work visa and application accepted within 4-5 months. Whilst others who did spousal visa are still waiting 2+ years. Immigration lawyers are aware of Montreal embassy and their timelines and are the ones suggesting to go AOS route.
  6. I’m sorry you’re in this position too. You could try to contact the consulate via email and explain your situation to see if there’s any movement. Although, my husband and I tried that for me (congressman and immigration lawyer emailed) but they give a generic non-reply.
  7. No updates regarding my status however I was able to travel to USA via Montreal connection with no issues. They asked the usual 2-3 questions that I’ve had in the past prior to DS5535. I went to the customs officer with my husband. Very friendly. Just wanted to share my experience for anyone thinking to travel.
  8. Has anyone ever been denied to go after they received the DS5535? I have never had any issues prior to the interview and I traveled quite often but always returned well in advance before the 6 months date. Also, does anyone know if they can specifically see if you’ve received the form and it currently says refused? Just curious as I don’t want to divulge unnecessary information and just want to answer questions when asked. thanks all!
  9. Just wanted to add on to this question, how long till one can file WOM? People who have taken this route could you share your process? Chris from PIC a seems to be a good option according to previous comments. After consulting with a few lawyers, they suggest to wait 60 days minimum. I read some contradictory material from Goldstein where in one pamphlet he suggests to wait 6 months but in a YouTube video on his channel he states if you’ve already waited 18 months for I-130 you’ve already waited long enough.. FYI another case update today (total of 4 since submission on April 4th) but still says refused.
  10. Hi everyone! Recent member of this lovely group 🙃 I had my interview recently (April 03, 2023) and passport returned at the spot after my short 4-5 minute interview. I asked why they weren’t keeping it and CO mentioned they will send an email with just some questions about travel history (email came later in afternoon). Spent the last few days reading the forums and quite disheartened to know what people and their families have had to deal with even after reaching the interview stage. I’m a Canadian citizen although moved from Pakistan when I was 7–which I’m sure was one of the reasons for this “random” extreme form of vetting. I work in a healthcare field and had been in school up until 2 years ago. CEAC was updated April 4th and 5th. Good luck to everyone and praying we have a short stay here.
