The CO gave back my passport. After questioning him as to why he said the DS5535 was to verify some travel history, all of which could be seen on DS260 albeit maybe 1-2 trips. Usually, if they keep your passport you’re more likely to have a faster processing! The consulate was quite strict when I had my interview about who they were letting in. We went back to ask some questions after my interview and the guard did not let us go in and just gave us a small note which had the email address to contact them (same one they send your form from) so I’m not sure they’ll allow you in but since you’re in Montreal it’s worth a shot!

I was told it’ll take 4-6 weeks. It’s going to be 10 months in a few days. I was hopeful we’d get second medical invites out soon but it doesn’t look like that’s coming anytime as Feb ppl haven’t mentioned anything. Is this going to really be a two year process? If you switch the last digit of the case number on CEAC it tells you the status of the cases before/after you. Seems like on my particular interview day alone, 6 people got put in APs. Pretty ridiculous.

No replies between Sep-Oct. I received the standard response for an inquiry sent 12/26 on 1/6. Interview was early April 2023. Really praying to hear back in the next few weeks 😓

Some say you have to withdraw it before as in AOS it asks if you have any previous applications and their status.

Same with us. Nowadays, they don’t even reply to us but do reply to the congressman/woman. Yet with the generic response we used to get previously.

I believe multiple agencies such as Homeland Security, the Department of State, and the FBI conduct background checks. Unfortunately, the timelines for processing our information are unclear, leaving us uncertain about how long these checks will take.

Unfortunately, we are in the DMV area so it would go to DC or Virginia which is also known to be tough.

They also didn’t reply to my email which I sent early September whereas previously they would send a response in ~2 weeks time. They did, however, respond to my husband’s congressmen who inquired on our case. The response to him was their standard generic reply. Currently at 206 days post interview. We also consulted with PIC lawyers but were told, as others mentioned already, judges are a lot more strict and he referenced the case where WOM was denied in spite of it having been 16-18 months after the interview citing that this was not a long duration.

Yes, well aware and not something I’m interested in. Spoke to multiple lawyers at length about this topic as well. But curious if anyone did this in the group and what the outcome was. Frustrating when I know of a few people who did AOS to begin with and they already have a work visa and application accepted within 4-5 months. Whilst others who did spousal visa are still waiting 2+ years. Immigration lawyers are aware of Montreal embassy and their timelines and are the ones suggesting to go AOS route.
