Why not just write to them and convert it to a waiver? Seems most who do this have little to no problems and you keep your place in line. The poster is nearly 1 year in to the process now, I would be very hesitant to withdraw and start over again if it was me. Just write to them explaining you are divorcing, you will provide them a final decree on whatever date you will have it and send it in when you get it or they send an RFE. -
Good for you. But not everyone has that luck. Don’t send people down a dangerous path just because you had an easy experience. There is no reason on earth NOT to send everything you got, absolutely none. It’s laughable how people here seem to think it’s their job to decide what the officer wants to see.

This is proof positive you have to send everything you have as evidence. The amount of people on here that seem to claim you only should send a couple months of each type of evidence - bank, utilities etc…is just plain wrong and leading people into trouble. I’ve said it before and I’ll say it til I’m blue in the face…drown them in evidence! It’s not our job to decide what they want to see. This is what they are paid to do. Send them every single thing you got. Hope this person can send more in and get this situation resolved.

From what others on here have said this is totally normal in your situation, the status updates on the site are misleading. You have been approved and your card should arrive in next couple of weeks. Congrats -
You may find a different lawyer may be able to frame your situation in a better way if you aren't 100% confident in the one you have. I think it will all come down to how much proof you have of the abuse you suffered. As for your spouse, USCIS knows there will be bitter ex spouses so them just saying it was a fake marriage alone shouldn't be a show stopper, but the fact you said there was suggestions of fraudulent documents + your spouses claims + suddenly switching to VAWA AFTER a denial is going to make your case very very very difficult I would imagine. Perhaps investing in the "best" lawyer you can find may not be a bad plan really.

Wow. Glad you have an attorney. Did you provide extremely strong evidence for the VAWA? I’m no lawyer but I’d dare say you will be needing some incredibly good proof you suffered abuse. also I don’t understand, you filed a i485 solo after you got your greencard? Or you mean you filed a solo 751? A 485 won’t help you after you have your conditional greencard and did they say you are under investigation when you contacted them? That is worrying if so.

True. Most are without interview, but this guy was adamant it all comes down to the proof you provide of the legitimacy of your marriage at 751 application time...so who knows haha. But yes, you won't go wrong following Mikes advice also, just is much harder when you are in a state that takes 6+ months to offer a decree. -

This is something there is still so much disagreement on, even amongst attorneys it seems. Some people wait until they have the decree to send it all and notify USCIS at that time...others notify USCIS immediately then wait for the decree later on. Last thing I read on an attorneys blog on this subject was it comes down to how much evidence you sent in with the 751 initially, if you sent a tonne of evidence supporting a bonafide marriage then you will be fine at citizenship time and will be no problems if you wait for the decree...if not, then you may need help when and if it comes to N400 time. But overall, Mikes advice is solid. Good luck! -

Have been in and out of Costa Rica twice with expired card...no issues at all. Didn't even ask to see it. I assume the level of scrutiny you get is based on the passport you are traveling on. -

Don't quote me but I think I saw someone say some of these rapid approvals are from military spouses and tend to get ushered through quicker in some cases. -
Hey guys, quick question! Can people with a pending 751 on here tell me if they are able to click on the documents tab of the my USCIS website and let me know if it allows you to upload evidence? I have been trying and every time I press the blue button it just returns me back to the main screen again, tried on multiple browsers as well. Wondering if I have an account issue or if everyone is in the same boat. IOE case number if it makes any difference. Thanks

I would say his points are actually pretty valid. The thing is none of us know what is going on behind the scenes, we can only speculate how USCIS is running the show now and hope this 751 insanity ends for everyone -
I honestly think you are right. As another post pointed out; the 751 is basically useless outside of some potentially fraudulent cases in the vast minority - of which USCIS would already know who they suspect of this at the 130/485 stage of the process anyway. If they intend to keep the 751 it should really be down to just background checks etc…and cool it on providing a tonne of evidence all over again. That would speed things up dramatically. I mean look at the stats, 98-99% of 751s are approved anyway. What is the point of it. Just my thoughts anyway!

Correct. They previously would be mailing stacks of paper around the place. IOE cases are “online” in so much as they are all digital now on the officers computer screen. Hence the fact they are faster to process. And yes I agree, it’s not fair that older cases are held up for the newer ones to process faster but it’s the way of the future now, and as another poster pointed out, it seems they are doing this to A) show cases are being processed faster and B) testing out the new system for data points.

I agree. Except for questionable cases it shouldn't even be a thing. I can see the reason for it to exist at N400 stage but not 751. As some others suggested, its basically just revenue raising for USCIS and nothing more -

Plenty of ideas on here, some of it good...some not so good. You have to consult with an attorney or two and trust their advice. As far as I am aware, this forum while useful is mostly full of strong opinions more so than legitimate legal advice. Trust your lawyer. If they say go for it, I would do that over anything a random forum user tells you to do.

Yep this is my understanding as well, the IOE cases were on trial run before March where they were sporadically used. Guess it was successful so now its been widely adopted
