Well USICS is making a nice small dent in 0919 IOE cases from March 2023 now. looks like they have cleared about 400 or so cases now from that block, if they continue the momentum all cases from March 2023 should be complete (by N400 or just waiting it out) in a little over 12 months from now. They have been approving about 3-6 per day, Monday to Saturday.

Yep this is it. Unless they have some absolutely damning evidence proving without a doubt you attempted to defraud the system, they can’t remove you. Do you suspect your ex may have said something to USCIS or sent them some documents that make things look like there was fraud? Certainly odd you had, by your account, a very good interview then got a denial. don’t give up!

I agree. Unlikely any good will come from taking your spouse with you. Now I’m not an attorney but I would bet you if you jump on Hackings show he is going to say “decide if you are getting back together or get that divorce going! and file/convert to a solo case” edit - Just saw your evidence list as well. You really need a lot of help on this case. I would bet you will get an RFE for insufficient evidence, and if you can’t provide anything my understanding is they will deny your case. A good attorney can help you get all kinds of evidence you may not have even thought of. It may not be cheap but you absolutely need a lot of help to get this approved

I have heard that as well, but I am yet to understand why sending more evidence is a bad thing for the purpose of the 751. I uploaded new tax return, bank statements, insurance etc...the more you send the less likely you are to get RFEs in my opinion. I've also noticed this idea lately that you should only send a few months worth of each type of evidence (eg 1 bank statement per quarter)...absolutely no clue how this crazy idea became so popular. I stand by the "send absolutely everything you can get your hands on with both names" tactic. Worked for my initial 130/485 which was approved without interview in 5 months at the height of the COVID slowdown. Your mileage may vary though.

And on a side note, there is a bizarre story going around on various forums lately that you should only send a few months bank statements and a few credit card statements etc...absolutely and 100% incorrect. Send everything you have that has your both names on it. Easiest way to avoid RFEs and possible interviews.

Like some others, my 130-485 during covid and under trump was less than 6 months. I don't think he will slow things, just make the process more selective.

I have just been following Feb/March/April cases loosely on a few forums and seen a few of these types approved quite quickly.

None here. I have been tracking peoples progress who filed Feb and April and no one seems to be having much of anything happen unfortunately except as odd as it is, a few divorce waivers I have seen approved and military spouses.

I wouldn't get too hung up on affidavits. They are basically the lowest form of evidence, sure they don't hurt...but they don't carry much weight.

This is where things seem to get complicated in some attorneys eyes. I’ve read some say what you suggest in that it’s best to wait til you hold the final decree in your hand before notifying USCIS and others who say to notify them immediately if you have filed for divorce so things dont get complicated at N400 time if they adjudicate your case while you are technically “separated”. I tend to agree with your statement but just food for thought. It’s a shame there isn’t more direct guidance from USCIS on how they want this handled, seems like it’s mostly guess work on everyone else’s part sometimes!

Funny you mention this, I am going through CBP at major airports almost weekly and 9 times out of 10 they don't want to see the extension letter or the GC. They must have this stuff on their biometrics system now, I don't even show them a passport anymore.

Upload it. Could be the difference between an RFE and an approval. I didn't have our tax return and a few other documents when we filed and since uploaded it to the unsolicited evidence section. I'd rather do that than have my case on hold for an extra few months if they decide they want it.

There should be no issues at all with travel. I know the case you are referring to, the person in questions friend was on Hackings show getting advice on this and it was a very very very isolated and unprecedented incident. You can’t be kept out of the country til a judge revokes your status. All CBP see is a green card and an extension date.

Solid advice. Side question @mindthegap - Have you been working on getting your 751 since 2015? Or am I reading your history wrong? 8 years for a 751 is ridiculous. I hope you get approved soon. Can't even imagine how stressful that must be.

Yeah those are good points. just personally think he goes a bit overboard sometimes and is probably causing a lot of folks some severe anxiety when it’s not needed. I mean the other day someone just said “I got an RFE for my 751” and he put the fear of god into them saying how unusual it is and should never ever get an RFE etc…which seems very untrue from what I have seen on here and elsewhere. Plenty of folks get RFEs and it doesn’t mean anything particularly bad a majority of the time. Just my opinion anyways

Yeah funny you say that. I’ve noticed he is excessively negative and cautious to the point of putting absolute fear into people over their situations, which in my opinion is not called for or necessary. I’m sure he is a good lawyer though. But yes, this case sure sounds like it needs some help. Hope they get it approved.

Things will slow back with the government shutdown. Yes, USCIS is "self funded" but everyone needs to keep in mind, they rely on many other federal agencies and government sectors to actually process the entire case. So except delays picking up again now the shutdown is happening.

Does anyone know how accurate this sites data is? I have read that USCIS changes the way they publish case information and what we see on this site may not actually be legitimate.

Just a few random pages. I assume they have it all scanned but this is all that populates for us, for 25 pages the file size is pretty big. So for the hundreds I submitted I’m sure the file size would be out of control! pretty cool none the less. I added a few new documents to unsolicited evidence like new tax return and a few random bills, anything to prevent RFE is good!

This is very interesting! Maybe this means something is moving with March cases. Mine just showed the same, clearly someone has done something with our cases in the last week or so.

Also traveled many many times on the letter, 3/4 of the time they don’t even want to see the letter at all - despite me offering it to them - and I’m through immigration control in seconds. It’s quite odd!

You are still on just case received? Not even the "actively being reviewed" ? None of this process makes any sense at all.

March filer here and same deal. All I am seeing is dates blowing out further and further for processing. I am anticipating a decision in early 2025 based on the current climate. And who knows what will happen if Trump or another hardliner gets elected next year.

This is true... But it wont be mistakenly approved if the OP writes to them and explains they are in divorce proceedings and will provide the decree on date X when it is available to them. Actually everyones favourite online immigration lawyer just recently specifically said "If you already hold a conditional green card, you are not legally obliged to actually tell USCIS you are in divorce proceedings. You just have to provide it once it is final" - But obviously most of us know doing this could cause problems at N400 if you didn't provide a solid case at the outset. I suspect as always, best advice is to take everything on here with a grain of salt and speak to a lawyer to make a sensible decision. Good luck!
