  2. No recent activity at all. Last update was in December which coincided with a generic response to an email I had sent previously. Pity I haven't kept an eye on it until now so I could have known when it was re-opened.

  6. Have you heard this from people who received visas in the end? I posted a while back if people who got their visas noticed unsolicited updates on the CEAC tracker prior to receiving their passport requests but no one responded. I can't blame them from not being on here either though lol.
  7. That sucks. You'd think if they opened your case after so many months unsolicited they would be making a decision. Maybe their getting ready to contact you still, seems they usually request passports around a month after receiving clearance from the DOS. The holidays may have delayed the request also. Hope you hear something soon.
  8. Think it’s across the board seeing as it’s Federal regulation. To be honest I think it may not mean that the CO will actually reconsider an application unless they’ve received the clearance first. Perhaps if the clearance has come in for a case and that clearance info has been lost amongst the pile of info the consulate receives a reconsideration of the visa may prompt the CO to dig for the clearance itself.   9. Our Interview was in March and still news. Hopeful signs last week with two April interviewers receiving unsolicited updates on CEAC tracker. Just to add for anyone interested, I seen a post by Red Eagle Law on X that stated that by law a refused visa must be reconsidered by the consular officer on the 1 year anniversary from the interview date provided that the applicant was asked to and provided additional information post interview. We would all meet this criteria since we've given them the DS-5535. Who knows if that actually means they do anything.
  10. My last two emails received responses in October and December about a month after I sent them. I haven't sent an email since November as it just seems pointless. Not sure if anyone on here has ever really had a positive response to an email inquiry. Although someone recently posted that their congressman received an email response from the consulate stating they would request passport be returned to the consulate soon. I just cant see the consulate responding to a personal inquiry with the same email but hopefully that can be proved wrong.

  12. Not sure I understand your question fully. I assume that by soft rejected you mean Motion to Dismiss? I think by and large the length of time since you've submitted DS-5535 is the deciding factor in whether you are issued a MTD. That being said, on a case by case basis the DOS attorney that ends up being assigned to your WOM case is a Human, meaning that one DOS attorney might see the length of time you've waited in DS-5535 and choose to push the DOS and consulate to make a final decision while another DOS attorney might fight it with MTD. There's essentially no rule book, seems to me that a large amount of the time they act intuitively when dealing with these WOM's.
  13. Yes, the DOS attorneys are issuing Motions to Dismiss more regularly. So far evidence suggests that they are issuing them more regularly if you filed a WOM within 6 months post interview. That being said it could be suggested that they will continue to issue them even if you file a WOM after 6 months post interview. Also seems that it can be pot luck whether you receive a Motion to Dismiss or not which makes the whole process that much more frustrating. Some peoples WOM's that are filed 90 days post interview are working and getting their Greencard over the line. But definitely MTD are becoming more of a trend. We will know more over the next few months where this trend goes but it definitely feels like the timeline for getting out of DS-5535 is being extended. 1/1.5 years even with a WOM might be ambitious at this point sadly.

  15. 100% agree and understand that. What we’d all like to try and find out is the particular reason behind the higher rate of Motions to dismiss for WOM’s. Which seems to be a more recent trend.
  16. Interesting to hear Goldstein essentially recommending the 4 month wait but at the end of the day they would say that not to discourage people from paying them $5000 for the WOM. Hacking seem to be way off the mark with their take on dismissals happening before people have their interviews. Thanks for the input!!
  17. Hi Everyone Just wondering if anyone has any interesting information that might lead to an explanation for the apparent radio silence we're experiencing right now with these Visa applications. Perhaps anyone who has spoken to Lawyers and gotten their perspective on the current situation. As it stands we know that WOM's are getting push back now, particularly WOM's filed within 6 months of the Interview. I've heard that the conflict in the Middle East might even be having an impact on visa timelines right now. All in all just trying to hear other peoples views and maybe someone has heard something through an Immigration lawyer as you would think that they would be up to date on any issues connected with Immigration. Hard to make sense of it all so would like to see if others are interested in discussing this further.
  18. Just wanted to add in here that September 30th was the DV visa deadline and that was just last week. Historically the amount of Visa’s issued by the consulate in most categories goes down while the amount of DV visa’s they issue goes way up in September. All in all I believe they focus mostly on DV visas in September so hopefully going forward they will resume focus on all other categories. You can track how many visas they issue and what categories there in online by year and month. I can’t attach a link here but if you Google US Visa issuance statistics you should find it. Takes some digging but you’ll find Montreal in there somewhere. Stay strong!!
  19. Hi folks. For those that were eventually approved, I'm wondering if you noticed any case updates through CEAC in the lead up to receiving the request for passport email. Would be interesting if there was a particular pattern that we could identify through status updates. TIA
  20. Thanks for clearing that up. Seems like some people in the 2022 WOM group recieved motions to dismiss but ended up having their visa's adjudicated in the end,don't see much info on here regarding those cases unfortunately.
