  1. Not sure what you mean by 'apply for an extended green card'? Depending on her job, skills, education level, she may qualify for an employment based visa. For most employment based green cards she'd need to be petitioned by her employer - and a lot are reluctant to do so as it costs them a huge amount of money, and of course then means the employee can immediately go and work for somebody else. So do factor that in, once she's found a job/sponsor, she must get it in writing that they'll sponsor her green card as it sounds like that will be crucial for you both. And of course, not all work visas are dual intent, so make sure she qualifies for one that will actually allow her to stay permanently.

  5. I’m with Boiler, don’t really understand why you’d do it that way round. Say the children get a visa in 18 months time, they then have to move within a few months and make the US their permanent home. If your wife has to leave the US to get her visa, then it doesn’t make much sense to still have them in separate countries? And in the US without a parent?
  6. What's your Priority Date? And did your petitioner move back to the US? Seems that's why you were originally refused, that they were living in Jordan with no intention of moving to the US? Have you filed a Writ of Mandamus as previously advised?

  9. I think we’re talking at cross purposes. Anybody with an EAD can of course work in the US. I was specifically responding to the above post that was talking about working remotely without an EAD.
  10. Work authorisation i.e. a visa that allows you to work. So we were told no remote work for our UK businesses was possible on the temp (O1/O3) visas we had, but fine on our immigrant visas once they came through.
  11. Did she not tick the box on the I-130? If not then she’ll have to apply in person.
  12. FWIW, our lawyers told me the opposite, said work like that would require authorisation and not to risk working illegally.

  14. I thought they had immigrant visas and moved to the US with you a few years ago? So became citizens automatically upon entry on those visas?

  17. You tell the truth - just what you said above. She entered illegally, stayed for 9 months and hasn't returned to the US since. If she can remember dates then give those too.
  18. Yes, they should do. But if you know you didn't include the correct fee then you can get a head start and just submit a new application asap, no need to wait for it to be returned, it could take a while.

  23. No, you can't switch petitioner. Her mother can petition for her as well, but it's about the same wait for the adult child of a citizen as for the adult child of a green card holder anyway. So your daughter is likely to get a visa faster through you than through her mother, if you applied a while ago. The only advantage for her mother petitioning her rather than you would be that she could then get married if she wanted to.
