Montreal embassy EB-2 interview wait time-Part 2
appleblossom replied to Blueeyes1989's topic in Canada
Yes, you would, and you might find Paris wants proof of French residency, not just citizenship. Most consulates don't like you 'consulate shopping' and will only accept cases from those who are actually resident there - no idea if Paris is among them though, so you can always give it a try. Good luck. -
Because (a) we didn't know if your PD was current or not (you'd be amazed how many people have no idea about the Visa Bulletin), and (b) your interview wait only starts once your PD does become current and you're added to the queue for an interview. So it's useful to know your PD to see if you were current before you were DQ'ed or not. But it's about 12 months for first priority cases to get an IL from DQ date (spouses etc), but yours will be behind them. Can't find any other EB applicants, but lower priority family cases have been waiting for several years - most recent case I can find is still waiting after being DQ'ed in Sept 2020. If you click on your name at the top, the 'my timeline' section is one of the things on the menu. There aren't many of us EB applicants around, so the more timelines we have, the better. Thanks and good luck.

What visa? Where is her husband? And what evidence did she provide? Having kids is potential evidence of a relationship together at some point, but not necessarily a current one.

2 years under adminsitrative processing

You can file a Writ of Mandamus. Is there a specific reason to visit the US? Maybe another country would offer something similar. -
What’s your Priority Date? Please fill in your timeline on your profile, thanks.
-
So it hasn’t been approved? Please do fill in your timeline, it’s really hard to help without that. Your CPSA calculation will depend on exact dates, but if the I-130 is still pending that’s a good thing.
-
Employment letter and job offer letter would be the same thing?
-
Then there’s your answer, EB5 or EB2 NIW seem to be your only options. Although I disagree the EB2 NIW is ‘usually business’. Two thirds of the EB2-NIW’s approved in the last fiscal year were from applicants in STEM fields.

The US will do all that it can to ensure it's done in a 'timely manner', any delay is usually on the part of another country - in this case, presumably Pakistan where records aren't always great, and background checks can be very slow. The officer shouldn't have made that assurance, as it's not up to them how long it takes.
-
Has the I-130 been approved? Or you're still waiting for that? It would be really helpful if you could fill in your timeline on your profile.
-
Is this a company transfer? Or are you already working in the US? You need a US specific contract, so if you're already working for the company outside of the US they'll need to give you a new contract for your new role in the US. But if you are already working in the US, then yes, your current contract will suffice.

Too vague a question really. There is no immigrant visa to be obtained just from setting up a business or transferring a business. There is an investment based immigrant visa (EB5) if you have the cash. Or employment based ones. But without knowing what you mean by 'business immigration' (how much investment, how many US citizens will be hired, any unique skills etc), it's hard to help further. Perhaps a consultation with an immigration lawyer to see if there are any options may be the best thing to do.

That’s odd anyway. Why is he travelling on his own, without his wife, and not seeing you? Depending on their nationality, your sister may be much more likely to be granted a visitor visa than her husband. So they may want her to try for her to come and visit you alone.
-
Then if you search VJ for that term with expedite you’ll find threads that would be useful. But you’ll need proof (medical records, doctors letter) to show the USC’s medical issue and why you need it expedited. And then if it’s granted you’d need to do the same at the NVC stage. Which family member are you petitioning for? Please fill in your timeline.
-
Surely they’ve already provided this for your I-140 application? So you just need an up to date copy of that, and your employment contract.
-
Your PD isn't current yet, so there is no visa available to you anyway. Exactly what date is your PD in Nov 2021? Please fill in your timeline! Once there is a visa available to you and you are added to the queue for an interview, it’ll be quite a while as Lagos has a big backlog. I think it’s about 18 months for a spousal interview, so yours is likely to be a longer wait as they’ll be prioritised.
-
Exactly, so you don’t need the physical card. I travelled internationally several times before I got my card, it was no issue at all. They both serve the same purpose. The only downside is you can’t have an interview for Global Entry until you have a GC, but that’s not the end of the world and you can still apply for other programs.
-
It doesn’t mean anything really, except it’s being dealt with electronically now. Most cases are. As for how it will take, we’d need a lot more info to give you an idea of that - what type of case, your Priority Date, which consulate etc.
-
Yes, but it doesn’t really matter if you don’t get them until Sept or even later, it’s not like you need them for anything before then. It’s just a pain you have to spend time chasing them but as long as you get them before the beginning of 2025 that’s all good.
-
It'll be a problem with their photos or biometrics I'd think, my daughter had the same thing. So frustrating that they don't contact you to tell you that and you have to wait the 90 days! But helpfully in a month or so's time you'll have an appointment for them to be redone, and once that happens the physical GC will only take a few weeks to arrive. Good luck.

Verbal us visa approved
appleblossom replied to Passat1's topic in US Embassy and Consulate Discussion
If you've been given something saying the visa is approved, why do you think there is a problem? Can you upload a copy of the letter? Obviously block out any identifying info. -
Verbal us visa approved
appleblossom replied to Passat1's topic in US Embassy and Consulate Discussion
Not unless you can give us the info asked for above - visa type (F2A?), consulate (Naples as you've now put Italy on your profile?) and what exactly you've been asked to provide. -
No, because that's immigration fraud. There is no way to skip the large queue of people ahead of you, but it may not be as long as 2 years as things have sped up a bit recently, and there is also this option once the I-130 is approved (which takes about a year), if she's eligible - https://www.uscis.gov/newsroom/news-releases/dhs-announces-family-reunification-parole-processes-for-colombia-el-salvador-guatemala-and-honduras I agree with the suggestion above to tell her you're moving to Colombia instead and see what her reaction is, make sure she's not just using you for a green card, as unfortunately it happens all too often.
