It's not 'one long interview', it's usually 5 minutes if that. But it's two steps, firstly you're called up to the window to hand over your documents. Then you sit back down again and wait to be called again for the actual interview. The interview waiver isn't for those apply for an immigrant visa via consular processing. It's only for those applying for non-immigrant visas. So you'll definitely have an interview. Good luck.

Xfinity Internet Bill as proof of residence?
appleblossom replied to PK_Bazm's topic in US Embassy and Consulate Discussion
I don't think will help prove residency. You could have that in a rental or holiday property for your tenants, doesn't mean you live there yourself. Ditto for electric bills. As @Boiler said, you need things like signed lease in your name, job, car insurance, bank statements (that show you were physically in the US i.e. regular grocery/gas purchases). -
I-130 Filing Concerns
appleblossom replied to Equardo's topic in Bringing Family Members of Permanent Residents to America
Only if (a) she entered without the intention of doing AOS and (b) there is a visa number available to her. The latter is the problem as even if you file the I-130 today, there won't be a visa available to her for many years. So she must return to India and apply via consular processing. -
Any updates on Nairobi Kenya processing times?
appleblossom replied to CloudySky's topic in Africa: Sub-Saharan
Nairobi has one of the longest waits unfortunately. You can search timelines to find relevant ones, I think it’s about 18 months. -
There’s a question on the visa app about previous arrests which you’ll have to answer truthfully anyway. But I can’t see it being an issue if you weren’t convicted, and you can say that on the form.

F2B TO F1 category
appleblossom replied to Jamaicanqueen's topic in Bringing Family Members of Permanent Residents to America
You asked above if you needed to do anything and the link above says you do. Personally I’d follow the instructions rather than risk her turning up for the interview and being told she’s no longer eligible for F2B. Your call though. -
‘No Live Trace’ just means he has an old conviction. If his record was clear it would say ‘No Trace’.

As said above yes, but for the current Visa Bulletin you need to look here - https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html As you can see, in this month’s the date for F4 is July 2007, so it’s only moved 4 months in 2.5 years. If you applied for him in 2020 then it’s going to be at least 2040 before there’s a visa available to him, but keep an eye on the VB every so often.

F2B TO F1 category
appleblossom replied to Jamaicanqueen's topic in Bringing Family Members of Permanent Residents to America
Yes, you do need to do something - https://travel.state.gov/content/travel/en/us-visas/immigrate/national-visa-center/immigrant-visas-processing-general-faqs.html#ivp7 Ideally contact them ahead of time to request her case stays F2B, as you’ll have to wait until USCIS approve the request so it would cut down any further wait if you do it now. Good luck. -
Only if they show the petitioner is in the US with transactions there. Just having a bank account there isn’t enough, lots of people have bank accounts in a country they don’t live in. But if they show transactions like i.e. grocery/gas purchases etc, then they’ll help alongside the other documents mentioned.

Our Case Migrated to ELIS

Ok. You’ve still got a few years to go, just keep an eye on the Visa Bulletin. -
Our Case Migrated to ELIS
appleblossom replied to Jedi JayR's topic in Bringing Family Members of US Citizens to America
Why do you think a max 10 years? Those who are eligible for visas now applied in March 2010 or earlier, so 14+ years. Which country are you from? -
EB2-NIW Waiting for Interview Letter in London 2023
appleblossom replied to OnPoint's topic in United Kingdom
Sounds like it was your hard work rather than God that meant you were successful. 😂 Well done, hope the visa application goes as smoothly. Personally there's no way I'd have done my own app, I just wouldn't have known where to start. -
Our Case Migrated to ELIS
appleblossom replied to Jedi JayR's topic in Bringing Family Members of US Citizens to America
There is nothing to do. All it means is that your case has been put in to an electronic system rather than paper. USCIS is gradually digitising but it has no effect on your case at all. -
Whoever this "someone" is, ignore them completely. You are not eligible for a visa any longer and that will be picked up at some point (probably at the consulate stage). I'd focus on getting your parent citizenship so you can apply again as your current application is not viable any longer. The only way you'd still qualify with your spouse excluded is if you were divorced from her.

EB2-NIW Waiting for Interview Letter in London 2023
appleblossom replied to OnPoint's topic in United Kingdom
Yes, you can go through the London consulate, but my point is that you are asking about the time for your PD to become current on the VB, and then it's based on your country of birth regardless of where you are living. For example, somebody that was born in India but living in London would have to wait a decade or so longer than somebody that was born in the UK. I'd STRONGLY recommend not doing an employment based immigrant visa app without a very good lawyer. Ours took several months to put our case together, and the submission was thousands of pages. I think spousal or family based cases are fine to DIY, but not employment based personally. Your friend was very lucky, that's unusual - official processing times show 10 months IIRC, figure about a year and then if it's sooner that will be good, but it doesn't really matter as your friend won't be able to get a visa until her PD is current anyway. Seems @jeleven hasn't even applied yet. -
The website you've attached a screenshot of gives you step by step instructions and a list of the documents required (on step 7 - Civil Documents). That's what you need to follow. Your step-daughters will need to follow the same process, have their I-130's been approved too? If not, your wife can delay the NVC stage until they catch up a bit. Good luck.

EB2-NIW Waiting for Interview Letter in London 2023
appleblossom replied to OnPoint's topic in United Kingdom
I answered this above? I-140 approval time will depend on if you/your employer pays for premium processing or not. If so then you get a response within 45 days, if not, then about a year. Probably no point in paying for PP though as your Priority Date won't be current for a while so you may pay $3k for nothing. You need to look at the Visa Bulletin each month to see what the current date is, as you can see from below it's currently 15th Jan 2023, meaning only those who applied before that date can get a visa. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2024/visa-bulletin-for-june-2024.html Your lawyer will be able to advise you on it all as well. Were you born in the UK? Note that it's country of birth that matters for the Visa Bulletin, not the country you're applying in. Good luck.
