What do you advise I do?
appleblossom replied to imenivity's topic in What Visa Do I Need - Family Based Immigration
I think any non-immigrant visa is likely to be refused from what you've said. But you can certainly try, you may as well give it a shot and see what happens. -
One ways are usually always more expensive than a return, as the airline has a duty to return you to the country of origin if you're refused entry, so they price that in to a one way. Most people just buy returns, but that's for when they chose not to use the return leg. I flew on a return which I made sure was flexible so I could just use it some other time. But you seem to be saying your husband wouldn't travel on the first leg? So I'm not sure that would work, as the return may well be cancelled if he's a no show for the first flight.

EB2-NIW Waiting for Interview Letter in London 2023
appleblossom replied to OnPoint's topic in United Kingdom
There's a table on various posts with timelines on - please do fill in your timeline as well as it helps hugely. But figure about 3-4 months from DQ to interview as a rough guide. Good luck. -

When were they DQ'ed though? That's the pertinent info. -

Having a rental property isn't a tie, you can rent that from anywhere in the world. Are you sure your visa was only for a month? That's very unusual (most are 10 years, multi-use) and sounds like there was an issue from the start. What was the actual reason given for the refusal last time? J1 is also non-immigrant as said above, so you'd still have to show you will return to your home country for that. If you really were only given a one time use B visa, then I would think your chances are incredibly low, as that indicates there is something on your record that they're concerned about. -

They were lucky, a lot of Pakistanis (particularly males) do get put in to AP as Pakistani records are so poor and extra checks are needed. Please complete your timeline to help others, thanks. I wouldn’t add it personally. please fill in your timeline to help others, thanks. -

Depends on when he was DQ’ed. If it was only August or September, then no, no backlog. Please fill in your timeline to help others, thx. -

Have you ever worked in the US or overstayed? Proving you didn't overstay should be easy enough, so I wonder why your B2 was denied. I suspect that option 3 may be your only choice - you can try again for a tourist visa though on the off chance it's granted. But if that's refused, I don't see you getting a J1 either, with a USC parent. As you're not an immediate relative it'll be a long time until a visa is available to you, and adjustment of status won't be an option. -

It's nothing to do with him now unfortunately. It could only take a couple of weeks (depending on the reason for AP), but it could also be quite a bit longer. There's a long running thread about the DS-5535 in Montreal which may be worth a read - It's usually due to an occupation on the TAL list, or link with a high risk country (Middle East, Pakistan, etc). -
You can check current processing times here - https://travel.state.gov/content/travel/en/us-visas/immigrate/nvc-timeframes.html It's updated weekly. Do you mean wait time for an interview once you've been DQ'ed? If so, ask on here and people will be able to tell you usually, or you can search the forum to find timelines. Good luck.

That makes no sense. Are you saying you were selected in the DV earlier this year? If so, you should have your visa by now - the deadline has passed. If your case would be resolved between May and August next year, then that would be next year's lottery, and the draw won't take place for a long time yet so there would be no way of having a case number yet. I'm sorry to say but this doesn't sound legit. Have you checked the status of your case number yourself? What does it say?

Then that's why you were given your passport back - you've probably got a lengthy wait ahead of you unfortunately. Good luck. -
Looking to sponsor someone for a visitor visa
appleblossom replied to Klolangel's topic in Tourist Visas
Ooof. Afraid I agree with the others, this has alarm bells ringing for me. Sounds like he’s desperate to get to the US and I very much hope that he loves you for you, and not for the green card you offer him a route to, but he could well have been online solely to try and snare a naive American. Personally I’d test him by saying you’ve decided you don’t want to live in the US anymore and would like to go and live with him in Pakistan. If he is genuine then he’ll just want to be with you, no matter where in the world that is, so his reaction to that suggestion could be quite telling. But if he’s from Pakistan then you’ll probably need several visits anyway, or there would be a much bigger risk of refusal. Pakistan is a high fraud consulate, so one meet up isn’t likely to cut it. If you don’t want to go to Pakistan then you can meet in a third country. Plan to do that several times before filing so you can really get to know him, and build up evidence of a genuine relationship. Good luck. -

Are you resident in Bangladesh? It makes sense to request that consulate if you are. -
EB2-NIW Waiting for Interview at Kuala Lumpur, Malaysia
appleblossom replied to Mahyar40's topic in Work Visas
You've posted this in the spouse visa section, I'll ask a kind mod to move it for you. There's a long thread for EB applicants and I'm pretty sure there is somebody from KL on there - I think it was about a 6 month wait for an IL, but could well be wrong on that. Is your PD current? Please fill in your timeline, thanks. -
No, that’s not true at all. He’ll end up being a dual citizen of both countries, just as you are. You’ll need to sponsor him for a spouse visa, start here - https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/family-sponsorship/spouse-partner-children.html Good luck.
