EB2-NIW Waiting for Interview Letter in London 2023
appleblossom replied to OnPoint's topic in United Kingdom
Yes, that's one of the things that you're required to take to the Visa Medicals centre in London. Can you fill in your timeline so we all know what stage you're at when asking questions? Thx. -
Transit Visas in UK After K1?
appleblossom replied to Kryssie1067's topic in Moving to the US and Your New Life In America
Yes, UK is different, and a transit visa can be required even if not going though immigration, as per the link I gave above - https://www.gov.uk/transit-visa/direct-airside-transit-visa -
You can see how many were issued in FY 2022 here - https://travel.state.gov/content/dam/visas/Statistics/Non-Immigrant-Statistics/NIVDetailTables/FY22NIVDetailTable.pdf 2023 data hasn't been released yet. Refusal rate is very high in Nigeria though, so a lot more will have been applied for than issued.

EB2-NIW Waiting for Interview Letter in London 2023

You have to contact your GP, but don't have to go in person. I applied for my SCR online and got it sent via email about an hour later. So just give them a call or see if they have a way of requesting it on their website. -
Yes. Only my opinion but I’ve only heard of EB applicants getting IL’s so far this month, so I’d guess that spousal are still to come (note definitely just a guess!). Normally the end of the month anyway so still could be a couple of weeks away.
-
Yep, I do. We're very lucky that London is one of the quickest consulates out there, even our passport return was super quick (interview on the Monday afternoon, visa received on the Thursday morning!). I can't imagine how tough it is for people who have a current PD and have been DQ'ed to have to wait 2 years for an interview as at other consulates. You may not get an IL this month, but hopefully should be Feb for an interview in April (ish) as a rough guide. Best of luck.

They don't send them out as a bulk email, each is individual and they seem to come at different times of the day. It's actually pretty transparent I think, London informs NVC of what slots they have for IV interviews, NVC then fill them in Tier order and DQ order. London generally has enough slots that anybody whose PD is current and has been DQ'ed at least 3 weeks before will get an interview, but the cut off date for DQ's can change each month depending on demand. Immediate relatives are given priority over other family categories, so those waiting for spousal/fiance/parent visas will get the first interview slots, and then any left over will be given to the other categories which means that sometimes those in your category or EB categories won't get lucky, but in London that's pretty rare (other consulates i.e. Montreal or Lagos, have people waiting for years who are in Tier 2 or Tier 3 as they have such huge backlogs of Immediate Relative visas to clear first).

OK, so your PD only became current this month, and you've only just been added to the queue for an interview. Hopefully it won't be too long though if you're also London? They move pretty quick thankfully. -

I hate to point this out, but you haven't actually filled in your own timeline! 😂 -
PD is currently 1st Jan 2015 for your category, so 1.5 years behind your PD - https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2024/visa-bulletin-for-january-2024.html But remember that it's not linear, if you look at previous VB's you can see it's only moved 1 month since Sept 2021, so very slow progress in the past 2.5 years. If it carries on at that rate you're still more than a decade away, but nobody can tell you for sure. Just keep an eye on the VB when it's released each month. Good luck.

The route you’ve described is for those already in the US, so not relevant to you. You’ll be doing consular processing rather than AOS. File the I-130 and then once that’s approved you’ll apply for your visa. Here is the process laid out step by step - https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition.html HTH.

Never seen him. I did spend over a decade working as an immigration officer though (not for the US, for another country) so I do tend to look at things from a very fact/proof based point of view. And i just don’t see how anybody can prove that they’ve never been married anywhere in the world. But hopefully @Elon has a cunning plan up his sleeve and will surprise us all!

Transit Visas in UK After K1?

I’m sorry that you felt my response was rude. When somebody has gone to the trouble to find you the relevant info you need to answer your question and to respond to you, I can assure you they’re not just doing it to try and make you feel stupid. Frankly, I have better things to do with my time. I have kids, several businesses, I’ve recently moved to the US myself. Etc, etc. I have enough going on and don’t need to spend my time doing that. I posted what would give you the answer you need, and just didn’t feel the need to add any commentary or opinion to it. I didn’t know you’d seen the website I gave you already. If you had then I’m not sure how there was any confusion. You say it ‘refers generally to anybody passing through’ but there’s a specific ‘do you need a visa link’ on it for each person to get their own specific answer. That tells you that no visa is required for your circumstances. There, was that wordy enough for you? 😂 -
This thread is specific to spousal apps and they’re always given priority for interview slots. Tier 2 versus your Tier 3. You might want to start a new thread for your category and see if anybody else is in the same boat? Good luck.

What is your PD? If you could also fill in your timeline that would be super helpful. In fact, a general request to all as I’ve noticed loads of people don’t have their timelines filled in - please could everybody take 5 mins to do it? Not only does it help everybody else that will follow us (with so few of us EB applicants every timeline helps add to the body of knowledge), but also helps other forum members know the pertinent info when you ask questions. Thx all. -

Yes. Plenty of time. 6-8 weeks usually for London but it does depend on your consulate - is yours London and are you EB2? If you could fill in your timeline it would be super helpful. -

If you really can prove that she’s never been married (including in every other country in the world outside Rwanda), then you may be right. It’s just that we’re all struggling to understand how you will show evidence to that effect. But do keep us posted, it would be so interesting to see how this plays out. I second the recommendation above for a seriously good attorney. This is not a DIY case. Best of luck.

Says 23rd above. HTH. -
Out of interest, what checks do they do in Rwanda to see if somebody is free to marry? I married in the UK and they just take your word for it that you're not married to somebody else. So I'm curious to know how Rwanda knows for sure they somebody isn't already married before they commence the wedding ceremony. USCIS may well ask the same thing, so it may be worth having evidence of the checks they do ready to submit as well.
