  1. Currently only those with PD's earlier than Nov 2019 (nearly 4.5 years ago) have visa numbers available to them, so do prepare him for a longer wait than he had. He can certainly visit them, and vice versa, but it's a big thing to be away from your child for years, so I guess he needs to work out if having a green card is worth that sacrifice. It often is for those from much poorer countries, but may not be for somebody from the UK - particularly as he still has a route to a green card in the future via you if you stay there.
  2. Yes unfortunately, it's the same as when you petitioned your son, they are also subject to a wait as they are not immediate relatives. Category F2A, so keep an eye on the Visa Bulletin - https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2024/visa-bulletin-for-january-2024.html If your son has a fiancee and baby, is he sure he wants to live apart from them for so long? That's going to be tough. It might be worth having a conversation about whether or not he's prepared to do that, or if he gives his green card up and returns to be with them. Not an easy decision I know, but one to discuss with him. Good luck.

  4. You've posted this in the family based section of the forum, I'd suggest you ask a lovely mod to move it to either the relevant country forum, or the employment based one. There's a big thread for EB2 applicants that may be helpful too. This is for CR1 applicants (which will have priority for interviews over your case), but may give you an idea at least, looks like it's at least 6 months - Good luck.

  7. I'd assume so too, but worth double checking I thought - would imagine the OP would know how to file US taxes if he's a USC, but if he's only recently moved to the UK, may not know how to do it that side of the pond.

Things changed then with a Federal Court ruling addressing spouses trying to enter Canada as visitors when intending to apply for PR via inland sponsorship - https://decisions.fct-cf.gc.ca/fc-cf/decisions/en/item/218891/index.do?r=AAAAAQAHVmlzaXRvcgE This ruling is particularly pertinent as the applicant was also a US citizen. Unless the OP's husband has another route to Canada i.e. a work permit, it's not a route I'd recommend for this reason. If the OP wants to move back before their spouse has had their PR app approved, I'd suggest applying outland and then moving once sponsor approval is received. Outland applications are dual intent (unlike inland), so no issue with entering Canada to wait the rest of the process out. There's also no appeal process if an inland application is refused, unlike outland.

  11. If she doesn't need a wheelchair then please don't take that service away from somebody who may actually need it - and she'll still have to queue for immigration anyway, so not sure what the point would be.
  12. Ah, if she has mobility issues, then you can ask for assistance, they're very good (use them for my parents). I'd definitely allow more time though in that case. Good luck.
  13. I'd imagine that's going to limit her options to bigger airports, which may mean she has to do a shuttle/terminal transfer at any of them anyway. If it helps, she can just walk between terminals at Boston, she doesn't need to get the shuttle, they're all no more than about 20 mins walk from each other.

  15. OK, I was just trying to help. You specifically mentioned 'timing is difficult' in your first post - cutting a year or more off your processing time and getting a green card by late spring/early summer may have helped with the that, by avoiding the whole O renewal issue entirely for you. So I thought it was worth suggesting.
  16. It should be ok, but in my experience that is the busiest time at Logan. It's taken me 1.5-2hrs to get through immigration at that time of night before, seems to be when there are less staff but also lots of other international flights arriving. But then I've also had times where I've been through immigration in 15 mins, so it really depends. Will she need to get her luggage too or will that be loaded on to the next flight for her? Most international airports will be similar though. Where's she coming from?

I didn't think Ankara had a big delay (at least compared to other consulates, which are 2 years or more for an interview), there are a few other threads that seem to say about 4-6 months from DQ to IL? Might be worth hunting those out to give you an idea of when you can expect to hear. Good luck.
  19. I've had both. My lawyer said exactly the opposite! I submitted exactly the same evidence for both my O visa and my EB1A, got the immigrant visa through in a few months without any RFE's.
  20. If you have an O-1 then can you not file for an employment based green card instead? It would be be so much quicker than via a spouse, as you can apply using Premium Processing.

  23. I'm sorry to hear that. When your PD became current, how long was it before you started the process, when did you submit the DS-260? The 'sought to acquire' rule isn't something I know much about, so hopefully if you can give a bit more info then one of the forum pros will be along to help you if CPSA will still apply.
  24. Then that sounds like the approval notice date - it took a long time so really helps you and you should be well under 21 according to CPSA. But I've just noticed that it's taken a really long time for you to become DQ'ed, why is that, particularly if you submitted the DS-260's years ago? Remember that CPSA only applies if you 'sought to acquire' a visa within a year of your PD becoming current.
  25. Just another thought - did you marry the children's father before the eldest turned 18?
