  1. Ok. Also, if they see this visa stamp during the interview or before it and see he overstayed, would they question him? And would consider it a criminal conviction? I ask this because I have a friend in Thailand who works in immigration and they told me it is considered a criminal to overstay.
  2. Hi. My husband and I were going through the DS-260 together. There was a question in there that I have a question about. I attached a photo of it. 7 years ago my husband was in Thailand. He overstayed his visa while there. It was 30 days. And then also 7 days again. He was never arrested. But they charged him a fine when he renewed his visa both times. There is also a stamp in his passport stating in Thai that he overstayed for such and such days, and that he paid the amount that was due. I know it is illegal in Thailand to overstay, but is this circumstance considered a criminal conviction? Considering that he did actually go in person to pay it and is that considered a conviction? How should we answer the question in the DS-260?
