  1. What can u suggest for us sir? We go thru the consulate k1 interview…or withdraw our k1 now? Cos im afraid in the future this might have a negative effect if my fiance will file spousal visa after we get married and wait for the ban to be over. We made immigration mistake and i regret that, this has been a difficult process for us. We paying the price being apart longer and spending on lawyers.
  2. Does that apply to a k1 visa, sir? We know i-212 has expiration. And a non immigarant/ immigrant visa. We are applying outside US. Our Atty. Said we wait for the outcome of my k1 interview and then file for the waiver.
  3. The US lawyer give us an option to wait for the 5 year bar and apply k1, Or k1 during the 5year bar and a waiver of 212. We proceed with k1, not aware that it will take 2years for k1 and possible 2years for a waiver. Nov2025 my 5year bar will end. Me and my fiance just want to be together for good and start our family. Me 35 and him 41 old. We have been together 3 years apart. And expensive for him every year to be with me🙁 And this immigration lawyer
  4. Before we file k1, we thought that is the only way for us to get married abroad (USA) cos my fiance has a prior marriage in my country. His marriage Lasted 3mos. But no divorce here. He filed his divorce in the US and dissolve the marriage. Back here in my country we thought his divorce is not recognized. Thinking we can’t get married here. Which we are wrong, just recently consulted a local lawyer and the lawyer said that we can get married here in my country no problem, bcos my fiance is considered foreign and not under the law. His US divorce is OK. Maybe the US lawyer is not aware of the laws here. He suggest k1 and thats what we did.
  5. We will wait for the k1 to expire or withdraw the k1 application. Then Dec 2023 my fiance next vacation leave, he will travel here and we will get married. Wait for my bar to be over😌
  6. Yes mam we have talked about this yesterday with my fiance. We’ll just have to wait for his vacation leave so we can get married in my country. We will still proceed with the k1 since its already in process, see what happens from there after the interview but won’t apply for a waiver application. Just wait for the 5 year bar to be over. But i dont know what will be the impact if ever in future he file for me an spousal visa. If that will give a negative effect, having a k1 refusal.
  7. Yes sir. That’s why we hire his service bcos of my 5year bar. At first Atty. suggest that we can wait for the 5year bar and apply for k1, or file k1 then a waiver. My fiance decided for us to proceed with k1.
  8. That means my fiance has to withdraw our k1 application. He spend a lot for that filed by lawyer. Maybe we’ll just wait for the outcome on my interview. Then if we are ask by the CO to file waiver. I dont know what will happen to our k1 if we dont comply, maybe it will expire😔 I dont want to consult our lawyer that filed the k1, cos the last time i ask questions he is charging my fiance for consultation fee.
  9. I understand that now. The lawyer we consulted advise us to file k1 instead of marrying in my country and file spousal petition. We are not aware of the backlogs that time.
  10. Yes thats a consideration now to wait for the ban to expire. Instead of spending a lot on a waiver thru a lawyer. Thank you for the suggestion.

Hello everyone, i would just like to ask if ever we got refuse for k1 and need a waiver like i-212 bcos of 5yr bar, is it going to expire if we will not file for a waiver, and instead just wait for the 5year bar to be over. Cos we are aware that waivers can take long to process bcos of backlogs. 20.5mos for the process of 212 waiver from uscis website. nov 2020 expedited remove for inadequate documentation 5 year bar Jan2021 my fiance applied k1 2 years since my ban. Thank you for your time reading.
  12. Pls update us when u get your visa. Maybe the port of entry CBP should just made you withdraw application for admission instead of expedited removed with 5year bar. And the consul at the embassy should just said applied for waiver but he didn’t. So there’s a chance you don’t need waiver. But the 5year bar is the complicated part, they can’t issue an IV unless the ban has end. Yes every case is different. Im hoping u hear good news soon. Good luck.
  13. How many years left on your bar? Maybe they will keep your passport until your bar is over. If it already close to 5year. Did you have a document signed like withdrawing your application for submission? That is lighter offense than the expedited removed with 5year bar. I hope you hear soon from the embassy and everything goes well with you. Im interested to know cos we have the same situation. No overstay or fraud. Inadequate documentaion with 5 year bar.
  14. How do you know about the flight? I am in the same situation no misrep, but inadeqaute documentatin and 5year bar with my b1/b2 revoked. My fiance and i applied for k1 and waiting for interview. Our lawyer will file 212 depending of the outcome of my interview. I was expedited removed. And withdraw my entry to US. My return flight was same airline i came to us. (Rebooked) They asked me to if i want the next available flight. I say to just wait for the return flight on my ticket (rebooked) idk if the US government paid for that. I am aware that we have to file a 212 consent to reapply (CTR) or maybe 221g slip will be issued. Now this worries me. Another long wait for the whole process.
