Thank you. Did you include copies of each of those docs with the petition or just bring them to the interview? We are including a copy of our marriage certificate with the petition but weren’t planning on including copies the beneficiary’s passport or birth certificate at this stage.

Her name on her passport is the name she’s been going by her whole life. Her Canadian birth certificate has a comma in between the two last names that her parents wrote to indicate the order. In Portugal, where she grew up and is also a citizen, the government interpreted that comma correctly and registered her with the intended name order. After having returned to Canada recently, she found out that Canada does not recognize the comma in surnames and therefore her name is “flipped” in Canada. Since the process to amend a name on a birth certificate is so complicated, we decided to change it via the marriage certificate (in NY you only need to show your passport) which constitutes as a legal name change. So now, the marriage certificate matches the passport, but those two documents don’t match the BC. Our goal is to use the time while form I-130 is pending, to amend the name on the BC in time for the interview. I understand this is kind of hard to follow, we’ve been having a real hard time dealing with it. I appreciate anyone reading and giving their input.

Did you have this issue? What was your experience? My spouse is in the process of trying to change it on her BC to match her passport before the consulate interview.

The passport and birth certificate are in two different orders as well. The marriage certificate matches the passport. So in effect she has changed her name to match her passport, via the marriage certificate (issued in NY). The name we were planning to provide in the "Other names" section is the name as the order on the birth certificate.

This isn't the issue. She has two last names. On the birth certificate it is in one order (Doe Smith), and on her tax paper work it's in another order (Smith Doe). Hope that's clear!

No, it's not that. It's due to lack of clear hand writing on her birth certificate. The government of Canada issued some ID's with one order and some ID's in another order. She's pursuing an official name amendent in Quebec but it's unlikely to be approved. We made sure to get her name written the way she uses it on our marriage certificate so we are using that one as the legal name.

Hello all, My spouse beneficiary has a unique name situation in that on some official documents her last name order is "Doe Smith" but on a few official documents it's "Smith Doe". Since I'm filling out the section of "Has your beneficiary gone by any other names", should I provide an explanation on the additional information section or is that unnecessary? Would appreciate any input! Thanks
