Additional Information or attach a separate sheet of paper; type or print your name and A-Number (if any) at the top of each sheet; indicate the Page Number, Part Number, and Item Number to which your answer refers; and sign and date each sheet.” @Herndon, I would just keep going and see if there is blank space where you can add that you have previously filed and been approved for your mom. Don’t forget that your i-864 has to include your parents in your household. Do they have income?
  2. The “Add another” option there refers to anyone else he IS petitioning now. Which he is not.
  3. Same advice except substitute i-485 for i-130, Get your docs ready to go. Then ask lawyer for i-485 mailing proof. If none, say you have a package ready to go and will complain to state bar if no proof of refund.

I assume family (because you said out of status): 1) I would start i-130 online (I assume you don't have this filed) and when it's about ready to go, ask the lawyer to give you proof of mailing or you will file it online AND report her to the state bar if she doesn't pony up a refund immediately. Save each screen as you fill it out. 2) once you have the i-130 receipt (should be fast if filled online), then you do the paper-based I-485 youself.

  7. I've never been through the i-130/K1 process but I've been on reddit and VJ plenty. It's a big pain to get CRBA/US passport for children born abroad. 3) Save your texts, photos, travel receipts. 4) File i-130. Make sure you fill it out correctly. Do not put down an address in the U.S. for adjusting status. DO fill out the embassy info under the consular processing section.

  12. It’s actually quite complicated and not about inheritance as you have pointed out. My spouse and I were LPRs when we purchased our 1st property. If I had not contributed an equal amount, then the there would be annual gift tax implications as we owned the property jointly.
  13. Not necessarily. We lost our GCs (issued 2004) in 2007, fell out of ziplock bag on plane. Noticed right away but airline cleaners didn’t find. Got boarding foils in London very easily. Went home, filed i-90s and we got 10 year cards expiring 2017. I know because my spouse filed to naturalize in 2017 and instead of getting a new card, received stickers to stick on back of GC. Naturalized 2018.
  14. Your priority date became current August 2019. You can subtract 12+ years from your children’s ages (if the 2 dates you provided are correct) on August 1, 2019. Your children did not age out and cannot age out. Your biggest problem is going to be the health of your sponsor. Your petition is dead even if your interview takes place if your petitioner dies before you arrive in the US. For this reason, it’s good to have a younger sibling or younger parent have separate petitions for you. And be prepared to file for humanitarian reinstatement should this happen so you can reuse your priority date. Maybe look for Nigerian posters. See what cases they are processing. Get your US relatives to contact their senator. This is almost 3 years.

How old were your kids on July 1, 2020? Double check your i-130 approval date. It seems super unlikely that your i-130 petition was approved in Sept 2020 and you were DQed Sept 2020. Find your EXACT i-130 approval date and you get to subtract the time that the i-130 petition was pending from your children's age on July 1, 2020 (again, always need exact dates).

  18. The single biggest one (for me) is estate/gift tax. As it stands right now and it's not going away - US citizens or LPRs can give/bequeath US citizen spouses any amount with ZERO taxes. The same is not true if the spouse is a foreigner or an LPR.
  19. Bear in mind that it takes 1yr+ from the time you apply for your mother to the time she gets an immigrant visa. I would advise you to file an i-130 for her ASAP to get her place in line, ready or not. Once you have an interview date for her in Montreal, you should start prepping your sister's app (to be sponsored by your mother). That way, the day your mother lands in the U.S., her i-130 for your sister is ready to go. I-130s can be filed online. Do not forget to take screenshots of each page.

In other words, if they are outside the country, table A is the one to look at for CSPA calculation. You can google to confirm.   23. @AV53, you need to find the exact priority date and i-130 approval date.
  24. Are you going to work for a research institution? I would look into getting a non-cap H1B visa then. Also, as you got married in May 2022, you may want to delay your green card (if you are able to get a non-cap H1B) until after your 2nd wedding anniversay. Otherwise you'll looking at $$$ to remove conditions and a lot of paperwork and aggravation to remove conditions from a 2 year GC.
