  1. 1) get married asap - that is allowed on b1/b2 visa as suggested by @discoverusa 2) what do you mean by engagement? Is that a religious event? Where is that? 3) where is the wedding? The Montreal consulate is super slow. From the time you file i-130/i130a, it can take take 2 years. Much easier to have a courthouse wedding in the US or Canada (you need to send away for the marriage certificate in Ontario). Everything in English, no translations needed.

  6. The age of your child (and their marital status) is important. The legitimacy of your child and your gender is also important. 1) if under 18 and 1 of your parents is both a citizen and has met residency requirements, you can file N600k and if approved, your child goes to the U.S. and gets proof of citizenship after oath/interview. 2) if under 21, you can sponsor your child but you have to prove domicile in the US and there are financial requirements. If your child is under 18 when they land in the US, they become citizens immediately if they can prove that they are in your physical and legal custody. 3) if over 21 and/or married, it’s a long wait, as there is a quota for F1 and F3.

  8. Both ways are fine. In Ontario, you have to request a marriage certificate from the province and that can take months. I would get married in the US for that reason.
  9. Sorry, I missed seeing “25 November” so yes, only became current in May 23. You cannot use chart B if not adjusting inside the US. Of course you should pay and go to interview. All you can do is immigrate and file for son.

  11. Yes, there will be collateral damage. But people who want the ineffective walls should want this, and what business does anyone have crossing the border in remote areas anyway? As for overstaying visas, take dna samples for non immigrant visas. One member of an extended family overstay, nobody’s cousin is getting a visa either.

End all asylum claims for those entering through the northern and southern land borders as well as by sea and no benefits for EWI. Encourage seasonal workers, no dependent visas for seasonal workers and have them contribute and be able to get SS benefits abroad if they work 40 quarters.
  13. I don’t know if it is hyperbole. There are a lot of proponents of a physical wall. To me, a wall is problematic from environmental and personnel perspectives. Assuming you could put one up, wouldn’t it be an issue if you didn’t have people watching it at near intervals? And even then, there are ways over and under a wall and what kind of resources would be required to pursue the people who get through? Taking away the possibility of a GC for any overstayer or EWI is fine and easy to implement, but I don’t think it’s tough enough of a deterrent.

  16. The kid is a retail banking associate (teller). Likely he has “group” legal through the employer (big bank). I see what the lawyer was doing. 1) file vawa 2) get EAD/AP 3) drop vawa 4) son files i130/485 as dad now has legal entry It’s entirely possible that this worked for other clients and now others (possibly US citizens) are going to have their status revoked. I wish the Latino community had real advocates who tell them the 2 or 3 ways an EWI can get a GC. Any one of the Velasquez children could have joined the military at 18.

Don’t forget that your i-864 has to include your parents in your household. Do they have income?

  19. Same advice except substitute i-485 for i-130, Get your docs ready to go. Then ask lawyer for i-485 mailing proof. If none, say you have a package ready to go and will complain to state bar if no proof of refund.
  20. 1) What is your package of documents exactly? 2) do you have a copy of what should have been filed 3) work or family based? I assume family (because you said out of status): 1) I would start i-130 online (I assume you don't have this filed) and when it's about ready to go, ask the lawyer to give you proof of mailing or you will file it online AND report her to the state bar if she doesn't pony up a refund immediately. Save each screen as you fill it out. 2) once you have the i-130 receipt (should be fast if filled online), then you do the paper-based I-485 youself.
