The most epic case was the one where he was able to lay down a clear line of descent and requisite time in the US for a man to claim US citizenship from his U.S. born great x 3 or 4 grandparents. As for Hacking, he seems ok based on the shows. Yes, he over simplifies but the callers are also … interesting.

  4. Uscis has been known to give out incorrect information. I would not send in the EAD. Is your spouse a USC? I would hire hackinglaw or schusterman asap.
  5. Ok, so Fester is over 21. 1) You didn't answer the question - what is his current status? H1b? 2) He has an approved i140 through work, and has he already filed an i-485 through work? Does he have work based EAD? 3) what is the priority date of Fester's i-130?
  6. Whoever filed this messed up. They checked both adjustment of status and consular processing on the i130. Your wife now needs to file i824 which will take a year to process.

  10. @LocDenz, simple solution IF they have kids. The kids presumably followed the dad over on his F2B petition? In that case, the kids naturalize ASAP and petition mom. Mom and dad live together in the US and don't re-marry. All they lose is the spousal exemption for estate taxes.
  11. She has to prove she intends to re-establish domicile. She has to either come on the same flight or arrive before the kids. Maybe draft a lease with her, and make enquiries about getting the kids registered in school. But as I said, her kids can apply for US passports day 1 of being in the U.S. Ah, and yes, I forgot about 1 more thing - because the kids are under 18 and can derive citizenship, no need to fill out regular i-864 for them. i864w will do!   12. 1) did your sister have a U.S. passport? 2) do a FOIA on your sister with USCIS/CBP. 3) did your mom take your sister to any doctor or get her vaccinated? 4) yes, get your father’s records from the university. 5) was your sister baptized at church in the US? 6) if not, she can file i-130s for her children - are you in the U.S. and can you act as financial co-sponsor? 7) the minute her children land in the US, they are immediately US citizens if in her legal custody if under 18. Based on this, I would file i130 asap while accruing other evidence.
  13. @Aussielad, was this child born while they were married? If so, it is true that without his co-operation, CRBA would be impossible to get. However, the child can file for a U.S. passport at any time once they are not a minor (I suppose the mother would be acting on his behalf) if he is a child of a marriage between a USC and a nonUSC as if the USC has lived the requisite amount of time in the US.

  15. Based on the regulation I quoted - yes, not because DQ but because you filled out DS260 one year within the priority date being current. Check with the lawyer and show him/her the regulations I posted. It may be another 5 years. Just keep copies of everything. Your father should NOT naturalize at this point.

  17. I urged them to update it. They said they didn’t see the urgency as obviously “something must have synced up” - their POEs would be Caribbean and Toronto. Maybe JFK. Don’t think they have gone anywhere else. The husband’s has expired and you can add yours in via the renewal app. The wife does not want to bother. They filed N400 same time online. Husband got his last year, wife earlier this year.
  18. @Mike E, I have recent Global entry anecdata - newly naturalized U.S. citizen with Canadian passports. So it transpires that neither of my Canadian friends updated their GE profile with their U.S. passport. In the last 12 months, both have gone through GE with facial recognition. Not flagged. Once they went through GE, the machine was busted and CBP officer in the GE line swiped their US passports. No questions asked.

  21. Maybe @Family can refine my ideas here. Go ahead and file i-824 to get duplicate of i-797 notice. She should file i-751. Once she gets that receipt, call uscis and request a ADIT stamp by mail. With that, valid passport and unrestricted SSN, that is all the proof she needs of her green card status for employers. If the i-751 comes back with an RFE, maybe don’t answer it and deliberately get denied. Why? She can then mail denial notice in with her i130 approval notice and i-485 form, to adjust on new basis.
  22. Well, your parents should have filed as LPR for you in 2010? 2011? But I suppose you were already married. When was the i130 approved?
  23. @Zeeshan0321 - have you filled out DS260 yet? This is what I would do - since I read the regulations as allowing you to "lock in the date" from March 2023, when you say your i130 F2A petition was approved AND the final action date was current for F2A: 1) Fill out and pay DS260 fees 2) hire a lawyer If you don't have the DS260 form to fill out, email and/or write a letter to NVC requesting that they send a link to you as it seems to lock in your CSCPA age if you "seek to acquire" within 12 months of March 2023 (even though F2A has retrogressed since).
