I was on H1 visa earlier. Currently, my brother is on H1. -
Hello, My spouse and kid are USC's and I am an Indian citizen. We had moved from US to India almost 12 years back. Now, we all are planning to move back and I was wondering, if we would qualify for filing I-130 through DCF? We do not qualify for any Exceptional circumstances listed on USCIS website. Also, I understand, we would need to show substantial US income in I-864. Can this be my brother, who is already in US and working there? Currently, my wife (the petitioner) does NOT have a substantial income source to support. We also do NOT have any joint asset in US, but we do have an asset in India. Will this help? Thank you
