  1. Yes. My question is how to obtain an offer letter prior to getting an EAD. But, regardless, thank you. Process would be...find job...interview...get offer...apply for EAD expedite (w/offer)...receive EAD...pass e-Verify...start work.
  2. Hello. Self-petitioner Jan 2023. Looking ahead here. Starting a job search in anticipation of getting an EAD. Hopefully getting an offer from a local employer to expedite with USCIS and/or my local congressional rep. I frequently encounter this question..."Are you authorized to work in the US". I am not, but my understanding is that employers are not allowed to ask about immigration status until AFTER a job offer. This seems inconsistent, but I assume legal. Yes, I realize the "authorized" question is not technically asking about immigration status. No need to flame me, or give snark response. Thx. I think employers ask the "authorized" question to avoid wasting time, but in my case, I'm not wasting their time. Any ideas of how to obtain a job offer and answer the "authorized" question truthfully or should I just look for employers that don't ask this question? Thx.
  3. Waiting on receipts for my I-360, I-485, and I-765. Most interested in getting an EAD. From what I've read, the best route is to wait for the receipts and when received inquire with my local congressman to assist in an expedite request. Does that sound correct? Other question is: would I need a job offer, or would it enhance my inquiry to the local congressman if I had an offer in hand with the provisions of expedite requests? Thanks.
  4. Where is the best state to live for VAWA petitioners with only PF?
  5. Any recommendations for a one/two year college program/certificate to pursue using prima facie/FAFSA money? Must be a Title IV eligible institution. My background is hotel, restaurant management, but not restricting myself to that discipline.
  6. Hey. Gotta ask if this statement is law, or from experience. There is a post on this board from someone claiming that she got her green card, no interview, and still lives with her abuser. Since, she didn't have an AOS interview, your statement would still stand. Obviously, this is just one case and I can't verify. I did see a Youtube lawyer say there is specific language in the law that married/separated/divorced is not considered...but maybe that is for the 360 and not the 485?
  7. Travelling on Advance Parole (AP) with VAWA and a 485 pending, still requires a humanitarian reason, correct? Like a letter from an ill family member?
  8. Question about the I-131... If you have a pending 485 and receive Advance Parole (Form I-131), would it be unwise to travel if you have unlawful presence? I'll try to rephrase: Unlawfully present. Filed 360, 485, 765, and 131. If granted 131, okay to travel?
  9. What is the real world difference between paying the fees for the 485, 765, and 131 and filing the 912 fee waiver? A) Identical processing time B) Less than one month processing time difference C) More than one month processing time difference
  10. Is obtaining the EAD or AP conditional on getting a Prima Facie on the I-360?
  11. sandranj had the intent of my post correct - still married and living with the abuser. Still, I have read and watched videos where the status (married, separated, divorced) doesn't matter for VAWA. That specifically somewhere in the statute it says marital status doesn't matter. Couples reunite all the time for all kinds of reasons and congress didn't want to dictate that the couple had to separate or divorce.
  12. Is the EAD conditional on obtaining prima facie, or is it granted solely by filing the I-360 itself?
  13. What is the time delay between filing an I-912 vs. paying the fee? same, week, weeks, month, months?
  14. Understand. There is an entire bona fide marriage package included in my I-130. USCIS has my I-130, but still sounds like I should submit the same information with my I-360. Better safe than sorry. Thx.
  15. Filling out the I-360. I-130 was filed for me in August. I-130 contains a complete set of bona fide marriage information. What should I include in the I-360? (1) Complete I-130 and I-130A and supplemental docs (over 35 pages) (2) Only the 797c receipt notice for the I-130 (IO would have access to the I-130?) (3) Selected information from the I-130 (4) Additional information beyond the I-130 that supports bona fide marriage after it's submission in AUG.
  16. Background: I am still living with my USC spouse. Thank you sandranj. I have all of my information, except the psychological eval, which I just started and I'm looking a 2+ months to complete. I have a police report and I suffer anxiety and nightmares as a result of the extreme cruelty from the incident in the police report. Lawyer says I have enough for PF. I am being advised to file for VAWA now, as I need medical and EAD to move on from my situation. I then would update my I-360 with the psychological eval as soon as it's completed. This makes sense to me.
  17. If I file the I-360 will that close out the I-130? If yes, won't the spouse be notified, therefore indirectly notifying the spouse of a likely VAWA filing? I have an active I-130 filed by my spouse.
  18. Broadly speaking, file an I-360 or wait to collect all of the information? For example, police clearances, completed psychological eval.
  19. I-130 filed, and active. Should I submit the entire I-130 with the I-360? It contains all of the necessary bona fide marriage files.
