  1. My I-140 petition under EB2 NIW has been documentarily qualified and at NVC since October 2022. I relocated to the US on an O1 work visa 4 months ago, and now intent to apply for Adjustment of Status instead as the Singapore Consulate appears to have a severe backlog for EB cases too (except EB3 which they are prioritizing). Besides submitting my I-485, I-131, and I-765 to USCIS, is there anything else that I have to do to move my petition back from NVC to USCIS? Should I contact NVC on their public inquiry form to inform them of my intention to switch to Adjustment of Status? Will this speed things up or confuse the situation when USCIS reaches out to NVC to pull my case back and risk potential loss of my petition? Should I indicate this information of switching from Consular to AOS on my I-485 cover letter? Thanks.
  2. Thank you. Is it ok to submit all three forms I-485, I-765, and I-131, with their respective supporting documents for the Principal Applicant and Beneficiary, all together in the same envelope?
  3. If I file I-765 and I-131 together with I-485, do I need to provide separate supporting documents for each form given that they appear to be processed separately? I.e., 3 separate cover letters, 3 copies of Passport, 3 copies of I-94 arrival/departure records, 3 copies of I-797 I-140 approval, 3 copies of current visa status etc?
  4. Thank you so much. Technically, I didn't withdraw my IV application, but rather, switch to AOS. So, would I indicate "withdrawn", or "Switch to Adjustment of Status" in Item 3?
  5. Yes, completed NVC's DS260, paid all fees, and documentarily complete. But awaiting Interview Letter invitation.
  6. If I switch from Consular Processing to Adjustment of Status, how would I answer this question on Form I-485, Page 4, Part 3? "Item 1. Have you ever applied for an immigrant visa to obtain permanent resident status at a US Embassy or US Consulate abroad? Item 3. Decision (for example, approved, refused, denied, withdrawn) Item 4. Date of decision (mm/dd/yyyy)" I believe my answer to: Item 1 = "Yes" Item 3 = "Withdrawn" Item 4 = same Date I sign I-485 Would these responses be accurate?

  9. I am sure that they are aware of that so I wouldn't worry. Did they give you a deadline whereby you have to submit those documents by?
  10. From my understanding, this is not really a flat out denial. The officer just requires the above documents requested, before they can further process this case. Better to think of it like a temporarily denial, I guess. 1) Medical Report 2) PHIL (Philippines Police Certificate?) 3) SING PC (Singapore Police Certificate?) 4) Proof of Identity (and Name Change Document if she changed her names)

  12. I'm a doctor already practising in the US on a visa. Applied for Consular Processing as I was told that this would be quicker than Adjustment of Status.
  13. I have been contacting the Consulate but they say that NVC is the one responsible for scheduling interviews. I have been DQ'ed since October 2022 but haven't received IL yet. Anyone here with EB petition?
  14. Yeah I have been DQ-ed since October 2022. I'm surprised too. I am not sure what to expect as they have already sent out invites for March and we still have not yet received our IL.
  15. Is it the Singapore Consulate or NVC that schedules interview? I’m confused as I reached out to SG Consulate to inquire about my interview and they said that NVC schedules that. However we know that it is SG consulate who tells NVC when to schedule interview. Seems a bit of a round about.
  16. So you’ll have to go for the interview but wait for the medical in the interim?
  17. Ok. It seems like the IR1/CR1 cases are prioritized and triaged very quickly, so I expect that you will receive IL within 1-2 weeks of DQ. Other cases like EB appear to be taking much longer
  18. When did the Interview Location show up? Did you already receive an interview date? Mine doesn't show Interview Location

  20. I'm sure that they accept cash, credit card or nets. This seems super fast. Did you expedite her case by any chance? I was DQ'd in mid-December 2022 but haven't received my IL yet. But I am also Employment based petition so probably lower priority than Family based petitions.
