My husband and I are in a very sad and unfortunate situation where he might not be able to move before his IR-1 visa expires. I’m absolutely heartbroken and so anxious about it, but right now I’m just trying to explore our options. If his visa expires, can he he reapply? We would probably be looking to move in 2 years, so I’d probably start a new application right away. Will that look suspicious? Do we have to file the full I-130 again or can we just do the NVC/medical/interview loop? If we go this route we will talk to an attorney, but I’m just trying to explore our options right now -
