  1. Do you have an option for AOS? Do you have a dual intent visa like H1 or L1? What made you change from AOS to CP IL are sent basis DQ date only provided your PD is still current. If there is any retrogress you continue to wait. Honesty next couple of months will give some idea on how Montreal is prioritizing EB. They have not yet published December stats but I am not hopeful that they prioritized EB. Starting JAN if they prioritize EB like how they did for family in the prior months you are still looking at 1.5 yrs. On the other hand if your eligible for AOS I guess USCIS has improved processing times so you should get EAD in 6 months and once you get EAD you are basically sorted. Other advantage of AOS is you do not need to submit police clearance letters.
  2. Now that your current have you submitted docs to NVC, do you have a DQ date. Honestly, if you have H1 and if you can go back to the US it’s better to go with AOS. you should apply for EAD and AP and once you get that you are almost there. Montreal is one of the worst in processing EB applications. Unfortunately if you are on TN then CP Is the recommended path and suck it up with Montreal. If you have OCI you can also try India. Unfortunately there are no processing times available for India as for Montreal
  3. How was it renewing the TN. I am going to be in the same situation. Do they question you about the open immigrant visa application. Considering TN is a single intent visa some attorneys are very pessimistic about renewing TN although consular processing is good proof that one will be exiting the country for the interview. I am may 2022 DQd and my TN expires Oct 2023. I was hoping to see it through but last few months there was no progress on EB for Montreal. I have given up hope. I was thinking of renewing via USCIS but it’s super expensive. To renew with USCIS you have to be within US and the only other way of doing it sooner is doing premium processing. That is nearly 2500 extra whereas doing it at the border is approx 60 dollars. Only issue is you don’t know what to expect at the border and which crazy officer you encounter. I have a very bad experience for my previous TN with the officer being very intimidating. He wanted to reject me from the time he greeted me. He ultimately did reject me asking for some damm document which was not even needed. The second time I went with that document the officer did not even bother checking that. So I am really skeptical about renewing at the border now that there is an immigrant visa application in progress
  4. Folks, just trying to get some estimates. For all those who were DQ’d around sep 2020 to Feb 2021, I am guessing the perm process started before March 2020(pre COVID shutdown). Is there any way to estimate how the backlogs moves hoping that the perms filed post COVID probably from March 2020 to September 2020 were relatively less. Is there hope of seeing some big moves?
  5. Do you have a TN or do you have to apply for one? If you have to apply for one it will get tricky because they will know about your application. You can prove non immigrant intent by telling them that you have selected consular processing. TN is a a single intent visa and doing AOS ON TN has its own risk. You will not be able to leave the country till your EAD and AP is not approved. The attorney has their own agenda of charging you and moving the paperwork from NVC To USCIS. Also remember you can apply for AOS only 90 days after entering the country. At the AOS interview they can still question your intent and if they are not happy with your answers they can reject your application. Consular processing is the safest bet.

  7. Police clearance is only needed for anyone 16years old and above. Even if the child is born in India and is now a Canadian citizen and has never been to India for more than 6 months after the age of 16, there is no need to submit a PCC from India
  8. This is a very tricky scenario. Considering your March 2021 there is a good possibility you might get an interview call. Someone from the group with feb 2021 did get a call while some from sept 2020 are still waiting. If you get a interview call from Montreal when still Indian citizen it’s best you delay your Canadian citizenship. The Canadian passport has quite a bit of backlog unless you can show an immediate travel itinerary. If you get the Canadian citizenship call before Montreal you might still be able to proceed. It can get tricky because if it’s virtual then you will need to first wait for the certificate to be delivered before you expedite the passport. In the mean while if you get the Montreal call you will need to directly deal with Montreal. Too much of hassle I would say. If I were in your place I would delay the Canadian citizenship. Get the visa on the Indian passport. Get the GC AND then get the Canadian passport. Canadian citizenship could get delayed but it will get done eventually. It’s a risk worth taking
  9. You mentioned your dq date as March 2021 India. At this point what is more important to know is your priority Queue as per the visa bulletin. Do you fall in the category of ROW or do you fall in the India category. This queue is purely decided on country of birth( you and your spouse) and has no bearing to any citizenship you currently hold. If either of you are born outside India then March 2021 is current. Unfortunately if you both are born in India, the backlog is really long. In fact it is said with the current law in place anybody from India will never get GC in their current life time. Nevertheless you should not worry about paper work and just proceed with Canadian citizenship. You just need to submit your documents to NVC. If you request for change from india to Montreal you will be placed in the back of the queue. However you can continue with India since you are a former resident of India. What matters now is if you are tagged as ROW or India. If you are tagged ROW submit the new documents and continue with India else submit new documents and transfer to Montreal. If ROW my sincere advise would be to be happy with Canadian citizenship and stop stressing about US GC.

  13. I know there was a exercise sometime back to send email to Montreal. Does anyone have that template? It was a really good formatted document(diplomatic and precise). It will be great if someone can share that template. I know it will not matter but I atleast want to try. We can all do it again and again till they hear us. It does not cost us a dime to send that email. We should do it again I feel.

Folks I want to send a general email to montreal consulate to express some dissatisfaction on how they are not prioritizing EB category even when the the guidance to posts for the prioritization of consular services during the pandemic issued in November 2020 has been rescinded. In a previous thread someone had provided a letter template to send to Montreal when the Biden administration had stopped the visa processing priority order(November 19, 2021 https://travel.state.gov/content/travel/en/News/visas-news/visa-services-operating-status-update.html) and they were still focusing on IR/CR. Does anyone have a link to that format? I guess its time to blast their inboxes with emails to remind them to process EB. Especially folks who have been DQ from Sep 2020 to Feb 2021. Although I am way back in the queue I will send the email too. Its high time they need to start focusing on EB too.

  20. Congrats…can you confirm the interview date or month..assuming they give 60 day notice it should be feb 2023 but just confirming. Congrats and start praying that all goes well. If possible get latest police certificates and take it along. These are valid for 2 years and you mentioned 22 months. The last thing anyone wants is the Administrative processing. The other thread on AP is going insane. The percentage of AP have increased drastically.
  21. On the same lines I have a question, I asked this question before but did not receive a response. I currently have a TN visa(which does not have dual intent like a H1) and now if I am placed in AP, Can I still travel to the US to work(not as a tourist). Because once I have attended that first interview I have shown intent to migrate. For someone on TN who is going through CP, one of the response to give to CBP is that since we have an interview scheduled we would leave US and head to Canada thereby proving that our current stay in US is temporary. But once that interview is over what reasoning can we give to prove that the current entry will be temporary. I guess once AP is compete they just ask for passports(they do not call for second round of interview)
  22. CP should be the ideal route. On a TN you are allowed to have a future intent as long as the immediate entry is temporary. If CBP officer questions you need to tell them that you are doing CP and such will leave US for the interview in Montreal which is proof that your current entry is temporary. On TN AOS is very tricky, you will need good justification to say what changed that made you to proceed with AOS. Plus be mindful of the 90 day rule if applying for AOS. if you apply for AOS within 90 days it’s implied fraud. Also till advance parol is not approved you cannot leave the country

  24. Hi Folks, Got a question pertaining to AP. I am currently on a TN visa and a frequent traveler(US-Canada). Since I opted for consular processing, I have not had issues with border crossing. In CP the intent to immigrate triggers when we go for the visa interview. Suppose for whatever reason if the CO decides my case should go to AP and if my TN is still valid, can I cross the border for work or can I now be refused because I have shown intent by attending that interview.
