Thanks for the update. Finally I am current again(EB3 ROW July 2021)so back to the Montreal wait line. DQ date of May 2022 and Montreal has reached April 2022. Fingers crossed for next round of invites. -

Montreal has been super disappointing and they will continue to disappoint. Please do not have any high hopes. If you have any option of switching your VO please do it now. There are folks DQ from early 2022 still waiting. I am DQd since May 2022 and till the Aug bulletin I was current but no IL. Was reading on the blog someone was so fed up with Montreal they asked to switch the VO sometime around December 2022, Jan 2023 they got acknowledgments, March 2023 they got IL for May 2023 and they you go we are still waiting. So if you have any other nationality or your spouse has any nationality do not waste time with Montreal. The other issue with Montreal is the percentage of cases being directed for administrative processing is one of the highest across all VO. There is another blog just dedicated for the number of folks in AP and once in AP It could take easily over 6 months to come out of AP. -

Did anyone with Dq date in 2021and current on the visa bulletin get IL? What is the latest status…do we think EB is still in 2021 or do we think EB has moved to 2022. The Montreal website still says 2020 but that seems weird. Hoping that in October ROW should be current again -

This helps because at every entry the officer determines intent although regular crossing vs going for an interview are two different things. They have much more access and time at hand to go over your profile and if anything does not fit it’s completely at their discretion. There is nothing we can do about it -

I have a similar dilemma. My TN is due in October and basically have to get it renewed because I won’t get the IL. The option is getting it done at the border for 56 dollars or premium processing from within US which will cost me more than 5000 dollars because you have to be physically present in the US till a decision is taken. Doing it via USCIS is less risky whereas doing it at the border is super risky because you don’t know what mindset the officer is in. The only safe thing is because I have chosen consular processing there is no immediate intent but a future intent. Intent kicks in only once you attend the interview and the worst is to have it renew when in AP because now intent has kicked in. Any suggestions or opinions? -

Another disappointment, all these days when EB3 was current Montreal screwed up and did not schedule interview. Now when I expected some traction in this month DOS retrogressed EB3 in the Aug bulletin for ROW to May 2020. They will most likely make EB3 current only in October. Super frustrated with this entire process -

That is just secondary and I don’t think they ever check that. You just need to carry the original documents that you submitted to NVC -

I am not sure why MTL is torturing us with these updates. They could have easily updated EB just like they did for family and mention the date with visa numbers available but they refuse to do it. Nevertheless, around the 20th of this month they will send the next round of IL. So we should get an idea of what is the date for those who are current. In the last round I heard folks till March 2022 did get invites. I am May 2022 EB3 and am hoping for some magic in this round. -

So since I was in TN and already have SSN, I was able to open an account with Bank of America and get a secured credit card to build credit. Also for easy fund transfer I opened a CIBC US account which links with my Canadian account. The CIBC account is a no monthly fee account. I have heard Amex takes Canadian credit history when applying for a credit card. Also capital one provides secured credit card -

The 500000 is accurate but I guess you are missing the deemed sale part of the conversation. As per the article say you got your home in 2015 for 500K and you activate your green card today and say as of today your house is deemed to be worth 1 million(the article says you would have sold and brought the house for 1 million). So now your base is 1 million. Say if you sell your house on 1 Jan 2024 and now the house is worth 1.2 million the capital gains is now 200 k and not 700 k. Also the 200 k can be adjusted across the 500 k deduction for couples -

Question: Do you know of anyone who sold their house after getting the green card and how is capital gains taxed? Canada does not charge capital gains on principal residence but once we activate the green card ideally the current home is not the principal residence. I was reading this article which talks of a deemed sale as on the day we switch residency. Not sure how to get that activated. What could be the large financial cost? Selling the house after becoming a resident? -
Question: can a WOM be filed for not getting an interview call even after being DQ’d for more than year? While Montreal has been prioritizing IR1/CR1 and are processing applications with DQ date as of March 2023, employment based applicants are still as of January 2021 even when these applicants are current as per the visa bulletin. During COVID there was direction to prioritize family reunification however that proclamation was taken back as of Nov 2021. Is there a case here or we just continue to wait?

Question: can we file a WOM for delay in getting an interview call? folks are filing WOM who are in AP for 6 months plus. However not issuing an interview call itself is a delay when it’s supposed to be first in first out. Can the government be sued for this delay? -

That is indeed correct. However timelines are very important. For a person who is ROW it easy for future employment because time from labor to interview is relevantly short and so the petition job roles might still be true when still not working on that role. However for someone from India which is heavily backlogged where the petition was like for example 8 years back and if not working with that employer, questions arise as to why will that company want to hire you 8 years down the line. But nevertheless the interview is for future employment so as long as relevant paper work is good it should be ok. -

It’s not mandatory but in most of the employment based categories the person will be working with the same company either on H1/L1/TN. Also when petition is filed it’s for a job that the petitioner intends to offer the beneficiary for a set role. So if you are not working for the same petitioner and if it’s been long from i140 approval to Interview date they need to verify that the job offer is still present. I am not sure if they also need client letters when working for a service based company but it’s good to carry the SOW or MSA to be safe -

This is very common with Montreal. It’s called administrative processing or AP. There is an entire thread dedicated on VJ for that. People have been in AP for 60 days to beyond a year. Lots of trigger point for AP so not sure what triggered in your case. Please search the thread The dreaded DS-5535 thread for Montreal
