No one really knows why they tag an individual for further processing. Most of the times it’s a system prompt although the VO has discretion even if the system does not prompt. That being said there is no issue travelling to the US when DQd. At the interview they will ask you about your recent visit to the US, what was the longest time you stayed, purpose of the visit. Also CBP can ask you on purpose of visit. In my case I travelled to US for 2 weeks just to get my TN renewed from within US rather than at the border. There were no issues with CBP/USCIS and interview. They also ask you at the interview if you have ever been denied entry or visa refused. I was refused entry once on my initial TN entry for a missing document and I informed the VO about the same. My Initial TN was eventually approved when I went back with that document. I did provide specifics about date and land border of that incident. -

Unfortunately most of the lawyers are risk averse and will always advise the least risky approach so that it does not come back hitting them if something goes wrong. I was in a similar situation like you. I was ON TN and I travelled daily. There was never an issue. Towards the end my travels reduced to once in 5 months. Basically TN like any other non immigrant visa has single intent. Which means when you enter the country you need to show intent to leave the country and not change status. The most important thing is you can have a future intent to immigrate as long as the immediate intent is temporary. So on the 140 when you select consular processing and not adjustment of status that is an indication of future intent and the current entry is limited to the point of IL at which point you would leave the country and go back to canada to attend the interview. Also a lot of folks in the DS5535 group are stuck in admin processing and have had no issues to enter on visitor visa even after attending the interview which is clear intent to immigrate. In case of consular processing intent to immigrate is established only when you attend the interview. You should be good to travel as long as you have enough documentation to prove your travel is time bound and that you have sufficient ties back home. Note: I renewed my TN from within US when the GC process was on and my file was with NVC -

There is no link to know what IL were sent out. The link shared only indicates how many visas were issued for that month. While some could actually be interviewed and issued in that month, some could be cases which were delayed for additional processing or DS5535. These folks could have interviewed in the past and case approved in that month. -

That is the issue, I don’t want to activate it. I just want to cross over on TN. The moment you activate the taxation rules are applicable. Has impacts to RESP/TFSA/house sale/dividend withholding etc etc. I first want to close these loose ends before activating -

Would anyone know..after I finally got the immigrant visa, I am planning on wrapping up all financials and house in canada before I officially enter the US on immigrant visa. However because my TN is still valid is it possible to enter US on TN. I have some work related travel which I am delaying but I am still not ready to wrap up canada. -

For EB it quite common that while your in AP the priority date could retrogress. If that happens even if AP is cleared visa cannot be issued. As soon as the priority date becomes current it would be good to send email to Montreal as a reminder. Normally July to September bulletins will start seeing some amount of retrogress happening as it’s close to end of visa processing year(Oct 1 - Sep 30) -

I guess you are out of options. DV is different from EB. There are only 55000 visa issued every year and they have to be used in the same year. The year starts from Oct 1 and ends on Sep 30. If the visa is not issued by then it’s game over. They had a few exceptions around this during COVID but from your post I don’t think so they are doing that anymore. This definitely needs legal opinion and you should talk to an immigration attorney. I guess you are out of options. DV is different from EB. I am not sure about the exact age( below which it exempted)but small kids do need the full dose. Also I am not sure if the single doses given these days constitute the full dose. You can call the visa doctors office or send them an email. They normally respond pretty soon -

You can get it done with your family doctor. I just asked mine that I need a test done for immunity for those mentioned in the list. He did not ask much and got it done and it was covered under OHIP. However to fill the form and print the lab report there was some charges involved since that was not covered under OHIP. The immigration doctors do need to see the lab results to verify immunity -

Please see the list because it varies per age group. I got mine done at Dr Lyndon Mascheranas at Toronto. If you check his website he has a form for each age group that needs to be signed by your family doctor or walk-in clinic doctor. Also there is a new change introduced lately. Even if you have all the COVID doses your last dose has to be within 12 months of the medical date. If not you will need a booster COVID dose. Also you do not need to take a dose if you have immunity. You can take the list of vaccines applicable to you and you can get an immunity test( I guess it’s called a titter test). If you have immunity you need to take the lab reports on day of medical and that will suffice. I had immunity for all except one so I just got that done. -

I would not think too much on what is specified or stated on the certificate in terms of expiry. If you have left your home country and if that certificate was issued to you after you left that place and if you have not visited again you should be good. That is why NVC accepted it and provided the DQ. All the VO needs to know is that you were cleared by your home country. If you have visited again, the rules are open to interpretation. In this case if its not a hassle, I would go with the safest bet of trying to get another one. In my case it was not straight forward to get one, so i made it a point to not travel back until this was resolved. -

Although USCIS increased validity to two years I would still go with what is mentioned on the Montreal site. In my case the certificate was older than 2 years but even it was not I would still go with the latest one. It does not make any sense to risk it. Also I last travelled to my home country in 2018 and after I submitted the docs to NVC I did not travel back so I just went with what I submitted to NVC. They looked at it and returned it back. If you travel even for a single day and if that travel reflects on your ds 260 they will expect a police certificate if the total length of stay after you turned 18 was more than 6 months for that country. I would not risk it and apply for one else that is good reason to be put in administrative processing. Also remember rules of USCIS are not the same for DOS. recently USCIS made a change for the medical rule that if you have once done medical even if there was a delay you do not need to do medical again but that is not the case with the consulate. -

Sorry for the delayed response. It went really good and I was approved. Summary of my journey: Perm Applied: July 2021 Perm Approved: December 2021 I140(EB-3)premium processing: Feb 2022 approved in 5 days NVC confirmation email: March 2022 NVC DQ: May 2022 NVC interview notification: Jan 2024 Interview : March 26 2024 NVC status change: 4 updates on CEAC- status was on READY for three weeks after interview Issued status: April 12 2024 Passports Returned: April 17 2024(not picked up yet) - I travelled to Montreal over the weekend and picked a hotel which was within walking distance from the consulate. My interview was at 7:45 in the morning on the following Tuesday and I did not want to stress on driving in the morning. - my family and I did a dry run of walking to the consulate the day prior. Just an advice if you do visit just don’t stop at the entrance and continue walking straight in to the RBC bank. The moment you wait at their doors security will approach you and start questioning. - whatever is your interview time, just reach 15 mins in advance. Do not worry about the lineup. When it’s time the security guard knows what is required to be done. - please read the requirements of carry bags. They are very particular on what you can carry in and the bag you carry. - I followed the checklist of documents available on Montreal site. Apart from that I carried additional secondary documents to be safe but none was requested. The additional documents I carried were all that I submitted at the I140 stage to USCIS with latest W2 and tax returns At the entrance there is a airport type security. Basically anything that can beep as you walk through a metal detector is to be removed and placed in the tray. They provide a small locker to keep your mobile phone. I did not carry mine since I was very close to that place. The security will give you two tokens which will have the same number. You will then be asked to take the elevator and go to the first floor. There will be another guard who will check your token and ask you to have a seat. It’s a pretty tight space and get crowded depending upon time of day. Since my interview was early there were few people but as we got done, the place was full. There are washrooms and a water dispenser on the first floor. when your number comes up the first counter is a document check counter. Here you submit the first token. Follow the checklist and submit all documents as they request. They will also take your fingerprints and this entire process takes approx 15 mins. Now you sit back again waiting for the second call. When it’s time you go to the second counter and provide the second token to the officer. The officer I got was super friendly from the get go. They will make you and your family to take an oath that you will answer truthfully. Since I am from EB, they make you sign a form that I will join the same company if approved. some basic questions: - where is my employer based - where will you be working in the US - can you walk me through your profile - Have you travelled to any other countries recently - have you lived in any country apart from Canada and your home country - we’re you ever denied a US Visa or denied admission to the US — my answer was yes and I had to provide an explanation. This question was on the DS260 too and I gave the same answer. I was denied admission while applying for TN at the border for a missing document. I was asked to return with it and was issued the TN - when did you last travel to the US and approx length of stay and purpose of visiting At the end he said that your visa is approved. He kept the latest police certificate and returned all prior police certificate. He also returned the certificate from my home country. He said we would receive the passport back in 2 weeks. It took 3 weeks and was scary because of the unusually high admin processing Montreal has been issuing. This journey with Montreal is finally over. Now starts the next steps of wrapping up and moving over. That is a mammoth task considering all the complications pertaining to taxation/house sale/car sale/ new rental place/ school/ spouse job. I wish all of you the very best. One final tip, keep your answers short and sweet. One liners and nothing more. -

Hi folks, I have been following this post for a very long time because my country of chargeability is Middle East and potential candidate for additional processing. After being current on the visa bulletin for nearly 2 years I finally got my interview with Montreal for next week. Sorry for the unrelated post but I had to renew my sons passport since there was less than 6 months to expiry. Do I have to email Montreal before hand or can I inform them about this change in person? The DS 260 and medical have the old passport number but the registration page for passport return has the new passport number. Is this something I should worry about?Any inputs would be appreciated.

My comments: 1) I feel it would be better to address it to the US consulate in Montreal rather than NVC 2) the subject line does not make sense to me. The visa officer needs an employment letter to adjudicate your application. It can just say employment letter for the post of xxx 3) after the word consultant (Job Title)would be good to add the statement on a full time basis 4) Ensure the salary is greater than or equal to that specified on the PERM and 140 5) after the word beneficiary (first time)ask them to add your full name -
