August 2022 - AOS Filers
LA1234 replied to Sarge2155's topic in Adjustment of Status Case Filing and Progress Reports
Hi, just had a question regarding the timeline it takes to obtain a green card with a K1 visa after submitting I-484 AOS. I know a few people who have went the I-130 route and were married in their own country and when the spouse came to the US it took them at most 90 days to obtain their Green Card and social security number because USCIS considers a married spouse an "immediate family member" and a Green Card is guaranteed compared to other categories that have a Green Card annual quota limitation. From what I have read on the USCIS website once a Fiance comes with a K1 Visa and gets legally married in the US than USCIS considers that as a spouse and falls in their "immediate family member" category. After this why isn't the process similar to a I-130 filer where a Green Card is guaranteed to the spouse and delivered within a short timeframe. For those that have submitted their I-484 AOS and havent received their approval / Green Card yet do you know if SSA sends the spouse a social security card while waiting for the approval of the AOS and what that time frame is? During this whole process of waiting for AOS approval can the spouse work, get a drivers license, get health insurance? It seems ridiculous that a legally married spouse has to wait two years based on some of the processing times I m reading on this thread to obtain legal status to participate in the society. Something doesnt add up about some of these long processing times and I am not sure if the USCIS processing times are looking at all visa categories grouped together and not based on specific visa cases. -
Thanks for the info. Since we are in similar timeline for the K1 Visa, I have been looking at the next step as far as applying for Form I-485 for permanent residence / change of status. I know for immediate family members that go through the immigrant visa I-130 they usually obtain a Green Card once they immigrate to the US within a 2 -3 months since Green Cards are unlimited for immediate family member category. For K-1 Visa once the fiance gets married within 90 days and applies for I-485 does USCIS treat that as an "immediate family member" for which a Green Card is issued within 2-3 months similar to a person with a I-130 or does it fall under the secondary family member category where Green Card's are limited and have to wait over a year for a Green Card to be available and issued?

For any of you December 2022 NOA2, did you Visa Status change from "At NVC" to "In Transit" recently? If so did NVC send you an email notifying you that your case is in transit to the embassy? How long does it typically take the NVC to mail the case to embassy? Did any of you that have your case "At NVC" sent a follow up inquiry to NVC to ask for the status of your case?

Did you just check the Visa Status via the Case Number or did you log into https://ceac.state.gov/iv/ with both the case number and Invoice ID number? Curious to know because NVC only sent me the case number and not the Invoice ID number so was wondering if you log into the website with the Invoice Number what does it allow you to do or see? Right now with only the NVC case number you can only check the Visa Status which states "At NVC".

Yea I'm not sure either. Its frustrating because they dont provide you with any instructions on what is next. Its like you have to constantly drag information out of them. Do you know if we are going to receive a welcome letter? From previous posts that I have asked most have just said they received the email with the NVC case number.

I got the same thing. Did they send you the Invoice ID Number? They tell you to log in to the ceac.state.gov/iv but you need an Invoice ID Number to do so. Wondering what the next step is, if we have to inquire NVC for the Invoice ID number or will they email us once the case is mailed to the Embassy.

Hi All, Has anyone else just received the NVC case number without the Invoice ID Number from NVC through an email with a message that states "You will be notified once this case is forwarded to the assigned US Embassy"? When you log into the CEAC Visa Status it just says its "AT NVC". They tell you to log in to the website ceac.state.gov/iv but you will need an Invoice ID number to do so. Was wondering if others are on the same boat and what this means and what the next step is to get that Invoice ID Number. Thanks

Nice, congrats that's great news that NVC is moving along with the cases. Did NVC also email you the "Invoice ID Number" or just the case number? Were you able to log in to CEAC with just the case number? On the CEAC website did you log into the "Immigrant Visa Check" or "Non-Immigrant Visa Check? Hi All, Does anyone know if its possible to add the beneficiary's email address to NVC file so the fiance also gets email notifications. Once NVC sends the case to the embassy does anyone know who gets notified from the embassy is it the petitioner, beneficiary or both and how do they notify that person by email or mail? The reason why I am asking is because I only recall them asking for the petitioners email address on Form I-129F and am curious to know how the beenficiary gets notified by the embassy when they receive the case from NVC. Thanks

Hi, Just curious to know how did your fiance get an email since I don't recall they asked on Form I-129F for petitioners email address and am interested in setting that up if its possible. What is the Invoice ID number used for? Do you need it to log in to CEAC? Did you get a letter in the mail when NVC created your case number or did they send it to you through email only? Thanks

Did you receive that email from NVCresearch or from the NVC website Public Inquiry Form. I inquired through the website Public Inquiry Form and they emailed me saying they haven't received my petition yet from USCIS, than next day I get an email from NVCresearch which is verbatim to what you got stating that they have received my petition from USCIS and are processing it. Not sure what to believe now.

Hi All, Was wondering if any of you December 2022 NOA2 approvals have send an inquiry to NVC yet through the NVC website or the NVC research email and what kind of responses you got so far. I send an inquiry through the NVC website and got a response early this week saying they have not received the petition yet from USCIS. It has been about 7 weeks now since I got the NOA2 so its kind of strange that its taking them this long to mail paperwork from California to the NVC location, at this point it seems to be another never ending waiting game. I did send an email to NVC research and am currently waiting for their response. Just curious to know what others are seeing as far as email correspondence from NVC. Thanks

Thanks for all the information, its very helpful. I had one more follow up regarding completing the DS-160. Does the DS-160 application ask for your NVC case number? The reason why I'm asking is because I read specifically from the embassy's website for which my application is going to that you do not submit or start anything until you get instructions from them first or else whatever fees you paid will be wasted and not reimbursed and that you have to submit the Ds-160 application again . Was curious how the DS-160 is eventually linked to your K1 Fiance visa application because I know the DS-160 is also used as a tourist visa so was wondering how does the embassy distinguish that your application is for a K1 Fiance visa when you submit the DS-160 application prior to you receiving a welcome letter from the embassy. Thanks Thanks for all the information.

Hi All, I had a few questions for those that have received their case number from NVC and also notification from the embassies. 1. How long did it take between NOA2 approval and NVC creating case number? 2. How long did it take between NVC creating case number and embassy notifying you that they have received the case from NVC? 3. How did the embassy communicate to you that they have received your case, was it via email or mail and was the notification send to the petitioner or the beneficiary since Form 1-129F only asked for the petitioners email address? 4. When in the process did you apply for the DS-160? 5. How long did you have to wait to schedule an interview with the embassy from the time the embassy received your case? 6. How far out was the interview date from when the embassy received your case? 7. On the NOA2 Approval letter that was sent from the USCIS, it says there is a 4 month "Approval Notice Valid" period. What does this mean and do you have to take any action if approaching this deadline? Thanks for your feedback.
