  1. Interviewed on June 22nd. I-130 approved but I-485 awaiting review since. On 23rd June it was showing as "we are actively" and nothing outstanding etc. Today it has another update - "case is being actively reviewed by Uscis" If already under review, why the new update when its still under review ? Anybody seen similar ? The optimist in me feels like they have looked at my case today are finally adjudicating.
  2. That was my first thought. I googled "case sent from Field Office back to NBC" and got a lot of hits. Some saying what you said. Some saying further enqs required. Some saying NBC adjudication. Some saying back at NBC ( for notification letter or card printing ) because approved by FO but not updated.
  3. Update - Now 3 calendar months since interview. Tier 2 had advised that my case was with supervisor for "final review" on 4th Aug ( he was unable to say why it took 6 weeks to get from interviewing officer to supervisor ) and would be a "matter of days for adjudication" As an aside - I googled the phrase "final review" in USCIS context and could find no trace of it being used. Anybody here ever had their case referred to as being in "final review" ? Called USCIS today and was told that the case was sent back to NBC for review. I was under the impression that Field Office were the ones to adjudicate ? I know NBC do all the background checks before passing to Field Office. But nothing was asked at interview that hinted at anything untoward that might need NBC to do more checks. Just reading through my file and confirming answers etc Anybody else had their case referred back to NBC post interview ?
  4. Whether or not it is legal to adjust status depends on the intent at point of entry. Filing a form I-130 is a clear indication that you want to live in the US. Link that to coming to the US and suddenly deciding to AOS ? USCIS could argue that you made your plans to live in the US known as soon as you filed the I-130.
  5. Salt lake city field office has just jumped from 80% in 32.5 months to 38 months.
  6. I am curious which field office because it really affects the wait time. The last time I looked at the "80% of cases adjudicated" numbers it ranged from 13 months ( Phoenix AZ ) to 38 months ( Salt Lake City UT ) If OP is covered by a field office with a big backlog like SLC, maybe it also delays post interview decisions ?
  7. Utah as exceptionally big backlog reflected in long wait times. Now 80% in 30 months at Salt Lake City office ?
  8. Good point regarding the "over a year". However, if one were pedantic, one could say that they do not specify whether its over a year concurrently or over a year in total. It appears that the OP lived at address A immediately before leaving the country AND that address was the last one in which he lived over a year, in total.
  9. If OP is unable to decide where he last lived before coming to US - I am not sure what to say apart from the obvious - most people know where they were living on a particular date. The date in question is your last day in UK.
  10. I do not see any technical difference. Your last physical address is pretty black and white.
  11. There is a reason they ask you on the form, to disclose all names you have used. Supplying evidence of those names is a natural progression. Why are you loathe to do so ? The form says "you must file your petition with copies of the legal documents reflecting the name change" Do you think failing to do that is going to make approval of your application more likely ? Your birth certificate is proof of citizenship. I assume the name on that document is not the name on your passport ?
  12. Call on phone, say "infopass" to automated thing - this gets you to a human. Then just ask them. I was called back by tier two agent a few hrs later.
  13. Could just be a mistake by Atlanta staff ? I had my interview there - it was organised chaos ! Dozens of interviewees in the waiting room. All arrived on time. All checked in properly but somehow the interviewers had no list of those checked in. We sat there 4 hours before we were called. Just before we got called, an interviewer came into the waiting room and called out "Anybody here with a 9am appt ?" - a guy raised his hand - it was 2pm by then - 5 hrs after his appt time. There was a laid back feeling in all the staff - nobody seemed motivated. Atlanta was at 32.5 months wait list when most field offices were half that. I wonder how much of that is due to incompetence rather than anything else. We had I-130 approved instantly but are approaching 90 days waiting on I-485 decision.
  14. Get married and file ASAP - until then, you run the risk of being caught while out of status.
  15. If it was me - I would avoid delay / RFE by supplying as much evidence as possible rather than the "wait and see" approach. With an increase in approvals after waiving interviews etc- you stand a better chance supplying too much evidence.
  16. Congratulations !! I usually do a final check on friday at 5pm and leave it until Monday mornings. Guess I will be checking weekends now.
  17. That is a long wait for a decision ! I was under the impression it was the field office that makes the decision. Anything unusual about your case or circumstances ?
  18. I think the USCIS definition of "actively" is not what you might think it is. But joking aside, it is a step in the right direction.
