I do not understand how he could be a dual citizen as the Malaysian government is not approved of dual citizenship. However, I think that is irrelevant in your case.

As your husband used his Malaysian ID card, I doubt that the US government would recognize the marriage. For more information, you should visit the website below.

And also, whatever you have said during your interview for your visitor visa to the US was recorded (or remembered in one way or the other). My advise is to NEVER lie as it will come back and "haunt" you eventually. I had to go through the interview twice as I did not provide enough information the first time. They required a letter from my company's HR stating that I will be back for my job. You have to give them enough reasons that you would be back to KL (I hope that was your intention in the first place).

I have no idea why the system is not taking the WAC number. It might take awhile before it appear in the system I guess. Just to clarify, the WAC number on the NOA and the bio appointment letter is different and you have to chcek with the WAC number on the bio letter.

Nope, all you can do is wait after the bio appointment unless they have an RFE or something.

I getting worried since I cannot see my case online even if I had WAC....... is says "something like case is not found........". My visa will expire soon Nov. 25, 2010. I submitted my I-751 last August 28 and did my Biometric appointment last Sep. 24 after that I don't get any notice from USCIS like interview appointment or whatever it may be. How long is the waiting period to get approved or notice after Biometric? Is their something to get worried here since my visa will expire soon? Please help me enlighten as I always find helpful people here. Thanks

Before you got your Bio appointment letter, you should have receive the NOA which will extend the green card for another year. It will takes months before your case will be approved or interview. There are many people here who are still waiting for approval after their bio appointment.

By the way, you should be able to check the status of your case on uscis.gov using the WAC number listed on your bio appointment letter.

Am i wrong in my observation that those who have been approved first had interviews in earlier parts of their visa/greencard process. I think it has been talked about before, is that the reason some get approved faster than others or is it entirely random!

We did not have any interviews during this journey. I am wondering if it's got to do with the local USCIS office. It would be interested to know how many of those who got approved has a spouse in the Military service.

Thank you everyone for their help! I really appreciate the assurances. We will make a few copies and I will retain a scanned image of it as well.

You can also make an Infopass appointment with your local USCIS office and get your wife's passport stamp with the extention date!

And since you are done with biometrics, you do not have to worry about that. It might takes a few months before you will hear back from them.

We didn't send in any pictures or affidavits and we were approved on 10/28! I would say it depends on how convincing your other documents are.

Received the approval letter in the mail on Wednesday! I was suprised to see that it came from our local USCIS office! Didn't know that the case is being processed by the local USCIS office.

Got a email at 8pm saying my case has been approved and the card is in production!!!!!!!

Received NOA today! Can someone please update the list? Thanks! Also, FYI, any maiden name GC holders who wish to file under their married name: we submitted under married name and the NOA shows it. Now, only to pass through FBI name check. Waiting on ASC Bio letter now... The wait goes on... Thanks to all of you!!!

Congrats!!! What's the date on your NOA?

So, I went to the USCIS office in Seattle to do an early biometrics as I will be out of the country on my original appointment. Went in about 10.30am and I walked out of the office 2.30pm!!!

When I gave the lady my appointment letter, I explained the situation to her and she said "Take a seat and wait. We will not guarantee that we will see you today and we will call you if there is any availability. And I can't tell you how long is it going to be." So I waited and waited and after 4 hours, they called me. The process only took about 15 minutes! I was glad that the parking is per entry charge and not hourly charge. Remember to bring at least $7 cash with you to pay for the parking as they only accept cash for the parking.

I would discourage people from doing a walk-in biometrics in Seattle unless you really have to.

She can always change her last name in all her documents by providing the marriage certificate. When submitting your paperwork, enclosed a cover letter to explain situation and a copy of your marriage certificate.

Brian & Mel, Glad to know that you could use your visit visa while I-130 was pending. Did you apply visit visa, after I-130 filing?

Kaashparinda, yes, I would recommend "Consular post" IR1/CR1 as well, rather than coming here while I-130 is pending and do AOS. However, there is an exception even after waiving the rights signed on VWP. If AOS is filed within 90 days period of VWP, USCIS cannot deport or remove the person based on the 7th circuit of U.S Court Appeal and it is LEGAL. It is always good to know all the legal stuff, huh? To enter the U.S in VWP, one must clearly demonstrate the tie up (there are many ways) in their home country with return ticket. You're right - never say visiting husband/wife.

Harsh, please let us know your experience after visiting the U.S in B2 visa.

I had my B2 visa before we were married and filed the I-130. On top of that I had visited US twice before I entered US while our paperwork was pending.

Well,like Darnell said...you have to look into AOS. I hope she did not overstay on her visitor visa.

No Green Card. She came as a visitor over a year ago. She has always come to New York since she was little and we got married here in New York City.

Loto - u said she is ok to travel on VWP or visitor visa, I don think that can work.

With either one VWP or Visitor visa one is agreeing they dont have any intention of immigration, while you have I-130 pending, that would be difficult to prove that person has no intention of immigration

I would advice against the travel, but that my opinion.

I actually visited my husband when our paperwork was pending. I stayed here for about 6 months before headed back to Malaysia for my interview. I didn't have any problem at the POE and in fact the officer didn't even mentioned about the immigrant visa.

I am a U.S. Citizen who got married back in November to a very cool and beautiful woman from Jamaica. I want to add her to my income tax return and I want her to work legally cause she wants to help me out since I work so hard every day. We made a two hole punch and bind all the papers together. It looked organised and hard to loose any page. The worst could happen is that they loose the whole stack of document.
