  1. The defense attorney filed it, but it most likely is going to get dismissed. They have been super sloppy with my case. Not even a reaction to the extension. They emailed me a 221g letter, 6 months after the interview! Two days before it got dismissed. My lawyer says it’s probably because the embassy in Amsterdam is not familiar with Iranian applicants. And according to my legal team, the AP is definitely because of me being Iranian. And they probably going to say that I filed a wom too soon. So if you are thinking about it, please don’t do it.
  2. Thank you! This helps me not feeling so alone now. My lawyer does say it’s definitely because of my background, but that European embassies are not that familiar with these type of cases. That’s why they take long and are sloppy on my case. They even sent me the 221g form, 6 months after my interview, two days before the wom got dismissed. I was scared cause I thought that was a final refusal. But you’re right. Even though I feel like I wasted my money om the lawsuit, I can take this time to keep saving my money, travel, and get my life a little back together. It feels like I have been living my life on standby in a waiting room. But we have to move on, cause life is short. There is nothing more we can do.

  4. Honestly, I don’t know anymore. I don’t even know if there’s a point in doing so. I am emotionally exhausted to be honest. I am being punished for being born in Iran, and there is nothing I can do about that.
  5. Here’s my timeline: 26 april 2023: interview 3 may 2023: embassy received ds5535 26 july 2023: filed WOM 2 october 2023: got 30 day extension 1 november 2023: dismiss wom filed in New Jersey
  6. Hi! Just wanted to let you know that after the extension, my lawsuit got dismissed. There is really nothing I can do anymore.

  8. Do you mind sharing why you think they dismissed? Did you file too early? I just got my extension (filed in NJ after 3 months in AP making it 5 months total) and I’m terrified!!
  9. Hey Milad, I got an update on my wom today. I got an extension of 30 days. It means they “need more time” to look into my case. After extension they can always dimiss it. If you want my advice, don’t file too soon or don’t file at all. They are dismissing so many cases now. It’s just going to be a waste of money. We’ll see how it goes after my extension, but I don’t believe the outcome will be positive.
  10. Hi, I think you’re right. My lawyer told me they been dismissing a lot of cases recently. I filed after 3 months…just got an extension today, and I reallyyyy hope they won’t dismiss it, but chances are high they will. I thought a lawyer would advise to wait if they thought it’s too soon to file. My lawyer seemed pretty confident while taking on my case. Guess I was just naive. I’m so done with all the waiting. It has been over 24 months since we filed our K1…..
  11. Oh this concerns me cause I filed after 3months. But the whole lawsuit takes another 60 days so that is 5 months total. Like how long do they actually need? It’s ridiculous! Background checks can be done in 3 months!
