Had you already submitted the i140 when you applied for the TN the first time? Where in the visa process were you the first time you applied for TN. I'm sure it's easier to renew... We had not went down the TN route as we thought it may affect our green card chances.

You need to be in the US to apply for AOS, and you cannot enter on a tourist visa with intent to apply for a green card. So yes then montreal could deny your visa as you would have carried out immigration fraud. Also if you stay over 6 months on a tourist visa you will also be in the US illegally and also increasing the chance montreal would deny your green card.

I agree. Last year from january- may they were clearing over 100 people from eb per month. I had assumed it may have been due to less immediate family applying around Thanksgiving and Christmas and was hoping to see the same trend this year. But still no interviews at all. If they keep doing only 10-15 eb interviews it will take over 5 years before they reach my date. (Assuming there is usually about 60 eb visas per month) I dont understand why they just do first in first out for all groups and stop continuing to prioritize family over all else.

Any other option is better than waiting on montreal at this point. It could easily be over a year still if they continue at their current pace.

Yes. This time last year they were doing 100+ eb interviews per month. Last month they did like 15. I dont know why they stopped clearing out the back log.

It used to be at the start of the month around 6th. Or near the end. 28th. However there's been nobody since may in this group. So its much harder to track.

Nope. The days in which they sent never really had much of a pattern either. I know that family group got sent around 20th Dec for February interviews. But I've yet to see anyone from eb on any blogs or reddit having received a letter since may. They would often send the family letters and the eb letters at different times of the month too.

As tn is a temporary visa. You cannot enter the US with a temporary visa with the intention of staying permanently. It's fraud, and you also risk being rejected at the border which can jepordise your chances of getting your eb visa.

The benefit is the application is already approved. And you are therefore only waiting on the interview. If you are in the US already on a legal visa the 485 makes more sense as you can apply for an ead and work authorization. However you cannot apply for the 485 from outside the US and you must go through consular processing

As it is an employment based visa and not family the waiting time will be the same as employment. So you are likely in for a long wait at montreal. If you have the option to use a different consulate that would be best.

They probably took off a bunch of time for american Thanksgiving. The numbers are usually pretty low in Nov and Dec. 10 visas in a month is devastating though. I think that's some of the lowest I've seen it.

Montreal have been so behind that they have never really been close to what is happening on the visa bulletin. Our priority date is Aug 2022. (Just became current as its now Nov 2022). We were dq'd March 2023 and Montreal are currently interviewing dq's from April 2022. Going off their average of processing 2 months for employment our expectation is another 6 months for an interview invite. 8 months until the interview. But also really hoping the make bigger leaps in processing the backlog.

You need to be current for montreal to offer you an interview. If you priority date is not current there are no visas available for you. 1st step is to become current in the visa bulletin. 2nd step is for montreal to offer you an interview based on the dq date.

It is not possible to provide precise wait times for immigrant visa appointments, as facilities, staffing resources, and local conditions all affect capacity and scheduling. As of December 5, 2023, most Immediate Relative and fiancé(e) visa cases being scheduled for interview in Montreal were documentarily complete at the National Visa Center in September 2023; most Family Preference cases with visa numbers available that are being scheduled for interview were documentarily qualified in March 2023; and most Employment cases scheduled for interview were documentarily complete in April 2022. No progress. No surprise. Although concerning that family preference is falling so far behind now too. No doubt they will catch that category up before looking at employment....

If you can transfer I believe it's best! Montreal have made very little progress and nobody has received interview letters since may.

Yeah they seem to be lumped together. At the current rate of 2 months per month. I'd anticipate 8 months before you get invited as they just announced today they are on April 2022. But we are all hoping they clear the backlog much quicker than that!

Glad to see it's back to apr 2022 and it was just a copy and paste error. Frustrated as always there is no forward progress.

It depends or what country you are from. When your priority date is and when you become dq'ed. As well as what type of visa it is.

As your priority date is current for November. You are only waiting for montreal. Last months update said they were up to dq dates of apr 2022. They are moving on average 2 months per month. Therefore my best guess would be 5-6 months, so April or may 2024. But montreal is completely inconsistent and not transparent. So that's just an optimistic guess.

Every day I open this site in the hope that a whole bunch of people have been invited for interviews. And every day I am so disappointed. No interview letters since may is just mind boggling.

There was more E3 priority during the pandemic as there were many health workers in that group. With some getting an interview within 3 months. But since then there doesn't seem to be much rhyme or reason.
