    We have studied the I-864 instruction. But it doesn't mention anything about whether the sponsor's assets can be foreign or not. It does mention that the intend immigrant 's assets don't have to be somewhere he/she resides. 
    He probably will have to study abroad around 6 months when we need to deal with this issue. We have filed I-130 recently and are waiting for the result. It'll probably take him around 10 -12 months to graduate from now. Hope I understood your question properly.

    If the assets are valued over 3x the minimum requirement for the household size, then it can be used on the I-864 with $0 income.  But keep in mind that it is up to the consul officer to decide whether it is sufficient or not.  Though it is not a rule, some COs prefer US-based assets, so best to transfer the savings to a US account if you still have a long time from the interview date.

  3. Hello all,

     

    My husband is U.S citizen, and is currently studying abroad. I currently reside in the same country with him. He is filing I130 petition and later need to file I864 application to show that he can financially support me when I go to the U.S. However, as a graduate student, he doesn't have income. He only has savings in foreign currency (wnot USD) where we currently reside. I have some savings in foreign currency where we currently reside as well.

     

    My questions are:

    1. If my husband doesn't have any income, can he solely rely on his savings as the proof of financial support?

    2. I know that the foreign spouse( beneficiary) can use foreign assets as supplement to meet USCIS poverty guideline. Can the sponsor (U.S citizen) use foreign assets as well? Or are they only allowed to use their U.S assets?

    Lol that's a mistake.. I do have another question tho. In the online I130 form there's a question "Where in the United States does the beneficiary intend to live?"
    But since my husband and I have left the States for few years cuz his education and we don't own a property in the US, is it okay if we put my relative's address?

    Thank you! I read it somewhere saying that USCIS never sends correspondences to a foreign address... my husband and I live outside the US now, so should we provide a US mailing address?

    Thank you. I was also wondering if CR1 visa was issued but the date I enter the US passes 2 year anniversary, will the government send me permanent green card or conditional green card?

    i guess they will be sending you communications via mail as well.we filed for my husbands naturalization online but they still send confirmation of biometric and other correspondence to ensure one did receive a physical copy. i also believe you will be getting correspondent from the NVC(National visa center ) whenever Uscis part is done and then finally from the consulate. i don't believe they will give you a green card abroad unless you do come to the USA some how once visa to travel is in your hand. According to the delay of everything during covid it maybe longer than expected. Who knows, maybe your husand may move back to the USA. Good thing is you can always go online and update addresses when needed.

    Well it maybe hard for him to prove domicile in the USA. When  I did the filling of my spouse I know that was one of the requirements of the I130, I'm not sure if the rules may have changed from 2016. Perhaps others can chime in.

    Yea that could be a problem that we need to solve.. he might have a US bank account not sure if that's enough..

    Put the address where you currently live and receive mail.

    Well I thought it'd be faster to receive the mail if the address is in the US. Do you happen to know what kind of documents the USCIS would mail? I plan to file everything online.

If it's your address then you will have to put your foreign adresd that isn't the US address. i hope this answers your question. You living abroad, are you referring to outside of USA? If your Outside of the US then you both will use your individual address at whatever resident you reside separately until your granted your visa to move to the USA.

    Hi thank you so much for your answer! I think I might need to provide more information for our situation. So my husband and I are living outside of the US for his education. We currently are living in the same country. He doesn't own a property or have a lease under his name in the US as of now.

    Recently my husband(US citizen) is trying to file  I130 petition for me. We both are living abroad as of now. In the I130 form, there's a question about mailing address. I was wondering should I put my current address which is a foreign address, or is it okay if I put my friend/relative's US address as the mailing address? Which one is preferred or what differences will it make?
