It is quite effective but will cost you about $5,000 to file. It only forces DOS to make a decision, not necessarily a favorable one. 

I personally am following the advice of the attorneys and not filing for the Green card until I have the waiver in hand. So I agree with you, it’s a major risk. I just was curious about the reasoning for a misrepresentation finding. 

The other worst nightmare is that you may also be slapped with a misrepresentation knowing very well that you don’t qualify to adjust your status based on USCIS manual but went ahead to do so for an EAD. That may put you in a difficult situation unless you apply for another waiver to remove that. So the best scenario is to wait but then it’s up to you.

Congratulations on your approval. I think you should send a copy of the approval from USCIS to the office where your case is being adjudicated with a copy of your receipt notice for I-485 since that may be the likely reason your case is pending. You are fortunate your case was not denied outright since you did not have a basis to adjust your status before hardship waiver approval.

I reached out to senators and reps offices, they requested to expedite, quickly rejected and then ignored after repeated requests.  I did not file a lawsuit.  

Just got FR.  52 weeks at DOS.  No government funding.

Got FR today after submitting WoM 2.5 months ago (DoS asked for a 2 week extension). My lawyer reached out to me this morning and said AUSA told them the case is approved. The site was updated roughly 3 hours later.
 
Paid 3.5K for the attorney and highly recommend them. Dm for the attorney recommendation. 
 
 

Finally got approval.
 
My case has been pending with DoS since Feb 2022. Filed a lawsuit which took about 1 month for all parties (USCIS and DOS) to be served. Once they got served, it took around 3 weeks to get FR from DoS. USCIS asked for an extension until Nov but ended up approving the case and sending me the final waiver within 2 weeks of FR from DoS. 
 
I hired a lawyer and paid 5K. Good luck everybody 

Still waiting, since June 2022 at DOS. There have been some approvals that I saw on the FB J1 Waiver group. They were mostly cases from 2021. 

21 months for recommendation. Wow!! 

Another one got it finally.

Nope. The most recent waiver statistics available is for year 2021 on the website. Nothing for fiscal year 2022 and fiscal year 2023 is almost coming to a close. 

I have a positive feeling that a lot of people will get decisions on pending J-1 hardship waivers this month since the 2023 fiscal years closes on 9/30/2023. 
Fingers crossed.

Thanks for your answer. For my case, it is 15 months since DOS received my I-612/613.

DoS typically mails you the decision in the stamped envelope that you submit with the application. However, not everyone receives that.
